FOEMAN CITY CLERK APPROVED AS Page 9 of 9 Rescinded by R-01-350 "EXHIBIT A" ATTACHMENT TO RESOLUTION NO.: DATE: ONE MIAMI - PHASE I PROJECT MAJOR USE SPECIAL PERMIT DEVELOPMENT ORDER Let it be known that pursuant to Articles 13 and 17 of Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended, the Commission of the City of Miami, Florida, has considered in a public hearing, the issuance of a Major Use Special Permit for the One Miami - Phase I Project (hereinafter referred to as the "PROJECT") to be located at approximately 205 South Biscayne Boulevard, Miami, Florida; see legal description on "Exhibit B", attached hereto and made a part hereof; said legal description is subject to any dedications, limitations, restrictions, reservations or easements of record. After due consideration of the recommendations of the Planning Advisory Board and after due consideration of the consistency of this proposed development with the Miami Comprehensive Neighborhood Plan, the City Commission has approved the PROJECT, and subject to the following conditions approves the Major Use Special Permit and issues this Permit: FINDINGS OF FACT PROJECT DESCRIPTION: The proposed One Miami - Phase I Project is a residential/office mixed use development to be located at approximately 205 South Biscayne Boulevard, Miami, Florida. The PROJECT is located on a gross lot area of approximately 4.9 acres and a net lot area of approximately 3. 04 acres of land (more specifically described on "Exhibit B", incorporated herein by reference). The remainder of the SITE DATA AND DEVELOPMENT PROGRAM is attached hereto as "EXHIBIT C", and incorporated herein by reference. The proposed PROJECT will consist of no more than 425 residential units with accessory recreational space, 603,126 square feet of office, retail and other nonresidential uses. The PROJECT will also provide a total of 1,485 parking spaces. The ownership, operation and maintenance of common areas and facilities will be by the property owner or (in the case of the property being converted to condominiums) a mandatory property owner association in perpetuity pursuant to a recorded Declaration of Covenants and Restrictions. Page 2 of 10 The Major Use Special Permit Application for the PROJECT also encompasses the following lower ranking Special Permits: CLASS I SPECIAL PERMIT as per Article 9, Section 906.6, for active recreational facilities (including a swimming pool); CLASS I SPECIAL PERMIT as per Section 915.2 for FAA clearance letter; CLASS I SPECIAL PERMIT to permit staging and parking during construction (to be approved prior to obtaining a building permit from the Department of Planning and Zoning); CLASS I SPECIAL PERMIT for Development Signs when combined with construction/rental signs; CLASS I SPECIAL PERMIT as per Article 9, Section 917.2.1, to allow valet parking for residential use; CLASS I SPECIAL PERMIT for a temporary construction trailer; CLASS II SPECIAL PERMIT as per Article 4, Section 401, for development of new construction within the Central Business District; CLASS II SPECIAL PERMIT for a temporary construction fence and covered walkway; CLASS II SPECIAL PERMIT as per Article 15 for any development between Biscayne Bay and the first dedicated right-of-way; CLASS II SPECIAL PERMIT as per Article 15 for waiver of certain Guides and Standards for 5 foot (51) driveway from property line; CLASS II SPECIAL PERMIT as per Section 908.2, for access from a public street or roadway width greater than 25 feet; CLASS II SPECIAL PERMIT as per Article 9, Section 908 for development on Biscayne Boulevard; � -� - 1 Page 3 of 10 Special Exception as per Article 4, Sec. 401, to allow bar/lounge open to the public; Special Exception as per Article 9, Sec. 917.1.2, to allow valet parking for restaurant up to fifty percent (500) of existing off-street parking spaces; Certificate of Appropriateness for ground disturbing activity in an archeological conservation area (City Code Section 23-5a); Designation as a phased project, pursuant to Section 2502 of Zoning Ordinance 11000, as amended; and Waiver from the City Commission for the following: 1. Noise Ordinance during the required concrete pours for construction of the building (City Code Chapter 3 6) . 