HomeMy WebLinkAboutR-01-0148J-01-108 2/14/01 w RESOLUTION NO. 148 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, AUTHORIZING AND DIRECTING THE CITY MANAGER TO REORGANIZE, RESTRUCTURE, AND IMPLEMENT THE CITY'S HOUSING OPPORTUNITIES FOR PERSONS WITH AIDS ("HOPWA") PROGRAM, INCLUDING THE TRANSFER OF LONG-TERM HOUSING ASSISTANCE PROGRAM TO THE CITY OF MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT; AUTHORIZING THE ALLOCATION OF HOPWA PROGRAM FUNDS, IN THE TOTAL AMOUNT OF $3,058,000, TO TWO SERVICE PROVIDERS AS FOLLOWS: (1) THE CITY OF MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT, THE AMOUNT OF $2,700,000, AND (2) DOUGLAS GARDENS COMMUNITY MENTAL HEALTH CENTER OF MIAMI BEACH, IN THE AMOUNT OF $358,000, TO PROVIDE HOUSING ASSISTANCE AND HOUSING RELATED SERVICES TO LOW INCOME PERSONS LIVING WITH HIV/AIDS; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY TO EFFECTUATE THE ALLOCATION, TRANSITION AND IMPLEMENTATION OF THE PROGRAM. WHEREAS, the Housing Opportunities for Persons With AIDS ("HOPWA") Program was created under the AIDS Housing Opportunity Act, and revised under the Housing and Community Development Act of 1992; and CITY COQ mz=NG Cr FEB 15 2001 :� A WHEREAS, the Housing and Community Development Act of 1992 requires that the most populous unit of general local government in an Eligible Metropolitan Statistical Area ("EMSA"), not including county government, be the applicant for the HOPWA Grant and be allocated the related funding, and WHEREAS, since 1994 the City of Miami has received the HOPWA Program funds from U.S. HUD, and has been responsible for the implementation of programs designed to provide housing and housing -related services to individuals living with HIV/AIDS in the City of Miami and the cities of Miami, Hialeah, Miami Beach and throughout Miami -Dade County; and WHEREAS, the City of Miami has been awarded funding from the U.S. Department of Housing and Urban Development ("U.S. HUD") for the implementation of the 2000-2001 HOPWA Program Grant; and WHEREAS, on May 11, 2000, the City Commission adopted Resolution No. 00-425 approving the restructuring of the HOPWA Program; and WHEREAS, under the restructured HOPWA Program (see attached "City of Miami HOPWA Budget, 10/1/00 - 9/30/01"), the City of Miami acting through the Department of Community Development will be responsible for implementation and administration of the HOPWA Program for participants living in the City, and Miami - Dade County, acting through the Miami -Dade Housing Agency, will Page 2 of 7 _ . 148 be responsible for similar services to participants residing outside the City of Miami in Miami -Dade County; and WHEREAS, on May 11, 2000, the City Commission also adopted Resolution No. 00-426, authorizing and directing the City Manager to hire the accounting firm of Sharpton, Brunson and Company to perform an audit of the City's HOPWA Program before implementation of the restructured Program; and WHEREAS, on September 14, 2000, the City Commission adopted Resolution No. 00-792 allocating $9,979,000 in HOPWA Program funds to ten service providers to provide housing assistance and housing related services to low income persons living with HIV/AIDS, from October 1, 2000 through September 30, 2001, to ensure that services are provided through the transition period; and WHEREAS, one of the service providers, Economic Opportunity Family Health Center, Inc., was awarded $1,200,000 to provide long-term housing assistance for individuals living with HIV/AIDS through March 31, 2001; and WHEREAS, over past year the City has received numerous complaints from both program participants and landlords regarding late rental assistance payments from the Economic Opportunity Family Health Center Program; and WHEREAS, the Department of Community Development's monitoring and preliminary audit of the agency revealed that the Page 3 of 7 .148 Economic Opportunity Family Health Center Program has a number of programmatic and financial problems, and raised concerns related to the commingling of funds; and WHEREAS, it is recommended that the City Commission approve the termination of the City's agreement with Economic Opportunity Family Health Center, for the provision of long term housing assistance and transfer the responsibility for administering the program to the Department of Community Development; and WHEREAS, based on the City's evaluation of the Short -Term Housing Assistance Program, a caseload exists of more than two hundred individuals living with HIV/AIDS who seek assistance through the Program and who are on the waiting list for the Long Term Housing Assistance Program; and WHEREAS, the Administration recommends the elimination of the Short -Term Housing Assistance Program and an increase in the number of slots available through the Long -Term Housing Assistance Program, to be administered by the Department of Community Development and the Miami -Dade Housing Agency; and WHEREAS, it is recommended that an additional $358,000 in HOPWA Program funds be allocated to maintain the caseload capacity of the Douglas Gardens Community Mental Health Center of Miami Beach to provide long-term housing assistance in the Page 4 of 7 - City of Miami Beach through the 2000-2001 Program Year ending September 30, 2001; and WHEREAS, it is also recommended that an additional $2,700,000 in HOPWA Program funds be allocated to the Department of Community Development for operations and long term housing assistance to individuals living with HIV/AIDS; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized and directed to reorganize, restructure, and implement the City's Housing Opportunities for Persons With Aids ("HOPWA") Program, including the transfer of the long-term housing assistance program for low income individuals living with HIV/AIDS previously operated by the Economic Opportunity Family Health Center to the City of Miami Department of Community Development, for implementation Page 5 of 7 upon expiration of the City's contract with the agency on March 31, 2001. Section 3. The proposed legislation authorizes and directs the City Manager to move forward and take the necessary steps to effectuate the restructuring and implementation of the City's HOPWA Program and further allocates available HOPWA Program funds in the amount of $2,700,000 to the Department of Community Development and $358,000 to Douglas Gardens Community