WHEREAS, the Miami Zoning Board at its meeting of December 04, 2000, Item No. 1, following an advertised public hearing, adopted Resolution No. ZB 2000-0385 by a vote of seven to one (7-1), denying a request for a special exception as listed in Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, to allow a used auto sales establishment with 19 parking spaces (16 parking spaces required); and WHEREAS, the applicant has appealed the decision of the Zoning Board; and :A►TTACIET " CTIE CITY COMMISSION MEETING OF FEB 2 2 2001 WHEREAS, the City Commission after careful consideration of this matter finds that the stated grounds for the appeal and the facts presented in support thereof do not justify reversing the decision of the Zoning Board denying the special exception; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Commission denies the appeal, and affirms the decision of the Zoning Board (Resolution No. ZB 2000-0385, adopted December 04, 2000), thereby denying a . special exception from Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Article 4, Section 401, to allow a used auto sales establishment with 19 parking spaces (16 parking spaces required) for the property located at approximately 7500 Biscayne Boulevard, Miami Florida, legally described in "Exhibit A," attached hereto and made part hereof. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayorll 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Second Avenue Miami, FL 33130 RE: Appeal of Zoning Board Decision for Case No. 2000-0367 Special Exception for Sale of Used Cars at 7500 Biscayne Boulevard Dear Teresita: As the Clerk of the City of Miami Zoning Board ("Zoning Board") and the person designated by the City Manager pursuant to the City of Miami Zoning Ordinance ("Zoning Ordinance") for the filing of appeals from the decision of the Zoning Board, this letter constitutes the appeal of the decision of the Zoning Board at its meeting of December 4, 2000 regarding the above application. The Zoning Board, without any factual basis and in contravention of its own staff recommendation and in violation of the Zoning Ordinance denied the special exception for the sale of used cars at 7500 Biscayne Boulevard. The Zoning Board bowed to the 11n%ninded objections of neighborhood residents and overruled the staff recommendation. It should be noted, however, that the owners of the property immediately surrounding the site not only did not object to the application, but supported it. STATEMENT OF THE CASE AND FACTS 1. Milano Motors is the owner of the property located at 7500 Biscayne Boulevard. The subject property is located in a C-1 Restricted Commercial District with a SD -9 overlay. The Zoning Ordinance allows for the sale of used cars in said district pursuant to a special exception. Sale of new cars in the same district does not require a special exception. The attached analysis prepared by the Planning Department indicates that the use is compatible with the CA Restricted Commercial District with an SD -9 Biscayne Boulevard north overlay subject to certain conditions which would make this project appear as if it is a new car dealership. 3. Special exceptions are defined in Section 2502 of the Zoning Ordinance as follows: A special exception is a special permit for a use which would not be approyriatte generally or without restriction throughout a zoning district but which, if controlled as to number, area, location or relation to the neighborhood and having such conditions attached which would eliminate or adequately mitigate any adverse impacts, would promote the health, safety, or welfare .... In passing upon a request for special exception, Sections 1603 and 1606(1) require the Zoning Board to "give full consideration" to the recommendation of City staff. 4. The Zoning Board decision is not supported by competent substantial evidence. There was no competent substantial evidence to support a finding that the used car facility would be "adverse to the public interest" as required by Irvine v. Duval County Planning Commission, 495 So. 2d at 168 (Fla. 1986). The competent and substantial evidence standard requires that "the evidence relied upon to sustain the ultimate finding should be sufficiently relevant and material that a reasonable mind would accept it as adequate to support the conclusion reached." The well-founded staff recommendation constitutes competent substantial evidence Metropolitan Dade County v. Fuller, 515 So. 2d at 1313-14 (Fla. 3d DCA 1987); Allapattah Community Association, Inc., of Florida v. City of Miami, 379 So. 2d 387, 393-94 (Fla. 3d DCA), cert. denied, 386 So. 2d 635 (Fla. 1980); Miami Mental Health Center, Inc. v. City of Miami, 3 Fla. L. Weekly Supp. 91a (Fla. 11' Cir. Ct. 1995). The Zoning Board heard only generalized opposition of neighborhood residents, some of whom lived a goodly distance from the actual location of the facility. Those residents who immediately adjoined the property were in full support of the project. Applying the Irvine principles, the burden shifts to the Zoning Board by virtue of the applicant's acceptance so the Planning Director's recommendation to prove that the Special Exception would adversely affect the residential neighborhood. There was no evidence to indicate that there would be an adverse effect upon the neighborhood. Based upon the foregoing reasons and authority, Milano Motors requests the City Commission to reverse the Zoning Board's resolution and to permit this pre -owned car sales at 7500 Biscayne Boulevard. CASE NO. 2000-0367 Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordi- nance of the City of Miami, Florida, the subject proposal to allow the sale of used cars in the C-1 Restricted Commercial Zoning District with SD -9 overlay has been reviewed as follows: The following findings have been made: • It is found that the use is compatible with CA Restricted Commercial District. How- ever, the design must address the intent of SD -9 Biscayne Boulevard North Overlay District by upgrading the visual qualities of the design along the Biscayne Boulevard corridor. • It is found that the proposed structure is located on an area with substantial public in- terest, therefore it shall respect and enhance this gateway role by providing a continu- ous urban edge for pedestrians with at least sixty five (65) percent of linear frontage to Biscayne Boulevard. • It is found that the use is compatible with C-1 Restricted Commercial; however, the intent of the SD -9 overlay district only allows the sale of new cars. The proposed use shall reflect the intent and aesthetic qualities that respond to the SD -9 overlay district. • It is found that the proposed use, as designed, is not consistent with the intent of SD -9. • It is found that the proposed layout provides adequate parking, circulation and landscape. • It is found that paint color sample and signage specifications have not been provided to determine the aesthetic impact on the SD -9 district. • It is found that due to the proposed number of cars for sale to be located on the lot, the inclusion of banners and flags would aesthetically tend to clutter the appearance and therefore would have an adverse impact on the surrounding C-1 District. CASE NO. 2000-0367 Pursuant to Article 4, Section 401 of Ordinance 11000, as amended, the Zoning Ordi- nance of the City of Miami, Florida, the subject proposal to allow the sale of used cars in the C-1 Restricted Commercial Zoning District with SD -9 overlay has been reviewed as follows: The following findings have been made: • It is found that the use is compatible and will be beneficial to the area by providing a needed service to the community and creating new employment opportunities. • It is found that the proposed use is in scale and character with the surrounding area. • It is found that the proposed layout provides adequate parking, circulation and landscape. • It is found that the designs of the proposed facades are adequate, however, paint color samples have not been provided to determine aesthetic impact. • It is found that due to the proposed number of cars for sale to be located, on the lot, the inclusion of banners and flags would aesthetically tend to clutter the appearance and therefore would have an adverse impact on the surrounding C-1 District. • It is found that upon compliance with conditions set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Planning and Zoning Department is recommending approval of the application subject to the following conditions: 1.