2. Waterfront Charter provision 3(mm)(iii). Pursuant to Articles 13 and 17 of Zoning Ordinance No. 11000, approval of the requested Major Use Special Permit shall be considered sufficient for the subordinate permits requested and referenced above as well as any other special approvals required by the City which may be required to carry out the requested plans. The PROJECT shall be constructed substantially in accordance with plans and design schematics on file prepared by Arquitectonica, dated September, 2000, as modified by plans dated January 16, 2001; the landscape plan shall be implemented Page 4 of 10 substantially in accordance with plans and design schematics on file prepared by Curtis & Rogers Design Studio, Inc., dated September, 2000, as modified by plans dated January 16, 2001; said design and landscape plans may be permitted to be modified only to the extent necessary to comply with the conditions for approval imposed herein; all modifications shall be subject to the review and approval of the Director of the Department of Planning and Zoning prior to the issuance of any building permits. The PROJECT conforms to the requirements of the CBD (Central Business District) Zoning District, as contained in Ordinance No. 11000, the Zoning Ordinance of the City of Miami, Florida, as amended. The existing comprehensive plan future land use designation on the subject property allows the proposed mix of residential and commercial uses. CONDITIONS THE APPLICANT, ITS SUCCESSORS, AND/OR ASSIGNS, JOINTLY OR SEVERALLY, PRIOR TO THE ISSUANCE OF ANY BUILDING PERMITS, SHALL COMPLY WITH THE FOLLOWING: Page 5 of 10 1. Meet all applicable building codes, land development regulations, ordinances and other laws. 2. Pay all applicable fees due prior to the issuance of a building permit. 3. Allow the Miami Police Department to conduct a security survey, at the option of the Department, and to make recommendations concerning security measures and systems; further submit a report to the Department of Planning and Zoning, prior to commencement of construction, demonstrating how the Police Department recommendations, if any, have been incorporated into the PROJECT security and construction plans, or demonstrate to the Planning Director why such recommendations are impractical. 4. Obtain approval from, or provide a letter from the Department of Fire -Rescue indicating APPLICANT'S coordination with members of the Fire Plan Review Section at the Department of Fire -Rescue in the review of the scope of the PROJECT, owner responsibility, building development process and review procedures, as well as specific requirements for fire protection and life safety systems, exiting, vehicular access and water supply. 5. Obtain approval from, or provide a letter of assurance from the Department of Solid Waste that the PROJECT has addressed all concerns of the said Department prior to the obtainment of a shell permit. 6. Prepare a Minority Participation and Employment Plan (including a Contractor/Subcontractor Participation Plan) to be submitted to the City's Director of Equal Employment Opportunity for review and comments, with the understanding that the APPLICANT must use its best efforts to follow the provisions of the City's Minority/Women Business Affairs and Procurement Program as a guide. 7. Record the following in the Public Records of Dade County, Florida, prior to the issuance of a shell permit: (a) a Declaration of Covenants and Restrictions providing that the ownership, operation and maintenance of all common areas and facilities will be by the property owner or a mandatory property owner association in perpetuity; (b) a certified copy of the Development Order specifying that the Development Order runs with the land and is binding on the Page 6 of 10 �?, APPLICANT, its successors, and assigns, jointly or severally. 8. Prior to the issuance of a shell permit, demonstrate to the City that the PROJECT has either: (a) completed its condominium requirements and has been approved for such by the State of Florida; or (b) provide the City with an executed, recordable unity of title or covenant in -lieu of unity of title agreement for the subject property; said agreement shall be subject to the review and approval of the City Attorney's Office. 9. Provide the Department of Public Works with plans for proposed sidewalk and swale area improvements (including implementation of the Burle Marx Plan for Biscayne Boulevard) for its review and approval prior to the issuance of a building permit. 10. Provide the Department of Planning and Zoning with a temporary parking plan, including an operational plan, which addresses construction employee parking during the construction period; said plan shall be subject to the review and approval by the Department of Planning and Zoning prior to the issuance of any building permits and shall be enforced during construction activity. 11. Pursuant to the Departments of Fire -Rescue and General Services Administration, the roof area of the proposed structures shall be made available to the City of Miami for any necessary communications equipment at no charge to the City. 12. The APPLICANT shall keep the Miami -Dade County archeologist apprised of all ground disturbing activity; based upon his findings, some level of monitoring by a private archeological consultant may be required. 