RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF SOLE SOURCE; WAIVING

AMOUNT OF $30,231.
WHEREAS, the Miami Police Department was awarded a grant
from the U.S. Department of Justice's Citizens on Patrol
("COPS") Technology Grant to establish a multi -government
information 3-1-1 system to provide citizens with quick access

to non -emergency police and other governmental services and
reduce the volume of calls handled by operators at 9-1-1; and
WHEREAS, the 3-1-1 service will provide the public with a
non -emergency information network that will be routed through
BellSouth Telecommunications to the proper Neighborhood
Enhancement Team ("NET") Service Center by using the caller's
nine -digit zip code; and
WHEREAS, BellSouth Telecommunications, Inc. owns the number
3-1-1 and is the sole source provider of this service; and
WHEREAS, the finding of the Chief Procurement Officer of
sole source has been approved and adopted as the finding of the
City Manager; and
WHEREAS, the City Manager and the Chief Procurement Officer
recommend that the requirements for competitive sealed bidding
procedures be waived and the acquisition of the Non -Emergency
Reporting 3-1-1 Services from BellSouth Telecommunications,
Inc., the sole source provider, be approved; and
WHEREAS, funds are available from the Police General
Operating Budget, Account Code No. 001000.290201.6.510, in the
amount of $105,960 annually, and the COPS 3-1-1 Technology Grant
Fund, Account Code No. 142029.290521.6.510, in a one-time amount
of $30,231;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. By a four-fifths (4/5tns) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of sole source and
waiving the requirements for competitive sealed bidding
procedures and approving the acquisition of non -emergency
reporting 3-1-1 services for the Department of Police from
Bellsouth Telecommunications, Inc., the sole source provider,
for a period of thirty-six (36) months, in an annual amount not
to exceed $105,960, plus contract preparation fees and the cost
of establishing routing service, in an amount not to exceed
$30,231 for total amount for the first year of $136,191, is
ratified, approved and confirmed, with funds allocated from the
Police General Operating Budget, Account Code
No. 001000.290201.6.510, in the amount of $105,960 annually, and
the COPS 3-1-1 Technology Grant Fund, Account Code
No. 142029.290521.6.510, in a one-time amount of $30,231.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayoril.

It is respectfully recommended that the City Commission adopt the attached Resolution, by a four-
fifths (4/5`'') affirmative vote of the members of the City Commission, after a duly advertised
public hearing, ratifying, approving, and confirming the City Manager's Finding of Sole Source;
waiving the requirements for competitive sealed bids and authorizing the provision of Zip Code
routing for Non -Emergency Reporting (NER) 311 Service, from BellSouth Telecommunications,
Inc., for a thirty-six (36) month period, at a total annual cost not to exceed $105,960, with the first
year cost totaling $136,191, to include contract preparation fee and the establishment of call
routing service in the amount of $30,231.00. Funding is available from the Police Department
General Operating Budget, Account Code 001000.290201.6.510 ($105,960) and the COPS 3-1-1
Technology Grant, Account Code No. 142029.290521.6.510 ($30,231).

The Department of Police has been awarded a grant from the U.S. Department of Justice's (COPS)
Technology Grant. This grant will be used to establish a multiple government information system
that will provide citizens with quick access to non -emergency police and other governmental
services. This service will reduce the volume of calls handled by operators at 9-1-1 (the real
emergency line), thereby enhancing its performance.'
Specifically, the 3-1-1 service will provide the public with an easy number to remember, a routing
consistent to the customer's location (zip code), enhancement of community government efforts by
integrating informational networks, and expand the hours of operation of the Neighborhood
Enhancement Team (NET) Service Centers. BellSouth Telecommunications, Inc will provide the
routing of the call. The nine -digit zip code of the address where the call originates will be used to
determine the calls destination, which will be routed to one of the NET Offices.

The Police Depent has requested the acquisition of a Zip Code routing for Non -Emergency Reporting
(NER) 311 Servi , from BellSouth Telecommunications, Inc., be deemed a sole source. An investigation was
conducted by s f to determine whether BellSouth Telecommunications, Inc., a non-minority/Miami-Dade
County vendor located at 7650 NW 19 Street, Ste. 600, Miami, Florida 33126, is the sole source provider of
Non -Emergency Reporting (NER) 311 Service, as requested by the Miami Police Department.
The Miami Police Department was awarded a grant from the U.S. Department of Justice's (COPS) Technology
Grant. This grant will be used to establish a multiple government information system that will provide citizens
with quick access to non -emergency police and other governmental services. This service will reduce the
volume of calls handled by operators at 9-1-1 (the real emergency line), thereby enhancing its performance.
This 3-1-1 service will provide the public with an easy number to remember, a routing consistent to the
customer's location (zip code), enhancement of community government efforts by integrating informational
networks, and expand the hours of operation of the Neighborhood Enhancement Team (NET) Service Centers.
BellSouth Telecommunications, Inc. (BellSouth) will provide the routing of the call. The nine -digit zip code of
the address where the call originates will be used to determine the calls' destination, which will be routed to one
of the NET Offices. Further, staff learned that BellSouth owns the number 3-1-1, and BellSouth must be the
provider of this number; no third party can provide these services as the originator of the number and service is
from BellSouth.
The proposed cost for the procurement of the NER 311 Service from BellSouth Telecommunications, Inc, for a
thirty-six (36) month period, will be at a total annual cost not to exceed $105,960, with the first year totaling
$136,191, which includes the contract preparation fee and the establishment of call routing service in the
amount of $30,231.00. Funding is available from the Police Department General Operating Budget, Account
Code 001000.290201.6.510 ($105,960), and the COPS 3-1-1 Technology Grant, Account Code No.
142029.290521.6.510 ($30,231).
Therefore, as Chief Procurement Officer, I am recommending that the requirements for competitive bidding be
waived and the following findings be approved: BellSouth Telecommunications, Inc., a non-minority/Miami-
Dade County vendor, is the sole source provider of the Non -Emergency Reporting (NER) 311 Service.