Mental Health Center of Miami Beach for the provision of housing assistance and housing related services to low income individuals living with HIV/AIDS. BACKGROUND: The Housing Opportunities For Persons With AIDS (HOPWA) Program was created with the passage of the AIDS Housing Act by the U.S. Congress and revised under the Housing and Community Development Act of 1992. Since 1994, the City of Miami has received HOPWA funds from U.S. HUD and has been responsible for implementation and administration of programs designed to provide housing and housing related services to individuals living with HIV/AIDS throughout Miami -Dade County. Based on the current HOPWA Program, housing and housing related assistance to individuals living with HIV/AIDS is being provided through subcontracts with various local area HIV/AIDS service providers throughout Miami -Dade County. Presently, the following eligible HOPWA Program activities and services are being provided: 0 Short -Term Rental Assistance 0 Emergency Housing Assistance 0 Long -Term Rental Assistance 0 Permanent Housing Assistance 0 Moving Expense Assistance 0 Utilities and Special Needs Assistance X31-- 148 Over the past year, the City has undertaken a complete review of the HOPWA Program and it is clear that the Program must be restructured to more effectively address the needs of the impacted population. It is apparent that several of the aforementioned HOPWA Program activities and services have not facilitated the expenditure of HOPWA funds in a timely manner and there exists a need to radically improve the service delivery system to better serve the HIV/AIDS population in the City and Miami -Dade County. At its Special Meeting of May 11, 2000, the City Commission adopted Resolution No. 00-425 approving the restructuring of the City's existing HOPWA Program. Under the restructured HOPWA Program, the City of Miami acting, through the Department of Community Development, would be responsible for implementation and administration of the HOPWA Program for participants living in the City and Miami -Dade County, acting through the Miami -Dade Housing Agency, would be responsible for similar services to participants residing in the balance of Miami -Dade County. It was anticipated that the 2000-2001 program year would serve as a transition period to implement the full restructuring of the Program. The Administration has reviewed the various HOPWA program activities, including the Short Term Housing Assistance Program, which provides housing rental assistance for up to six (6) months to individuals living with HIV/AIDS. Based on City staff's review and analysis, it has been determined and is recommended that this program be eliminated. Basically, the Short- Term Program has merely served as a transition phase for participation in the Long -Term Assistance Program and nearly the entire caseload of over 200 participants is part of the Waiting List for the Long -Term Program. It is recommended that those individuals in the Short -Term Housing Assistance Program be transferred to the Long -Term Program. To accomplish this objective, it is recommended that the number of slots available through the Long -Term Housing Assistance Program administered by Miami -Dade Housing Agency be increased. Based on City staff's review of Miami -Dade Housing Agency, the agency would be able to provide assistance to an additional two hundred fifty (250) participants through the use of prior year HOPWA funding previously awarded by the City, which will meet the funding needs to transfer existing Short -Term Program participants to the Long -Term Program. Secondly, based on the City's evaluation and monitoring of the Long -Term Housing Assistance Program administered by Douglas Gardens Community Mental Health Center of Miami Beach, it is recommended that an additional $358,000 in HOPWA funds is allocated to the agency for its operations costs associated with the provision of long term housing assistance to low income individuals living with HIV/AIDS in the City of Miami Beach to maintain the Agency's current caseload through the 2000-2001 Program Year. Thirdly, over the past year, the City has received numerous complaints from both HOPWA Program participants and landlords participating in the Long Term Housing Assistance Program administered by Economic Opportunity Family Health Center. The main complaint centers around the receipt of late rental assistance payments to landlords, which in turn results in many HOPWA participants facing the possibility of eviction from their residences, which further impacts their emotional and physical well being. 01- 148 Based on the Department of Community Development's monitoring and preliminary results from an audit of the agency being conducted by Sharpton, Brunson and Company, it has been determined that the agency has a number of programmatic and financial problems, including concerns related to the commingling of funds. As a result, the City Administration recommends that the City Commission not extend the existing sub- contract between the City and the Economic Opportunity Family Health Center under the Long Term Housing Assistance Program which ends March 31, 2001. In order to ensure that there is no disruption of services to HIV/AID participants, it is further recommended that the City Commission approve the transfer of the Long Term. Housing Assistance Program to the Department of Community Development for implementation. At the September 14, 2000 meeting, the City Commission adopted Resolution No. 00- 792, which allocated $1,000,000 in HOPWA funds to the Department of Community Development to move forward with the program redesign and transition. It is recommended that the City Commission allocate an additional $1,500,000 to the Department of Community Development for operations and $1,200,000 for direct rental assistance for the period April 1 — September 30, 2001 to continue and increase the number of slots available to participants seeking housing assistance through the Long Term Housing Assistance Program to be administered by the Department. A copy of the HOPWA Program Budget and Table of Organization for the City operated program is included as an attachment to the proposed Resolution. In an effort to ensure the continuation of services to HOPWA participants residing in the City, City Commission approval of the attached resolution is recommended.