13. Pursuant to the condition from the Urban Development Review Board and staff design review, the APPLICANT shall submit final revised design details, including materials, color schemes, and final landscape and lighting plan, to the Director of the Panning and Zoning Department for review and approval, prior to the issuance of a building permit; plans shall also include final design and landscape details for the river and bay walks. Prior to the issuance of a shell permit, the APPLICANT shall submit an interim plan, including a landscape plan, which addresses design details for the land occupying Phase II of this PROJECT in the event that the future phase is not developed; said plan shall include a proposed timetable and shall be subject to review and approval by the Director of the Department of Planning and Zoning. 15. Prior to the issuance of any building permits for Phase II of this PROJECT, the APPLICANT shall conduct updated traffic studies that shall include recommendations for mitigation. 16. As recommended by the Planning Advisory Board, if a dock is not constructed, a railing (type and design to be approved by the Department of Planning and Zoning) shall be provided along the river/bay walk (due to the particularly turbid conditions of the water at this location). 17. As recommended by the Planning Advisory Board, the APPLICANT shall work with the Department of Planning and Zoning to submit results of a laboratory test regarding archeology within 90 days of issuance of the Development Order. 18. Prior to issuance of any building permit, solutions to issues relating to providing a more pedestrian -friendly design and environment and to the proximity of the development to the Miami River shall be subject to the review and approval of the Director of Planning and Zoning. THE CITY SHALL: Establish the operative date of this Permit as being thirty (30) days from the date of its issuance; the issuance date shall constitute the commencement of the thirty (30) day period to appeal from the provisions of the Permit. Page 8 of 10 CONCLUSIONS OF LAW The PROJECT proposed by the APPLICANT complies with the Miami Comprehensive Neighborhood Plan 1989-2000, is consistent with the orderly development and goals of the City of Miami, and complies with local land development regulations and further, pursuant to Section 1703 of Zoning Ordinance No. 11000: (1) the PROJECT will have a favorable impact on the economy of the City; and (2) the PROJECT will efficiently use public transportation facilities; and (3) the PROJECT will favorably affect the need for people to find adequate housing reasonably accessible to their places of employment; and (4) the PROJECT will efficiently use necessary public facilities; and (5) the PROJECT will not negatively impact the environment and natural resources of the City; and (6) the PROJECT will not adversely affect public safety; and (7) the public welfare will be served by the PROJECT; and (8) any potentially adverse effects of the PROJECT will be mitigated through conditions of this Major Use Special Permit; and (9) the PROJECT complies with the criteria for modification of the Waterfront Charter provisions as specified in Section 3(mm)(ii) of the City Charter. TO FROM CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM Honorable Chairman and Members of the City Commission I z City Manager RECOMMENDATION PZ -3 DATE: JAN 18 2001 FILE: SUBJECT: Nonsubstantial Modification for One Miami MUSP Project (Phase I) REFERENCES: ENCLOSURES: It is respectfully recommended that the City Commission approve the attached request for a Major Use Special Permit for the One Miami Project (Phase I) and accept the modified plans per the attached findings that the proposed modifications are nonsubstantial. BACKGROUND The attached request is a modification of a previous application for development approval for the One Miami Project (Phase I). The Department of Planning and Zoning has reviewed the modified proposal and is recommending approval based on findings that the modification, while nonsubstantial pursuant to Section 2215 of the Zoning Ordinance (see attached), substantially reduces the impact on the adjacent property by reducingthe size of the abutting wall and building sizes; the plan also offers a better solution to activating the River's edge with additional pedestrian oriented activity. The modified plans are consistent with the criteria required for City Commission waiver of Section 3(mm)(ii) of the City of Miami Charter. The modified plans promote a better urban environment and public advantages. Pursuant to Articles 13 and 17 of Zoning Ordinance 11000, approval of the requested Major Use Special Permit shall be considered sufficient for the subordinate permits requested and referenced above as well as any other special approvals required by the City which may be required to carry out the requested plans. The requested Special Permit is for the purpose of allowing a mixed-use development project with consisting of 623,348 sq. ft. of office and retail use, and a total of 425 residential units, with 1,834 parking spaces, for the property located at approximately 205 South Biscayne Boulevard (see attached legal description, location maps and aerial photographs for exact property boundaries). In determining the appropriateness of the proposed residential project, the Planning and Zoning Department has referred this project to the Large Scale Development Committee (LSDC), the City of Miami Preservation Officer, and the Urban Development Review Board (UDRB) for additional input and recommendations; the following findings have been made: • It is found that the proposed office and residential development project, with accessory retail, will benefit the Downtown District by creating new housing opportunities in the core area to serve Downtown. • It is found that the subject property has convenient access to public transit that makes it ideally suited for residential and office as a mixed use to serve the downtown area. • It is found that per the Fire and GSA Departments of the City, the roof of the proposed structure may be required for communications equipment to serve the City; this are should be made available for said use at no charge to the City. • It is found that the City of Miami Preservation Officer reviewed the project and that a recommendation was made regarding archeological monitoring in the manner set forth in the condition described below. • It is found that the project was reviewed by the Large Scale Development Committee on August 22, 2000 and has been modified to address the expressed technical concerns raised at said Large Scale Development Committee meeting; however, additional design details related to sidewalk and swale area improvements will have to be submitted at the time of permitting. • It is found that the UDRB has recommended approval of the proposed project, with the condition as specified below, pursuant to a public meeting held on October 23, 2000. UDRB Condition: 1) Make revisions to the apartment buildings and come back to UDRB within 90 days of MUSP approval before building permit. Review: articulation of the apartment building; massing; and detailing. • It is found that the narrow width and irregular shape of a portion of the subject property is a substantial hardship that limits reasonable use of the property and therefore justifies the requested Waterfront Charter modification, and additionally, public benefits have been adequately provided for; final design details pertaining to the bay and river walks shall be subject to review and approval by the Director of Planning and Zoning. • It is found that the proposed project offers the most reasonable solution to the design problem facing this particular site. 01- 81 • It is found that upon referral of the proposed project to Public Works and the Downtown NET Office, the following comments were received: 1. Pursuant to the Department of Public Works, the project requires .plans for proposed sidewalk and swale area improvements prior to the issuance of a building permit; and 2. Pursuant to the Downtown NET Office, the applicant shall submit a parking plan for construction employees, including an operational plan for construction activity and enforcement; said parking plan shall be subject to the review and approval by the Department of Planning and Zoning prior to the issuance of any building permits. • It is found that, as a phased development project, it is difficult, if not impossible, for the developer to anticipate levels of actual future development and associated traffic impacts associated with such development. In order to adequately ensure that adverse impacts to the area will not occur, the Planning and Zoning Department would recommend that a condition be added to this development order which requires the applicant to conduct updated traffic studies prior to obtaining building permits for each subsequent phase of this project. The subject traffic studies should include recommendations for mitigation, including signalization options for the area. • It is found that the Department of Planning and Zoning is in concurrence with these comments (with the exception of a mandatory review of final design by UDRB, which shall be at the discretion of the Planning and Zoning Director) and will require compliance with the above referenced conditions prior to the issuance of any building permits for the proposed project. • It is found that with respect to all additional criteria as specified in Section 1305 of Zoning Ordinance 11000, the proposal has been reviewed and found to be adequate. Based on these findings, the Department of Planning and Zoning is recommending approval of the requested Development Project with the following conditions: 1. The approval of this Major Use Special Permit shall be subject to the recordation of the following documents prior to the issuance of shell permits for the proposed project: a. Unity of Title or covenant in lieu thereof providing that the ownership, operation and maintenance of all common areas and facilities will be by the property owner or a mandatory property owner association in perpetuity or completion of the State of Florida condominium process which assures the same compliance. b. Development Order specifying that the Development Order runs with the land and is binding on the Applicant, it successors and assigns, jointly or severally. 