AGREEMENT Case Number FLOO-2550-02
This Special Service Arrangement Agreement ("Agreement") is by and between BellSouth
Telecommunications, Inc., a Georgia corporation, d/b/a BellSouth, ("Company") and City of
Miami ("Customer or Subscriber"), and is entered into pursuant to Tariff Section A5 of the
General Subscriber Services Tariff. This Agreement is based upon the following terms and
conditions as well as any Attachment(s) affixed and the appropriate lawfully filed and approved
tariffs which are by this reference incorporated herein.
1. Subscriber requests and Company agrees, subject to the terms and conditions herein, to
provide the service described in the Attachment(s) at the monthly and nonrecurring rates, charges,
and conditions as described in the Attachment(s) ("Service"). The rates, charges, and conditions
described in the Attachment(s) are binding upon Company and Subscriber for the duration of this
Agreement. For the purposes of the effectiveness of the terms and conditions contained herein,
this Agreement shall become effective upon execution by both parties. For purposes of the
determination of any service period stated herein, said service period shall commence the date
upon which installation of the service is completed.
2. Subscriber agrees to subscribe to and Company agrees to provide any additional tariffed
services required for the installation of the Service. Subscriber agrees to be responsible for all
rates, charges, and conditions for such tariffed services.
3. This Agreement is subject to and controlled by the provisions of Company's or any of its
affiliated companies' lawfully filed and approved tariffs, including but not limited to Section A2
of the General Subscriber Services Tariff and No. 2 of the Federal Communications Commission
Tariff and shall include all changes to said tariffs as may be made from time to time. All
appropriate tariff rates and charges shall be included in the provision of this service. The tariff
shall supersede any conflicting provisions of this Agreement, with the exception of the rates and
charges herein, in the event any part of this Agreement conflicts with terms and conditions of
Company's or any of its affiliated companies' lawfully filed and approved tariffs.
4. This Agreement may be subject to the appropriate regulatory approval prior to
commencement of installation. Should such regulatory approval be denied, after a proper request
by Company, this Agreement shall be null, void, and of no effect.
5. If Subscriber cancels this Agreement prior to the completed installation of the Service, but
after the execution of this Agreement by Subscriber and Company, Subscriber shall pay all
reasonable costs incurred in the implementation of this Agreement prior to receipt of written
notice of cancellation by Company. Notwithstanding the foregoing, such reasonable costs shall
not exceed all costs which would apply if the work in the implementation of this Agreement had
been completed by Company.
6. The rates, charges, and conditions described in the Attachment(s) may be based upon
information supplied to Company by the Subscriber, including but not limited to forecasts of
growth. If so, Subscriber agrees to be bound by the information provided to Company. Should
Subscriber fail to meet its forecasted level of service requirements at any time during the term of
this Agreement, Subscriber shall pay all reasonable costs associated with its failure to meet its
projected service requirements.

7. (a) If Subscriber cancels this Agreement at any time prior to the expiration of the service
period set forth in this Agreement, Subscriber shall be responsible for all termination charges.
Unless otherwise specified by tariff, termination charges are defined as all reasonable charges due
or remaining as a result of the minimum service period agreed to by Company and Subscriber and
set forth in the Attachment(s).
7. (b) Subscriber further acknowledges that it has options for its telecommunications services
from providers other than BellSouth and that it has chosen BellSouth to provide the services in
this Agreement. Accordingly, if Subscriber assigns this Agreement to a certified reseller of
BellSouth local services and the reseller executes a written document agreeing to assume all
requirements of this Agreement, Subscriber will not be billed termination charges. However,
Subscriber agrees that in the event it fails to meet its obligations under this Agreement or
terminates this Agreement or services purchased pursuant to this Agreement in order to obtain
services from a facilities based service provider or a service provider that utilizes unbundled
network elements, Subscriber will be billed, as appropriate, termination charges as specified in
this Agreement.
8. This Agreement shall be construed in accordance with the laws of the State of Florida.
9. Except as otherwise provided in this Agreement, notices required to be given pursuant to
this Agreement shall be effective when received, and shall be sufficient if given in writing, hand
delivered, or United States mail, postage prepaid, addressed to the appropriate party at the address
set forth below. Either party hereto may change the name and address to whom all notices or
other documents required under this Agreement must be sent at any time by giving written notice
to the other party.

10. Subscriber may not assign its rights or obligations under this Agreement without the
express written consent of Company and only pursuant to the conditions contained in the
appropriate tariff.
11. In the event that one or more of the provisions contained in this Agreement or incorporated
within by reference shall be invalid, illegal, or unenforceable in any respect under any applicable

statute, regulatory requirement or rule of law, then such provisions shall be considered

1. Should the Company offer the same or similar service pursuant to tariffs approved by the

A. The Local Calling Area of the NER service subscriber will be the basic Local Calling Area defined
in A3.3 of General Subscribers Services Tariff (GSST), as facilities permit. NER service will be
made available in the following Basic Local Calling Areas: Ft. Lauderdale.
B. Only one NER service number (E311) will be assigned to an NER subscriber or its affiliates, per
local calling area.
C. An "affiliate of a NER service subscriber is any entity that directly, or indirectly through one or
more intermediaries, controls, is controlled by, or is under common control with, the NER
subscriber.
The term "control" (including the terms "controlling," "controlled by," and "under common control
with") means the possession, direct or indirect, of the power to direct or cause the direction of the
management and policies of an entity, whether through the ownership of voting securities, by
contract, or otherwise.
D. Non -Emergency Reporting service is available in BellSouth Territory only. To provide access to
a non -emergency 311 number to end users in an independent company territory within the local
calling area, the NER service subscriber must make appropriate arrangements with the independent
company serving that territory. The subscriber asserts that he has no intention of selling or
transferring this E311 Service to another entity
E. NER service can be delivered via regular exchange access lines (by individual business lines, PBX
trunks, etc.).
F. This service is furnished subject to the availability of non -emergency 311 numbers.
G. Limitations and use of service as stated in Section A2. of the GSST.
H. Calls to a disconnected E3 I service number will be routed to intercept over the announcement
facilities for a maximum of 60 days. The announcement provided may, at the Company's option,
refer the caller to another telephone number. No intercept announcement will be provided for a
disconnected E311 service number.
I. Directory Listings may be provided for NER service at rates and regulations as specified in Section
A6. of the GSST. If applicable, the phrase "Charges Will Apply" will be included in the NER
service
listing at no additional charge.
J. Access to NER service is not available to the following classes of service:
- Pay phone Service Providers
- Hotel/Motel/Hospital Service
- 1+
- 0+, 0- (Credit Card, Third -Party Billing, Collect Calls)
- Inmate Service
- 101XXXX
- Four -party Stations
- Cellular - Type 2A
In addition, operator assisted calls to a NER service subscriber will not be completed.
K. Non -Emergency Reporting service will not provide calling number information in real time to the
NER service subscriber. If the NER subscriber needs this type of information, the NER service
subscriber must subscribe to compatible Caller ID features in Section A13. of the (GSST), as
available.

