RESOLUTION NO. 01-+� -� "�
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO SUBMIT
APPLICATIONS FOR GRANT FUNDING IN THE ESTIMATED
AMOUNT OF $300,000 TO THE FLORIDA INLAND
NAVIGATION DISTRICT ("FIND") WATERWAYS
ASSISTANCE PROGRAM FOR SHORELINE STABILIZATION
IMPROVEMENT PROJECTS AT LEGION AND MORNINGSIDE
PARKS; FURTHER AUTHORIZING THE CITY MANAGER TO
EXECUTE THE NECESSARY DOCUMENTS, IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID
PURPOSE.
WHEREAS, the City of Miami is committed to the preservation
and improvement of neighborhood parks for the enjoyment of the
public; and
WHEREAS, Legion and Morningside Parks are included in the
City's Capital Improvement Projects Program; and
WHEREAS, funding is available from the Florida Legislature
to municipalities for shoreline stabilization improvement
projects from the Florida Inland Navigation District ("FIND")
Waterways Assistance Program on a fifty-fifty cost share basis;
and

WHEREAS, the proposed shoreline stabilization improvements
at Legion and Morningside Parks meet the criteria for such grant
funding pursuant to the FIND program standards; and
WHEREAS, the City's matching share of the projects costs, in
the estimated amount of $300,000, is available from the Safe
Neighborhood Park Bond Program;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized to submit
applications for grant funding in the total estimated amount of
$300,000 to the Florida Inland Navigation District Waterway
Assistant Program for shoreline stabilization improvement
projects at Legion and Morningside Parks subject to the following
conditions:
a. The City will accept the terms and conditions set
for in FIND Rule 66B-2 F.A.C. and which will be a
part of the grant agreement for any assistance
under the attached proposal.
b. The City is in accord with the grant proposal and
will carry out the project as described in the
proposal, and any plans and specifications
attached to it, unless prior approval for any
change has been received from FIND.

c. The City has the ability and intention to finance
its share of the cost of said project from
available Safe Neighborhood Park Bond funds and
the project site will be operated and maintained
at the expense of the City for public use.
d. The City will not discriminate against any person
on the basis of race, color, creed, national
origin, sex or handicap in the use of any property
or facility acquired or developed pursuant to the
grant proposal and will comply with the terms and
intent of Title VI of the Civil Rights Act of
1964, P.L. 88-352 (1964) and will design and
construct accessibility by handicapped persons as
well as other federal state and local laws, rule
and requirements.
e. The City will maintain adequate financial records
on said project to substantiate claims for
reimbursement.
f. The City will make available to FIND, if
requested, a post -audit of expenses incurred on
said project prior to or in conjunction with its
request for the final 10% of the grant funding
provided by FIND.
Section 3. The City Manager is authorized:1 to execute
the necessary documents, in a form acceptable to the City
Attorney, for said purpose.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor Y

requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.
2/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission
adopt the attached Resolution authorizing the City Manager
to submit an application to the Florida Inland Navigation
District ("FIND') under said agency's Waterways Assistance
Program for grant funding in the total estimated amount of
$300,000 for shoreline stabilization improvements at Legion
and Morningside Parks. The Resolution further authorizes
the City Manager to execute the necessary documents, in a
form acceptable to the City Attorney.
BACKGROUND:
The City of Miami Department of Parks and Recreation working
with residents and community associations have developed
plans for the shoreline stabilization improvements at Legion
and Morningside Parks.
The Florida Legislature has made funding available "to
municipalities for such projects under the FIND Waterways
Assistance Program on a 50-50 cost share basis. The
proposed shoreline projects satisfy the criteria for grant
funding, and the City's required matching share is available
from the approved Safe Neighborhood Park Bond program.
