RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), MAKING FINDINGS AND
APPROVING A MODIFICATION OF THE WATERFRONT
CHARTER REQUIREMENT AS SET FORTH IN
SECTION 3(mm)(ii)(A) OF THE CHARTER OF THE
CITY OF MIAMI, FLORIDA, AS AMENDED, WHICH
ESTABLISHES A 50 FOOT SETBACK REQUIREMENT
FOR ALL PROJECTS ALONG THE MIAMI RIVER, EAST
OF NORTHWEST 5TH STREET, TO PERMIT A 40 FOOT
SETBACK FOR THE "ONE RIVERVIEW SQUARE"
PROJECT, TO BE LOCATED AT THE PROPERTY
GENERALLY BOUNDED BY THE MIAMI RIVER ON THE
SOUTH, SOUTH MIAMI AVENUE ON THE WEST, THE
METROMOVER GUIDEWAY ON THE EAST AND
SOUTHEAST 4TH STREET ON THE NORTH, MIAMI,
FLORIDA, AS LEGALLY DESCRIBED ON "EXHIBIT A,"
ATTACHED HERETO AND MADE A PART HEREOF.
WHEREAS, on December 28, 2000, Panther Real Estate
Partners, (the "APPLICANT"), submitted a request for a
modification of the Waterfront Charter requirement set forth in
Section 3(mm)(ii)(A) of the Charter of the City of Miami,
Florida, as amended (the "Charter") for a reduction in the
waterfront setback from 50 feet to 40 feet for the "One Riverview
Square Office" Project, as legally described on "Exhibit A,"
attached hereto and made a part hereof; and

WHEREAS, said Charter modification requires City Commission
approval; and
WHEREAS, the City Commission deems it advisable and in the
best interest of the general welfare of the City of Miami to
approve the requested waterfront Charter modification as
hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Commission (a) hereby finds that
the "One Riverview Square" Project complies with the criteria for
modification of the Waterfront Charter provisions as specified
in Section 3(mm)(ii) of the Charter, which establishes a 50 foot
setback requirement for all projects along the Miami River, east
of Northwest 5th Street, and (b) hereby approves a modification
to said Charter Provision to permit a 40 foot setback for the
"One Riverview Square" Project, to be located at the property
generally bounded by the Miami River on the south, South Miami
Avenue on
the
west,
the Metromover
Guideway on the
east and
Southeast
4th
Street
on the north,
Miami, Florida, as
legally
described on "Exhibit A," attached hereto and made a part hereof.

Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.'/

It is respectfully recommended that the City Commission approve the attached request to
waive a provision of the City of Miami's Waterfront Charter requirement for the One
Riverview Square Office Project to be located at the property generally bounded by the
Miami River on the south, Miami Avenue on the west, the Metromover guideway on the
east, and SE 4`'' Avenue on the north.
BACKGROUND
Section 3(mm)(ii) of the City of Miami Charter (see attached) requires a 50 -foot setback
for development along Biscayne Bay and the Miami River. Waivers of this provision are
permitted by the City Commission if the Commission determines that "the modifications
requested provide public access, public walkways, plaza dedications, covered parking up
to the floodplain level, or comparable benefits which promote a better urban environment
and public advantages, or which preserve natural features."
The attached request is a modification of a previous request in order to construct a new
office building along the Miami River at the Miami Avenue Bridge. The modified
requested waiver is to specifically allow a setback of 40 feet instead of the required 50
feet.
The Department of Planning and Zoning has reviewed the modified proposal and is
recommending approval based on findings that the modification from 20 feet to 40 feet is
in character with the river and that the new construction is providing Riverwalk amenities
and public access, including connections from the new proposed Riverwalk to the
adjacent streets for use by pedestrians. The modified plans promote a better urban
environment and public advantages.