L. If local calling areas are merged, and a non -emergency reporting service number exists in both
areas, the NER service subscriber who established the service first in time will be entitled to retain
non -emergency 311 number in the merged local calling area, as the subscriber of record.
M. The NER service subscriber must comply with any orders and rules, pertaining to 311 Service,
adopted by the FCC in rule making proceeding (CC Docket 92-105).
N. The NER service subscriber is prohibited from providing programming which involves live group
interaction, such as "GAB" lines, "chat" lines, or similar type programs where the primary purpose
is for callers to interact with one another.
Enhanced 311 Service (E311) - Limited Service Offering (LSO)
A. E311 service is a three -digit local dialing arrangement, available in specified areas as defined
previously, that will allow callers to be routed to the serving non -emergency police or other
governmental entity responsible for their areas as directed by the entity purchasing the service.
B. The E311 service subscriber or sharing partners must use a routing number assigned at the
discretion of the Company. Only one routing number will be available in a Basic Local Calling
Area.
C. The E311 service subscriber and sharing partners must either (1) obtain a new 7 or 10 -digit
number, (2) designate an existing non -published 7 or 10 -digit number, or (3) change an existing
published 7 or 10 -digit number to a non -published number. This 7 or 10 -digit number must be
non -published. When the E3 I service is disconnected or discontinued, the subscriber and sharing
partners must surrender the 7 or 10 -digit number as part of the E311 service. This 7 or 10 -digit
number can be either disconnected or a new 7 or 10 -digit number can be assigned. Appropriate
rates from Sections A3. and A4. of the (GSST) will apply.For the purposes of this contract, the
unique 7 or 10 -digit number(s) used by the subscriber and sharing partners as the terminating
number associated with the routing number, will be referred to as the point -to -number.
D. An E311 service subscriber may share the use of non -emergency service in those instances where
multiple police or governmental entities responsible for providing non -emergency service exist in a
local calling area. The E311 service subscriber is restricted from selling or transferring the 311
number to an unaffiliated entity, either directly or indirectly. If applicable, the subscriber will
assume all responsibility for disclosing the terms and conditions of this contract to the sharing
partners, as well as any issues arising from nonparticipation in this service. The Company assumes
no responsibility for establishing, coordinating or otherwise maintaining the sharing relationships
established between multiple police or governmental entities in a local calling area.
E. E3 I service will allow callers to be routed to police or other governmental entity responsible for
their area, by retrieving the caller's zip code based on the caller's telephone ni.-nber and matching
the zip code with the correct local authority phone number.
F. The subscriber is responsible for establishing, coordinating or otherwise maintaining the zip code
list defining the areas serviced by the sharing partners. Where the zip codes do not coincide with
all entities of non -emergency services, the subscriber is responsible for coordinating and resolving
such discrepancies amongst the sharing partners. Charges for initial Zip code mapping by the
Company's authorized agent will be billed directly by the agent to the subscriber.
G. Establishment of the Zip code routing data will be submitted in writing by the subscriber to the
Company's designated mapping agent.
H. If applicable, all E3 I sharing partners are subject to the terms and conditions defined in this Tariff,

as is the subscriber of record.
I. Calls originated to E311 service will incur no per call charge from the E311 service subscriber,
Billing and Collections of per call charges as set forth in A46.1.2. of the GSST will not apply.
J. The subscriber's bill will provide a summary of all calls delivered to the E311 number per
terminating
telephone number.
K. Calls made to a disconnected E311 number will be provided a disconnect announcement.
L. In those instances where the zip code is not included in the zip code mapping as a result of omission
by the subscriber or police nad/or governmental entity choosing to not subscribe to this offering, the
Company shall provide a standard announcement to the caller.
M. If applicable, the subscriber and/or its sharing partners will assume all responsibility for notifying
callers of the termination of service for a period of 60 days.
Rules and Regulations of Non -Emergency Reporting (NER) Service
A. A minimum usage charge becomes effective 6 months after the service has been initially
provisioned.
Once it becomes effective, this charge will be billed to the NER service subscriber for any billing
period in which the NER service subscriber's usage charges fall below the amount of the Minimum
Usage Charge specified in the rate table. The transfer of an NER service number to an affiliate,
whether through merger, acquisition, or otherwise, will not toll or restart the counting of the 6 months
period during which the minimum usage charge does not apply.
B. Non -Emergency Reporting service is provided where facilities permit.
C. Use of NER service is subject to possible recall of the 311 code by the NANP (North American
Numbering Plan) Administrator for national use. The NER service subscriber and/or sharing
partners
must, prior to provisioning of the service, sign a written acknowledgement of this condition and an
agreement to return the code upon receipt of 6 months written notice of such a recall from the
Company and abide by all terms and conditions contained in FCC Order No. 97-51, issued by the
FCC in CC Docket 92-105 regarding the use and return of such 311 codes. If a recall is effected by
the NANP Administrator, the Company will work with all NER service subscribers and sharing
partners affected by such recall to transfer their service arrangements, if technically and
economically feasible at the time, to an abbreviated dialing arrangement, and if not feasible, to a
seven or ten -digit dialing arrangement within the 6 -month notice period. The NER service subscriber
will be required to migrate to any standard access arrangement for information services
subsequently
agreed to by the industry and approved by the FCC. The NER subscriber will be charged the
appropriate tariff rates or lower rates established on an individual case basis for the establishment
of the new access arrangement.
D. Non -Emergency Reporting service will be provided under the following conditions.
1. For network sizing and protection, each NER service subscriber and/or sharing partner must
provide an estimate of annual call volumes, the expected busy hour and holding time for each
call to a NER service number.
2. The customer will subscribe to adequate telephone facilities initially and subsequently as may be
required, in the judgment of the Company, to adequately handle calls to NER service numbers

without impairing the Company's general telephone service or telephone plant. The customer may
be required further to bear the expense of traffic load protection equipment when, in the judgment
of the Company, such would be required as a protection to the general telephone service or
telephone plant during temporary periods of traffic overload.
3. The NER service subscriber is responsible for obtaining all necessary permission, licenses,
written consents, waivers and releases and all other rights from all persons whose work,
statements or performance are used in connection with the service, and from all holders of
copyrights, trademarks, and patents used in connection with said service.
4. The NER service subscriber and/or sharing partners shall be liable for, and shall indemnify,
protect,
defend and save harmless the Company against all suits, actions, claims, demands and judgments,
and of all costs, expenses and counsel fees incurred on account thereof, arising out of and
resulting
directly or indirectly from the Service or in connection therewith, including, but not limited to, any
loss, damage, expense or liability resulting from any infringement or claim of infringement, of any
patent, trademark, copyright, or resulting from any claim of libel and slander.
5. Each subscriber and/or sharing partner, if applicable, agrees to release, indemnify, defend and
hold
harmless the Company from any and all loss, claims, demands, suits or other action, or any liability
whatsoever, whether suffered, made, instituted or asserted by the Subscriber or by any other
ply

or person, for any personal injury to or death of any person or persons, or for any loss, damage or
destruction of any property, whether owned by the subscriber or others, or for any infringement
invasion of the right of privacy of any person or persons, caused or claimed to have been caused,
directly or indirectly, by the installation, operation, failure to operate, maintenance, removal,
presence, condition, location or use of NER service features, including but not limited to the
identification of the zip code associated with the telephone used by the party or parties accessing
NER services hereunder, and which arise out of the negligence or other wrongful act of the
Company, the Subscriber,its user agencies or municipalities or employees or agents of any one
of them.
9. No NER service subscriber shall promote non -emergency service with the use of an auto dialer
or broadcasting of tones that dial a 311 number.
10. The NER service subscriber shall respond promptly to any and all complaints lodged with any
regulatory authority against any service provided via the 311 number. If requested by the
Company, the NER service subscriber shall assist the Company in responding to complaints
made to the Company concerning the subscriber's NER service.
11. A written notice will be sent to any NER service subscriber following oral notification when their
service unreasonably interferes with or impairs other services rendered to the public by the
Company or by other subscribers of NER service. If after notification the subscriber makes no
modification in method of operation or in the service arrangements that are deemed
service -protective by the Company, or if the subscriber is unwilling to accept the modifications,
or if the subscriber continues to cause service impairment, the Company reserves the right, at
any time, without further notice, to institute protective measures, up to and including termination

of service. In an emergency situation as defined by the Company, the Company reserves the
right, at any time, without notice, to institute protective measures, up to and including termination
of service.
F. If a pre-recorded announcement is provided by the NER service subscriber, the following
conditions
apply.
1. The NER service subscriber will provide announcements. The Company will provide only the
delivery of the call.
2. NER service subscriber sponsorship of any particular announcement of recorded program
service shall not preclude another NER service subscriber from sponsoring the same or similar
announcement or recorded program service.
3. The provision of access to the NER service Network by the Company for the transmission of
announcement or recorded program services is subject to availability of such facilities and the
requirements of the local exchange network.
4. The NER service subscriber assumes all financial responsibility for all costs involved in providing
announcement or recorded program services including, but not limited to, the
recorder -announcement equipment producing the recording, advertising and promotional
expenses
5. The NER service subscriber assumes, according to other specific rates and charges under tariff,
all financial responsibility for all facilities required to connect the recorder -announcement
equipment located on the subscriber's premises.
G. The Company may take all legal and practical steps to disassociate itself from NER service
subscribers providing services whose business and/or public conduct (whether demonstrated or
proposed) is of a type that generates unacceptable levels of complaints by end users.
H. In no event shall the Company be liable for any losses or damages of any kind resulting from the
unavailability of its equipment or facilities or for any act, omission or failure of performance by the
Company, or its employees, or agents, in connection with this Tariff. The Company shall not be
responsible for calls that cannot be completed as a result of repair or maintenance difficulties on
Company facilities and equipment nor on equipment owned or leased by the subscriber.
I. The NER service subscriber must be located within the principal exchange of the Basic Local
Calling Area in which he subscribes to NER service.
Charges to Calling Parties:
A. Subscriber agrees that this service will be provided at no charge to the calling party.
The following rates apply to NER (E311 service).
a. Nonrecurring charges shall apply for each NER service number per local calling area.
b. NER service subscribers will pay the normal tariffed charges for the local exchange access
arrangements (e.g., PBX trunks, Centrex Type Services lines, etc.) used for transporting and
terminating messages at the NI I subscriber's designated premises.
c. Minimum Usage Charge will be billed to NER service in each billing period, following the
6 -month period after the service has been provisioned, in which the NER service subscriber's
usage charges fall below the amount of the Minimum Usage Charge in B.2. following.
d. Applicable service order charges as specified in Section A4. of the GSST will apply, in

A. Three -Digit Dialing Service (hereafter NI I Service) is a three -digit local dialing arrangement available in specified areas,
with BellSouth Telecommunications, Inc. recording and rating of the call, for delivery of general information via voice grade
facilities.
B. The NI l subscriber may apply a charge to his end users, within the NI I subscriber's local calling area, for services delivered in
response to calls to an N11 number. The Company will record and rate these calls on behalf of the Company's NI 1 subscriber
only.
C. For the purposes of handling (recording of end user calls to an N11 provider, the Company will provide call detail for
rating of NII calls by the Competitive Local Exchange Carrier (CLEC) as defined in the Resale Agreement
D. The Local Calling Area of the NI I Service subscriber will be the basic Local Calling Area defined in A3.3 of this Tariff, as
facilities permit.
NI I Service will be made available in the following Basic Local Calling Areas:

U. If local calling areas are merged, and an NI I number exists in both areas, the NI I subscriber who established the NI I Service
first in time will be entitled to retain the N 11 Service in the merged local calling area.
V. N11 Service will be provided within a maximum of 30 days after the customer's request for service has been processed in order
to allow the Company sufficient time for provisioning.
W. The NI I subscriber must comply with any orders and rules, pertaining to N l Service, adopted by the FCC in rulemaking
proceeding (CC Docket 92-105).