2. Pursuant to the Department of Public Works, the project requires plans for proposed sidewalk and swale area improvements (including implementation of the Burle Marx plan for Biscayne Boulevard) prior to the issuance of a building permit. 3. Pursuant to the Fire and GSA Departments, the roof area of the proposed structure shall be made available to the City of Miami for any necessary communications equipment at no charge to the City. 4. The applicant shall submit a parking plan for construction employees, including an operational plan for construction activity and enforcement; said parking plan shall be subject to the review and approval by the Department of Planning and Zoning prior to the issuance of any building permits. 5. The applicant shall keep the Dade County archeologist apprised of all ground disturbing activity; based upon his findings, some level of monitoring by a private archeological consultant may be required. 6. Pursuant to the condition from the UDRB and staff review, the APPLICANT shall submit final design details, including materials, color schemes, and final landscape and lighting plan, to the Director of the Panning and Zoning Department for review and approval, prior to the issuance of a building permit; plans shall also include final design and landscape details for the river and bay walks. 7. Prior to the issuance of a shell permit, the APPLICANT shall submit an interim plan, including a landscape plan, which addresses design details for the land occupying Phase II of this project in the event that the future phase is not developed; said plan shall include a proposed timetable and shall be subject to review and approval by the Director of the Planning and Zoning Department. 8. The applicant shall conduct updated traffic studies prior to obtaining building permits for each future phase of this project. The subject traffic studies should include recommendations for mitigation, including signalization options for the area. 9. This paragraph presents the Miami River Commission's vision of a downtown RiverwaIk and provides clarification and rationale for our position on items PZ 2 and PZ 3. One of the Miami River Commission's top priorities is to develop a continuous Greenway or Riverwalk around the entire river. Historically the public has been isolated from the Miami River, and the Riverwalk would reconnect them to this valuable community resource. As clearly shown by the success of the Fort Lauderdale, Chattanooga, Pittsburgh and other city riverwalks, our riverwaik will attract residents and tourists, creating a critical mass of activity along the Miami River's downtown shoreline. The Miami River and Greenway will become a destination landscape, creating reoccurring revenues to the City of Miami with adjoining businesses, such as cafes, restaurants and fresh fish markets. In addition, the riverwalk will cause nearby properties to increase in value, increasing tax revenues. In addition, the greenway should have cleats along the Miami River's shore, in order to provide recreational boats a place to tie up to the riverwalk. These standards are consistent with the recommendations of Greenways, Inc., the professional Riverwalk planners, who designed the Miami River Greenway. (Please see attached Riverwalk sectional views.) PZ 3) PZ 3 is a modification of a previously approved MUSP for the One Miami Project. The majority of the One Miami Riverwalk has only a 14 -foot clear path. In addition the West end of the One Miami Riverwalk portion has a barricade, forcing the Riverwalks clear path to turn north, off the Riverbank, towards Biscayne Blvd. The Miami River Commission passed a motion recommending approval of the project with the following conditions. 1) The One Miami segment of the Greenway widens the clear path to a minimum of 16 feet. 2) In the event that the Ramada Dupont Plaza opens access to the Riverwalk along the River's shore, the planned barricade between One Miami and the Dupont Plaza is removed, in order to allow a continuous Greenway. The Miami River Commission recommends these revisions be incorporated into the official plans submitted to the City, and we respectfully request a review of the plans prior to issuing building permits. PZ 2) The One Riverview Square project has considerably improved since the City Commission denied it on December 14, 2000. The proposed riverwalk's clear path width doubled from 8 to 16 feet, and the building setback doubled from twenty to forty feet. The Miami River Commission passed a resolution in support of the projection with one condition. Cleats are added on the Miami River shoreline, in order to permit recreational boats to tie onto the riverwalk. The applicants expressed their support of the condition, and stated their approval of the Miami River Commission's review process, which resulted in an improved One Riverview Square proj ect.
