A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR-FIFTHS (4/STHS) AFFIRMATIVE VOTE,
AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND AWARDING A CONTRACT
TO DAYAN CONSTRUCTION, INC. FOR THE PROJECT
ENTITLED "MORNINGSIDE PEDESTRIAN BRIDGES
REPLACEMENT, B-6367," IN THE AMOUNT OF
$28,775; ALLOCATING FUNDS FROM PROJECT
NO. 311016, AS APPROPRIATED BY THE ANNUAL
APPROPRIATIONS AND CAPITAL IMPROVEMENT
PROJECTS ORDINANCES, AS AMENDED, IN THE
AMOUNT OF $28,775 FOR THE CONTRACT COSTS AND
$6,225 FOR EXPENSES, FOR A TOTAL ESTIMATED
COST OF $35,000, AND AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PROJECT.
WHEREAS, due to numerous complaints received regarding the
unsafe condition of the pedestrian bridges in Morningside Park,
barricades were placed around the bridges; and
WHEREAS, the barricades have been removed several times by
a person or persons unknown, creating an immediate danger to the

health, safety and welfare of the citizens and residents in the
area; and
WHEREAS, the City Manager made a written finding that the
repairs to the pedestrian bridges in Morningside Park
constituted a valid emergency; and
WHEREAS, informal quotes were solicited and Dayan
Construction, Inc. provided the most responsive and responsible
quote for the emergency repairs; and
WHEREAS, funds are available from Project No. 311016, as
appropriated by the Annual Appropriations and Capital
Improvement Projects Ordinances, as amended;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

public hearing, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bidding
procedures, and awarding a contract to Dayan Construction, Inc.
for the project entitled `Morningside Pedestrian Bridges
Replacement, B-6367," in the amount of $28,775, is ratified,
approved and confirmed, with funds allocated from Project
No. 311016, as appropriated by the Annual Appropriations and
Capital Improvement Projects Ordinances, as amended, in the
amount of $28,775 for the contract costs and $6,225 for
expenses, for a total estimated cost of $35,000.
Section 3. The City Manager is authorized!' to execute
an agreement, in a form acceptable to the City Attorney, with
Dayan Construction, Inc. for said purpose.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayoral

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the
attached Resolution ratifying, approving and confirming the City
Manager's finding of an Emergency, waiving the requirements for
competitive sealed bidding procedures, and authorizing the
acquisition of services for the Department of Public Works for
Capital Improvement Project No. 311016, entitled Morningside
Pedestrian Bridges, located at Morningside Park, and awarding to
the lowest responsive and responsible bidder and to proceed with
the construction of the project.
BACKGROUND:
Several complaints from members of the Morningside Homeowner's
Associations were received stating that the bridges were unsafe
and that some one had gotten hurt using them. The bridges were
barricaded immediately, but the barricades have been removed
several times by unknown members of the public and had to be
replaced frequently.
On October 27, 2000, the City Manager made a written finding that
the pedestrian bridges at Morningside Park were in need of
repair. The Department of Public Works evaluated the bids
received on November 11, 2000 and determined that the lowest
responsible and responsive bid in the amount of $28,775.00 was
from Dayan Construction, Inc. and proceeded with the construction
of the project.

Emergency Finding Waiver
of Formal Bids for
Morningside Park
Pedestrian Bridges
This memorandum serves to request your authorization to proceed with informal bidding
to award to the lowest responsible bidder a contract to repair the three (3) pedestrian
bridges located north of the pool and cabanas building at Morningside Park which are in
disrepair and present a safety hazard to the public. The Department of Public Works has
estimated the cost of repairing the three bridges at approximately $35,000. Funding to
cover this emergency has been identified from CIP No. 311016, Index Code 589301 and
Minor Object No. 830.
The finding of emergency is based on the need to conduct immediate repairs to prevent
public injury as a result of the condition of the pedestrian bridges. In order to correct this
possible future liability to the City, we need your authorization to proceed with
immediate repairs through an informal bidding process. This item will be placed on the
next available Commission Agenda for ratification as soon as possible after the work is
completed.

In response to your inquiry, as soon as we discovered that the pedestrian bridges at Morningside
Park were in need of repair, we reported it to our General Services Administration (GSA)
Department. It; was determined by GSA that architectural/engineering work would be required to
correct the problem and that therefore this matter needed to be referred to our Public Works
(PW) Department.
The PW Department inspected the bridges and determined that although they needed repair
work, they did not present an immediate danger to the public. PW staff committed to prepare the
necessary plans to repair the bridges.
We then received several complaints from members of the Morningside Homeowner's
Association that the bridges were unsafe and that some one had gotten hurt using them. We
proceeded to take no chances and immediately barricaded the bridges so that they would not be
used by the public. Unfortunately, the barricades have been removed several times by unknown
members of the public and we have had to replace them.
It has taken PW several months to complete the plans for the necessary repair work. Since
Morningside Park is a heavily used facility and the barricades that we have installed on the
bridges as a preventive measure to avoid liability have been removed several times, we
recommend that we proceed with the repair work on an emergency basis.