A. All requests for N11 Service must be submitted in writing to the independent firm designated by the Company for
assignment of N11 numbers. The independent firm will allocate N11 Service numbers in the specified Basic Local Calling
Areas pursuant to non-discriminatory procedures approved by Company. An earnest money deposit must be included with
the written request for NI I Service, except for a request by Law Enforcement, as identified in FCC Order No. 97-51, issued
February 19, 1997, for 311. This deposit should be in the form of a certified or cashiers check in the amount of the
nonrecurring charge for Ni 1 Service establishment in the Basic Local Calling Area for which the customer is requesting
service. If the customer is assigned a N 11 Service number, the deposit will be applied to the customer's charges for establishing
NI I Service. If the customer is not assigned a N l Service number, the check will be returned to the customer. The Company
will not pay interest on the earnest money deposit.

B. Within 30 calendar days of the number assignment, the NI l subscriber must initiate a service request order which will
determine the subscriber's provisioning date. This provisioning date must be within 90 calendar days of the date the N1l
number is assigned to the subscriber. The N 11 subscriber will be billed the nonrecurring charge when the service is provisioned
by the Company.
If, during or at the end of this 90 -day period, the NI 1 subscriber has failed to establish service or decides to discontinue service
establishment, the N 11 number will be recalled and the number will be considered available for reassignment as specified in A.
preceding. If the network has been provisioned for the subscriber, the nonrecurring charge will not be refunded or waived.
A minimum usage charge becomes effective 6 months after the service has been initially provisioned. Once it becomes
effective, this charge will be billed to the NI I subscriber for any billing period in which the NI l subscriber's usage charges fall
below the amount of the Minimum Usage Charge in A39.1.7 of this Tariff. The transfer of an NI I number to an affiliate,
whether through merger, acquisition, or otherwise, will not toll or restart the counting of the 6 months period during which the
minimum usage charge does not apply.

C. The N11 subscriber must either (1) obtain a new 7 or 10 -digit number, (2) designate an existing non -published 7 or 10 -digit (C)
number, or (3) change an existing published 7 or 10 -digit number to a non -published number, which will be established as the
lead number in the hunt group, ACD, etc., of the subscriber. This 7 or 10 -digit number must be non -published. When the NI I
Service is disconnected or discontinued, the N11 subscriber must surrender this 7 or 10 -digit number as part of the NI I
Service. This 7 or 10 -digit number can be either disconnected or a new 7 or 10 -digit number can be assigned. Appropriate -rates
from Sections A3. and A4. of this Tariff will apply.
D. The Federal Communications Commission (FCC) has ordered that certain NI I numbers be assigned for national purposes and
certain uses. As requests are submitted by qualifying entities for N11 numbers assigned for national use, the Company will
update the Tariff accordingly and inconsistent commercial uses of such numbers shall be discontinued according to the
following provisions.
Use of Nll Service is subject to possible recall of the N11 code by the NANP (North American Numbering Plan)
Administrator for national use. The NI l subscriber must, prior to provisioning of the service, sign a written acknowledgement
of this condition and an agreement to return the code upon receipt of 6 months written notice of such a recall from the
Company and abide by all terms and conditions contained in Order 97-S1, issued by the FCC in CC Docket 92-105 regarding
the use and return of such NI 1 codes. If a recall is effected by the NANP Administrator, the Company will work with all NI l
subscribers affected by such recall to transfer their service arrangements, if technically and economically feasible at the time, to
an abbreviated dialing arrangement, and if not feasible, to a seven -digit dialing arrangement within the 6 -month notice period.
The NI l subscriber will be required to migrate to any standard access arrangement for information services subsequently
agreed to by the industry and approved by the FCC. The NI l subscriber will be charged the appropriate tariff rates or lower
rates established on an individual case basis for the establishment of the new access arrangement.
E. The NI l Service is provided where facilities permit.
F. NI I subscribers should work separately with cellular companies to ascertain whether Type 1 cellular customers will be able to
reach information services provided by dialing an NI l number. Charges for calls to the NI I number made from cellular end
users will be billed to the cellular company. This may require the N 11 subscriber to enter into a contractual agreement with the
cellular company to provide 3 -digit access service and the billing associated with the service.
G. NI I subscribers should work separately with competitive local exchange companies to ascertain their end user customers will
be able to reach information services provided by dialing an N l number. The CLEC company will bill charges for calls to the
N l number made from CLEC end users. This may require the NI I subscriber to enter into a contractual agreement with the
CLEC company to provide 3 -digit access service and the billing associated with the service.

H. N11 Service will be provided under the following conditions.
1. For network sizing and protection, each N11 subscriber must provide an estimate of annual call volumes, the expected
busy hour and holding time for each call to an N1 l number.
2. The customer will subscribe to adequate telephone facilities initially. and subsequently as may be required, in the
judgment of the Company, to adequately handle calls to N11 numbers without impairing the Company's general
telephone service or telephone plant. The customer may be required further to bear the expense of traffic load protection
equipment when, in the judgment of the Company, such would be required as a protection to the general telephone
service or telephone plant during temporary periods of traffic overload.
3. The Company report of the number of local calls completed to each NI l number will serve as the sole document upon
which remittance will be made. In the event the Company's charges for calls exceed the revenue from billed calls, the
subscriber will be liable for payment of the difference to the Company. Nonpayment of the NI l call billing by the end
user shall not be cause for denial or termination of the end user's exchange telephone service.
4. The Nl l subscriber is responsible for obtaining all necessary permission, licenses, written consents, waivers and releases
and all other rights from all persons whose work, statements or performance are used in connection with the service, and
from all holders of copyrights, trademarks, and patents used in connection with said service.
5. The NI l subscriber shall be liable for, and shall indemnify, protect, defend and save harmless the Company against all
suits, actions, claims, demands and judgments, and of all costs, expenses and counsel fees incurred on account thereof,
arising out of and resulting directly or indirectly from the Service or in connection therewith, including, but not limited
to, any loss, damage, expense or liability resulting from any infringement or claim of infringement, of any patent,
trademark, copyright, or resulting from any claim of liable and slander.
6. Suspension of Service as covered in Section A2. of this Tariff is not applicable for this service.
7. When Nl l Service is disconnected all remittance money due to the N l subscriber may be credited or applied to the final
bill issued for the recurring charges associated with this Tariff.
8. If an Nll subscriber discontinues subscription to Nll Service, the N11 number will be disconnected and reassigned
according to the conditions defined in A. preceding. Upon the termination of N l Service, the NI I number may be
reassigned after 60 days.
9. Unless otherwise specifically provided in this Tariff, the Company shall be authorized to disconnect any tariffed service
provided to the N11 subscriber utilized, directly or indirectly, with the Nll Service which fails to comply with
regulations and conditions set forth herein, upon five (5) days notice to the subscriber. Disconnection may be suspended
at the discretion of the Company if it receives written certification that the Nll subscriber is in compliance with
regulations and conditions of the tariffs. Continual noncompliance shall be cause for disconnection without notice at the
discretion of the Company.

10. The N11 subscriber is responsible for informing potential end users that a call to the NI 1 number will beat the charge the
subscriber establishes and if applicable, will be billed by the Company for calls from within the NI I subscriber's local
calling area. The NI I subscriber must notify the Company in writing at least 30 days in advance if the call charge is to be
increased or decreased. Such charge shall begin on the date requested by the NI I subscriber. As a result, the NI I end
user bills may show calls to the NI l number at different rates during the same billing period.
11. If the Company provides billing for NI l Service, billing entries to appear on the end user's bill must be specified by the
NI I subscriber, as provided Section A37. of this Tariff. A telephone number must also be provided for printing on the
bill for end user inquiry purposes.
12. The Company will rate the calls from end users of the NI 1 subscriber one charge per call to the N1 I number.
13. The NI l subscriber shall subscribe to adequate exchange facilities to transport the calls to the N1 l subscriber's premises.
14. The Company will not be responsible for recording and rating those calls that by-pass the N 11 routing.
15. The Nll subscriber shall provide appropriate answer supervision for a minimum two-second duration for all calls
completed to the N 11 subscriber to ensure proper recording and rating for the service.
16. When end users are charged for services delivered in response to calls to an NI I number, the NI l subscriber must
provide a preamble at the beginning of each NII Service call, stating the charge for the NI l Service call. The N11
subscriber's preamble on all calls where there is a potential for minors (defined as under 18 years of age) to be attracted to
the program, must provide clear and conspicuous notification in language understandable to children of the requirement
to obtain parental permission before placing or continuing with the call. The preamble message must be given within 15
seconds and must be followed by a 3 second period within which the caller can hang up without being charged the NI l
Service charge for the call. The NI l subscriber may allow a caller to affirmatively bypass a preamble. However, if the
period of time from off -hook condition to on -hook condition is 1S seconds or less, the NI l Service charge will not be
recorded or rated. In those instances where the call is likely to exceed the maximum $10.00 rate level specified in .21
joUowing, the preamble must advise the caller that an additional call may be required to complete the transaction.
17. Children's programs shall not have rates in excess of $10.00 per call, and shall not include the enticement of a gift or
premium.
18. No N1 I subscriber shall promote NI I Service with the use of an autodialer or broadcasting of tones that dial an NI I
number.

19. The N 1 subscriber must prominently disclose the additional cost per minute or per call for any other telephone number

21. The N11 subscriber will charge callers to the N11 number a rate that does not exceed a maximum of $10.00 per call. In
those cases where N1 I subscribers rate their own calls, prior to the termination of a call which has reached the maximum
$10.00 rate level, a caller will be advised that he must terminate the call and initiate another call which may not require
the caller to hear the preamble provided for the initial call. The maximum rate of $10.00 per call will apply to all
subsequently initiated calls placed following the original call.
22. The NI I subscriber shall respond promptly to any and all complaints lodged with any regulatory authority against any
service provided via the NII number. If requested by the Company, the NII subscriber shall assist the Company in
responding to complaints made to the Company concerning the subscriber's N1 l service.
23. A written notice will be sent to any NI 1 subscriber following oral notification when their service unreasonably interferes
with or impairs other services rendered to the public by the Company or by other subscribers of NI I Service. If after
notification the subscriber makes no modification in method of operation or in the service arrangements that are deemed
service -protective by the Company, or if the subscriber is unwilling to accept the modifications, or if the subscriber
continues to cause service impairment, the Company reserves the right, at any time, without further notice, to institute
protective measures, up to and including termination of service. In an emergency situation as defined by the Company,
the Company reserves the right, at any time, without notice, to institute protective measures, up to and including
termination of service.
If a pre-recorded announcement is provided by the N 11 subscriber, the following conditions apply.
1. The Nl l Service subscriber will provide announcements. The Company will provide only the delivery of the call.
2. NI 1 Subscriber sponsorship of any particular announcement of recorded program service shall not preclude another NI I
subscriber from sponsoring the same or similar announcement or recorded program service.
3. The provision of access to the N 11 Network by the Company for the transmission of announcement or recorded program
services is subject to availability of such facilities and the requirements of the local exchange network.
4. The NI I subscriber assumes all financial responsibility for all costs involved in providing announcement or recorded
program services including, but not limited to, the recorder -announcement equipment producing the recording,
advertising and promotional expenses.
5. The NI 1 subscriber assumes, according to other specific rates and charges under tariff, all financial responsibility for all
facilities required to connect the recorder -announcement equipment located on the subscriber's premises.

J. The Company may take all legal and practical steps to disassociate itself from NII subscribers providing services whose
business and/or public conduct (whether demonstrated or proposed) is of a type that generates unacceptable levels of
complaints by end users.
K In no event shall the Company be liable for any losses or damages of any kind resulting from the unavailability of its
equipment or facilities or for any act, omission or failure of performance by the Company, or its employees, or agents, in
connection with this Tariff. The Company shall not be responsible for calls that cannot be completed as a result of repair or
maintenance difficulties on Company facilities and equipment nor on equipment owned or leased by the subscriber.
L The NI I Service subscriber must be located within the principal exchange of the Basic Local Calling Area in which he
subscribes to N11 Service.
M. If the NI l Service subscriber also subscribes to the Company's Billing and Collection service, the subscriber may choose
itemized billing or aggregate billing to the end user. Itemized billing will print on the end user's bill a separate line identifying
each call made to the NI l Service number. Aggregate billing will print on the end user's bill one line to indicate the total
number of calls made to the N11 Service number and the total amount of the charges for those calls.
A39.1.3 Obligations of the Competitive Local Exchange Carrier
A. In those instances where a CLEC assumes responsibility for an N11 subscriber, all terms and conditions defined in this Tariff
and in their Resale Agreement will apply with the exceptions of:
1. Billing on behalf of the NI l subscriber is the responsibility of the CLEC. Billing and Collections as defined in A37. of
this Tariff, will not apply to N1 l services where the N1 l provider is a CLEC's subscriber.
2. When the N11 Service is disconnected or discontinued, the NII Provider must surrender the 7 or 10 -digit number as
defined in A39.1.2.C. preceding.
B. In those instances where a CLEC provides N11 service to its end user within the local calling area, terms and conditions for
NI I service are as defined in the appropriate Interconnection Agreement.
I. For purposes of providing a CLEC end user access to an Nll provider within the local calling area, appropriate
arrangements must be made by the CLEC with the N1 l provider serving the local calling area.
2. A CLEC may negotiate the provision of directory listings as defined in their Interconnection Agreement.
A39.1.4 Advertisement Regulations for N11 Service
A. All advertising inviting the use of or in any way relating to NI l Service shall conform to and comply with the requirements and
conditions contained herein as well as all other applicable tariff provisions, rules, ordinances, laws and statutes.
B. The advertising for N 11 Service shall comply with the following regulations.
1. Advertising may be distributed in any form that the subscriber chooses, provided it complies with and conforms to the
specifications contained herein.
2. No advertiRing shall be permitted which, in form or substance, does not allow for an audit trail which is verifiable
independent of the subscriber for review and confirmation, at any given moment, of compliance with the procedures and
specifications set out herein, as well as in other applicable tariff provisions.

C. Each advertisement shall inform potential callers of the name of the person responsible for the advertisement, the charge for
NI I calls, and if billing is provided by the Company, that the charge will appear on the telephone bill from which the call is
placed. This information shall be displayed with such clarity and prominence to permit it to be noticed and understood by
prospective callers. In order to ensure that callers will have an adequate opportunity to notice and understand the foregoing
information, advertisements inviting the use of or in any way relating to NI I Service will, at a minimum, be conducted in
compliance with the following media -specific specifications.
1. Print Media - Notice of the charge for each NI I call and, when applicable, the fact of inclusion of this charge on the
telephone bill, and the telephone number of the person responsible for the advertisement shall appear on the face of any
printed material, in BOLD type Cif BOLD type is permitted by the advertising medium: if BOLD type is not permitted,
the same type as used in the remainder of the advertisement shall be used) of a sue no smaller than the largest type
contained elsewhere in the advertisement
2. Audio or Verbal Media - Notice of the charge for each Nl l call and, when applicable, the fact of the inclusion of the
charge on the telephone bill shall be stated once during audio or verbal advertisements. This portion of the advertisement
shall be broadcast at the same audio level with the same diction and pace as the remaining portions of the ad.
3. Audio/Visual - Notice of the charge for each NI 1 call and, when applicable, the fact of inclusion of these charges on the
telephone bill, and the person responsible for the advertisement shall be both displayed/broadcast during any audio/visual
advertisement. When displayed, this information shall be shown for the same duration as the NI I Service number is
shown, each time the Nll Service number is shown. In all other respects, the advertisement shall conform to the
specifications for print advertisements and audio or verbal advertisement set out in 1. and 2. preceding.
D. In addition to complying with the procedures stated preceding and all other specifications relating to the advertisement of the
charge and bill consequences associated with N11 Service, each NI I subscriber shall comply with the following:
1. The NI 1 subscriber shall exclude from any advertisement any matter the dissemination of which is prohibited by law. No
advertisement shall be used which, because of words, phrases, statements or illustrations therein or information omitted
therefrom, has the capacity or tendency to mislead or deceive prospective callers as to the cost, extent, quality, caller's
qualification or nature of any information or service to be received from an NI I call. The NI I subscriber shall respond
promptly to any and all complaints lodged with any regulatory authority regarding advertisement for NI l Service. If
requested by the Company, the NI I subscriber shall assist the Company in responding to complaints to the Company
concerning advertisements for N I Service.
2. Where detailed and complete information concerning the NI I Service is prominently displayed in a publication, other
references to the NI 1 Service within that publication need not repeat all of the information so long as each other reference
clearly reflects that there is a charge for dialing the N l Service number and where the complete information is located.

3. NI l subscribers will pay the normal tariffed charges for the local exchange access arrangements (e.g., PBX trunks,
Centrex Type Services lines, etc.) used for transporting and terminating messages at the N11 subscriber's designated
premises.
4. Applicable service order charges as specified in Section A4. of this Tariff will apply, in addition to the following rates.
5. A charge will apply to changes to the billing arrangement at the subscriber's request. Such changes may be one of the
following: a change in rate to the end user for an N l Service call, or a change of subscriber name or telephone number
provided on the end user's bill.
6. A Minimum Usage Charge will be billed to the NI l subscriber in each billing period, following the 6 -month period after
the service has been provisioned, in which the NI I subscriber's usage charges fall below the amount of the Minimum
Usage Charge in B.5. following.
7. Extended NI I Service is provided from exchanges as indicated in A39.1.1.C. A monthly charge applies per business line
or PBX trunk to the N l subscriber in addition to the regular monthly charges for business lines or PBX trunks in Section
A3. of this Tariff. Toll charges to N l codes do not apply from extended NII exchanges when the NII subscriber

A. ZipCONNECT' service is an intraLATA service that allows a subscriber with multiple locations which provide the same

calling party based on the geographic location of the caller. The ZipCONNECT' service subscriber may choose to route calls
based upon wire center, block group, or zip code location of the caller.
B. The ZipCONNECT' service subscriber who subscribes to Wire Center or Block Group Routing can also subscribe to any of

Routing based on the time of day

volume. This grace period will apply only to the subscriber's first 36 -month contract for the service. If the contracted
call volume is not attained, the subscriber will be required to pay the contracted rate for the contracted call volume for
the duration of the 36 -month period. This may not apply if the subscriber can satisfactorily demonstrate the anticipated
call volume prior to the execution of the 36 -month contract. If the actual call volume is greater than the contracted call
volume, the contracted rate will apply.
8.
Volume Discount subscribers who terminate prior to the expiration of the 36 -month contract will incur termination

charges. Termination charges will be calculated by multiplying the minimum call volume by the contracted per call rate
times the number of months remaining in the 36 -month contract.

A Nonrecurring Charge will apply to changes to parameters of an existing ZipCONNECT" service option made at the

ZipCONNECT' service subscriber's request.
10.
A Nonrecurring Charge will apply if the ZipCONNECT' service subscription data must be reconfigured. This could be

due to addition or deletion of a ZipCONNECT' service Option or addition or deletion of ZipCONNECT' service
subscriber Point -to Number. The Nonrecurring Charge includes one set of paper maps verifying the final configuration
of the ZipCONNECT' service for the Wire Center or Block Group Routing subscriber. Additional sets of maps can be
provided to the ZipCONNECT' service subscriber at a charge.

A. Application of Rates

A Nonrecurring Charge will apply for each ZipCONNECT' service subscription per LATA. A Monthly Charge will also

apply for the ZipCONNECT' service per LATA. A Nonrecurring Charge and Monthly Rate for Wire Center, Block
Group or Zip Code Routing will apply for each ZipCONNECT' service subscription.

A Nonrecurring Charge and Monthly Rate will apply for each type of routing ordered by the ZipCONNECT' service

subscriber.

The Nonrecurring Charges for Wire Center Routing and for Block Group Routing includes two sets of paper maps - one

working set and one verifying the final configuration of the subscriber's ZipCONNECT' service. Additional sets of maps
can be provided to the ZipCONNECT' service subscriber at a charge.
4.
The Nonrecurring Charge for Zip Code Routing does not include mapping charges. A mapping vendor will provide the

mapping capability for this routing option.

A Nonrecurring Charge and Monthly Rate will apply for each Point -to Number designated by the ZipCONNECT'

service subscriber for deliverly of calls to the ZipCONNECT' service number.

A per call charge will apply for each recorded call to the ZipCONNECT' service number.

A volume discount may apply to the per call charge if the subscriber commits to a special call volume by signing a

contract for a 36 -month period. The subscriber will be allowed a grace period of one year to attain the committed call
volume. This grace period will apply only to the subscriber's first 36 -month contract for the service. If the contracted
call volume is not attained, the subscriber will be required to pay the contracted rate for the contracted call volume for
the duration of the 36 -month period. This may not apply if the subscriber can satisfactorily demonstrate the anticipated
call volume prior to the execution of the 36 -month contract. If the actual call volume is greater than the contracted call
volume, the contracted rate will apply.
8.
Volume Discount subscribers who terminate prior to the expiration of the 36 -month contract will incur termination
(0)
charges. Termination charges will be calculated by multiplying the minimum call volume by the contracted per call rate
times the number of months remaining in the 36 -month contract.
9.
A Nonrecurring Charge will apply to changes to parameters of an existing ZipCONNECT' service option made at the

ZipCONNECT' service subscriber's request.
10.
A Nonrecurring Charge will apply if the ZipCONNECT' service subscription data must be reconfigured. This could be

due to addition or deletion of a ZipCONNECT' service Option or addition or deletion of ZipCONNECT' service
subscriber Point -to Number. The Nonrecurring Charge includes one set of paper maps verifying the final configuration
of the ZipCONNECT' service for the Wire Center or Block Group Routing subscriber. Additional sets of maps can be
provided to the ZipCONNECT' service subscriber at a charge.

Charges for assignment of a 203-XXXX number are applicable in addition to the charges for ZipCONNECT' service.

The ZipCONNECT' service subscriber may request a special study at any time after the ZipCONNECT' service has been

activated. A ZipCONNECT' service Special Study contains the same information as the monthly report, except that the
special study is conducted over a limited amount of time and can be provided upon request.

The ZipCONNECT' service subscriber may request a ZipCONNECT' service Special Study through the service ordering

process. The ZipCONNECT' service subscriber must specify the day on which the special study should begin and the day on
which it should end. The special study interval must be a minimum of five (5) days and a maximum of thirty-one (3 1) days
and must begin at 12:01 A.M.

The ZipCONNECT' service subscriber may subscribe to the ZipCONNECT' service Monthly Report or to ZipCONNECT'

service Special Study, but can not subscribe to both during the same period of time.

TYPE OF PURCHASE: Term Contract
REASON: The Department of Police has been awarded a grant
from the U.S. Department of Justice's (COPS)
Technology Grant to establish a multiple government
information system (311) to provide citizens with quick
access to non -emergency police and other governmental
services. This 311 service will provide the public with
an easy number to remember, a routing consistent to
the customer's zip code location, and expand the hours
of operation of the NET Service Centers. This service
can only be obtained from BellSouth
Telecommunications, Inc.
RECOMMENDATION: It is recommended that award be made to BellSouth
Telecommunications, Inc., the sole source provider,
for the acquisition of the Non -Emergency Reporting
(NER) 311 Service, for a thirty-six (36) month period,
at a total annual cost not to exceed $105,960, with
the first year cost totaling $136,191, to include
contract preparation fee and the establishment of call
routing service in the amount of $30,231.00, with
funds available from the Police Department General
