A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CONTINUED ENGAGEMENT OF THE
LAW FIRM OF WEISS, SEROTA & HELFMAN, P.A.
FOR LEGAL SERVICES FOR THE CITY OF MIAMI IN
CONNECTION WITH THE LAWSUITS CONCERNING THE
IMPLEMENTATION AND COLLECTION OF THE
PARKING FACILITIES SURCHARGE AUTHORIZED
PURSUANT TO ORDINANCE NO. 11813: PATRICK
McGRATH, III, INDIVIDUALLY AND ON BEHALF OF
ALL OTHERS SIMILARLY SITUATED VS. THE CITY
OF MIAMI, CASE NO. 99-21456 CA -10, AND
MIAMI -DADE COUNTY, THE PUBLIC HEALTH TRUST
OF MIAMI-DADE COUNTY AND LAUREEN VARGA VS.
THE CITY OF MIAMI, CASE NO. 99-23765 CA -08,
IN THE ELEVENTH JUDICIAL CIRCUIT COURT IN
AND FOR MIAMI-DADE COUNTY, FLORIDA;
ALLOCATING ADDITIONAL FUNDS, IN AN AMOUNT
NOT TO EXCEED $100,000.00, PLUS COSTS AS
APPROVED BY THE CITY ATTORNEY, FROM THE
SELF-INSURANCE AND INSURANCE TRUST FUND,
INDEX CODE NO. 515001.624401.6.661 FOR SAID
SERVICES.
BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Attorney's continued engagement of
the law firm of Weiss, Serota & Helfman, P.A. for legal services
for the City of Miami, in connection with the lawsuits concerning
the implementation and collection of the parking facilities
surcharge authorized pursuant to Ordinance No. 11813: Patrick
McGrath, III, individually and on behalf of all others similarly

situated vs. the City of Miami, Case No. 99-21456 CA -10, and
Miami -Dade County, The Public Health Trust of Miami -Dade County
and Laureen Varga vs. the City Of Miami, Case No. 99-23765 CA -08,
in the Eleventh Judicial Circuit Court in and for Miami -Dade
County, Florida, is authorized, with funds, in an amount not to
exceed $100,000.00 plus costs as approved by the City Attorney,
allocated from the Self -Insurance and Insurance Trust Fund, Index
Code No. 515001.624401.6.661, for said services.
Section 2. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Authorizing the continued engagement of the law firm of Weiss, Serota &

County, Florida (J-01-176)
The attached resolution authorizes the continued engagement of the law firm of Weiss,
Serota & Helfinan, P.A. for legal services provided to the City of Miami in connection with the
lawsuits concerning the implementation and collection of the parking facilities surcharge
authorized pursuant to Ordinance No. 11813: Patrick McGrath, III, individually and on behalf of
all others similarly situated vs. the City of Miami, Case No. 99-21456 CA -10, and Miami -Dade
County, The Public Health Trust of Miami -Dade County and Laureen Varga vs. the City of
Miami, Case No. 99-23765 CA -08, in the Eleventh Judicial Circuit Court in and for Miami -Dade
County, Florida. The allocation of funds, in an amount not to exceed $145,000, has been
previously authorized for this case by the City Commission pursuant to Resolution No. 99-728,
adopted September 28, 1999 ($75,000) and Resolution No. 00-450, adopted May 25, 2000
($70,000).
Funds in an amount not to exceed $100,000.00 plus costs as approved by the City
Attorney will be allocated from the Self -Insurance and Insurance Trust Fund, Index Code
No. 515001.624401.6.661, for said services.

Financial review and approval for the continued engagement of counsel for
representation of the City of Miami concerning the implementation and collection of

The attached proposed Resolution seeks authorization for the continued engagement of
the law firm of Weiss, Serota & Helfinan, P.A. for legal services provided to the City of Miami
in connection with the lawsuits concerning the implementation and collection of the parking
facilities surcharge authorized pursuant to Ordinance No. 11813: Patrick McGrath, 111,
individually and on behalf of all others similarly situated vs. the City of Miami, Case
No. 99-21456 CA -10, and Miami -Dade County, The Public Health Trust of Miami -Dade County
and Laureen Varga vs. the City of Miami, Case No. 99-23765 CA -08, in the Eleventh Judicial
Circuit Court in and for Miami -Dade County, Florida.
Funds in an amount not to exgeed $100,000.00 plus cost ved by the City
Attorney will be allocated from the Parking Surcharge Administrative Account for said service �
