RESOLUTION NO. O 316
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING FUNDING OF THE DADE-MIAMI
CRIMINAL JUSTICE COUNCIL, IN AN AMOUNT NOT TO
EXCEED $35,000; ALLOCATING FUNDS FROM THE LAW
ENFORCEMENT TRUST FUND, PROJECT NO. 690001,
SUCH EXPENDITURE HAVING BEEN APPROVED BY THE
CHIEF OF POLICE AS COMPLYING WITH SECTION
932.7055, FLORIDA STATUTES (2000).
WHEREAS, Section 932.7055, Florida Statutes (2000),
authorizes the expenditure of forfeiture cash or proceeds for
certain law enforcement purposes not considered normal operating
expenses; and
WHEREAS, the Miami Police Department supports the endeavors
of the Dade -Miami Criminal Justice Council (the "Council"); and
WHEREAS, the Council researches and writes grant
applications and assists in formulating policies and procedures
for municipal law enforcement agencies, as well as conduct
research studies and write articles on topics of interest to the
law enforcement community that appear regularly in law
enforcement publications; and
WHEREAS, the Council also serves as the Advisory Board for
the Police Department's Law Enforcement Block Grant; and

WHEREAS, funding by the City will assist the Council with
expenses related to its research and grant writing efforts; and
WHEREAS, funds to cover this expenditure have not been
included in the Police Department's normal operating budget and
are available in the City of Miami Law Enforcement Trust Fund;
and
WHEREAS, pursuant to the provisions of Section 932.7055(c),
Florida Statutes (2000), the recipient, the Council, shall
(1) certify that the funds appropriated will be used lawfully and
for the purpose stated, (2) be required to maintain proper
accounting records for the expenditure of such monies, and
(3) provide any reports, including, but not limited to, audit
reports, as may be required by the City of Miami or applicable
law; and
WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the expenditure proposed
complies with Section 932.7055, Florida Statutes (2000);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Funding for the Council, in an amount not to
exceed $35,000, is authorized, with funds allocated from the Law
Enforcement Trust Fund, Project No. 690001, such expenditure

having been approved by the Chief of Police as complying with
Section 932.7055, Florida Statutes (2000).
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.!'

the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing funding, in the amount of $35,000, for the Dade -Miami Criminal Justice Council.
Funding is to be provided from the Law Enforcement Trust Fund, Florida State Statute Chapter
932.7055, Project Number 690001.
BACKGROUND
The Dade -Miami Criminal Justice Council researches and writes grant applications and assists in
formulating policies and procedures for municipal law enforcement agencies. The Council serves
as the designated Advisory Board for the Local Law Enforcement Block Grant (LLEBG) program.
They are also responsible for conducting research studies and writing papers on topics of interest to
the Law Enforcement Community. The funds will be used to assist the council in implementing
these goals.
