A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR-FIFTHS (4/5 THS ) AFFIRMATIVE VOTE
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND AUTHORIZING THE
REPAIRS TO THE CEILING OF THE AFRICAN SQUARE
PARK RECREATION BUILDING FOR THE DEPARTMENT
OF PARKS AND RECREATION FROM JMC DEVELOPMENT
GROUP, INC., IN AN AMOUNT NOT TO EXCEED
$13,265; ALLOCATING FUNDS FROM CAPITAL
IMPROVEMENT PROJECT NO. 331053, AS
APPROPRIATED BY THE ANNUAL APPROPRIATIONS
AND CAPITAL IMPROVEMENT PROJECTS ORDINANCES.
WHEREAS, the ceiling of the African Square Park (the
"Park") recreation building had deteriorated and falling debris
from the ceiling posed a safety hazard to employees and the
public; and
WHEREAS, immediate repairs to the ceiling were required to
avoid continued deterioration and prevent a hazardous condition
during the summer when the recreation building is used for
programs conducted at the Park; and

WHEREAS, the City Manager made a written finding that the
repairs to the ceiling at the Park's recreation building
constituted a valid emergency; and
WHEREAS, the City Manager and the Director of the
Department of Parks and Recreation recommended that the
requirements for competitive sealed bidding procedures be
waived; and
WHEREAS, the Department of Parks and Recreation solicited
for informal quotes and JMC Development Group Inc. provided the
lowest responsive quote for the necessary repairs; and
WHEREAS, funds are available from Capital Improvement
Project No. 331053, as appropriated by the Annual Appropriations
and Capital Improvement Projects Ordinances;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/stns) affirmative vote of
the members of the City Commission, the City Manager's finding
of an emergency and waiving the requirements for competitive
sealed bidding procedures, and authorizing the repairs to the
ceiling of the African Square Park recreation building for the
Department of Parks and Recreation from JMC Development Group,

Inc., in an amount not to exceed $13,265, is ratified, approved
and confirmed, with funds allocated from Capital Improvement
Project No. 331053, as appropriated by the Annual Appropriations
and Capital Improvement Projects Ordinances.
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

It is respectfully recommended that the City Commission adopt the
attached Resolution, by a 4/5ths affirmative vote, ratifying,
approving, and confirming the City Manager's finding and
recommendation to proceed on an emergency basis to conduct the
repairs to the African Square Park Recreation Building in the
amount of $13,265. This Resolution further allocates funds for
said purpose, from the Community Development Block Grant Funds,
CIP Project No. 331053.
BACKGROUND:
The Public Works Department conducted an inspection of the
African Square Park recreation building and determined that the
ceiling structure had deteriorated to the degree that the
continued water leak and falling ceiling posed a safety concern
for employees and the public. The repairs were completed on an
emergency basis to avoid continued deterioration and prevent a
hazardous situation during the summer season when the park
building is used to operate children's summer and other park
programs.
