A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), GRANTING A TEMPORARY
CONSTRUCTION EASEMENT TO THE SOUTH FLORIDA
WATER MANAGEMENT DISTRICT FROM FEBRUARY 15,
2001 TO APRIL 14, 2002, ON APPROXIMATELY .017
ACRES OF CITY -OWNED PROPERTY AT THE MELREESE
GOLF COURSE, LOCATED AT 1400 NORTHWEST 37TH
AVENUE, MIAMI, FLORIDA, AS MORE PARTICULARLY
DESCRIBED IN "EXHIBIT A", ATTACHED HERETO AND
MADE A PART HEREOF, FOR USE AS A STAGING AREA
FOR THE CONSTRUCTION OF A PUMPING STATION,
SUBJECT TO BUNKERS OF MIAMI, A FLORIDA JOINT
VENTURE, EXECUTING A JOINDER TO THIS
TEMPORARY CONSTRUCTION EASEMENT; FURTHER
AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, REQUIRED FOR THE GRANT OF
THE TEMPORARY CONSTRUCTION EASEMENT.
WHEREAS, the South Florida Water Management District has
requested the grant of a temporary construction easement of
approximately 0. 17 acres of City property at the Melreese Golf
Course, located at 1400 Northwest 37th Avenue, Miami, Florida, to
use as a staging area, with full right of ingress and egress, to
construct a pumping station to provide relief from severe
flooding problems to the residents of the City of Miami and for
new construction at the Melreese Golf Course by moving a higher
volume of water at a faster rate in flood prone areas and

providing for reclamation, water storage, depositing, storing and
removing dredged or excavated material, installing culverts and
power facilities, laying, operating and using dredge pipe lines,
and storing equipment materials, vehicles and supplies; and
WHEREAS, the grant of Temporary Construction Easement is
required from February 15, 2001 through April 14, 2002, subject
to Bunkers of Miami executing a joinder to this Temporary
Construction Easement;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. A Temporary Construction Easement is granted
to the South Florida Water Management District from February 15,
2001 to April 14, 2002, on approximately .017 acres at the
Melreese Golf Course, located at 1400 Northwest 37th Avenue,
Miami, Florida, as more particularly described in "Exhibit A",
attached hereto and made a part hereof, for use as a staging area
for the construction of a pumping station, subject to Bunkers of
Miami, a Florida Joint Venture, executing a joinder to this
Temporary Construction Easement.

Section 3. The City Manager is authorizedlj to execute
the necessary documents, in a form acceptable to the City
Attorney, required for the grant of the Temporary Construction
Easement.
Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor .2/

1/ The herein authorization is further subject to compliance with all
requirements that may be imposed buy the city Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.
2/ If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

Resolution Granting a Temporary
SUBJECT: Construction Easement to South
Florida Water Management District
for a portion of Melreese Golf
REFERENCES Course.
ENCLOSURES:
The administration recommends that the City Commission adopt the attached Resolution
authorizing the City Manager to execute a Temporary Construction Easement, in a form
acceptable to the City Attorney, with South Florida Water Management District ("Grantee"), for
the purpose of granting Grantee the right to use approximately .017 acre, at the Melreese Golf
Course located at 1400 Northwest 37' Avenue, Miami, Florida, as more particularly described in
Exhibit "A" attached hereto and made a part hereof as a construction staging area, for the period
of February 15, 2001 to April 14, 2002, subject to Bunkers of Miami, a Florida Joint Venture,
executing a joinder to this Temporary Construction Easement.
BACKGROUND:
The South Florida Water Management District has requested the City to grant a temporary
construction easement on a portion of Melreese Golf Course to be used in connection with the
construction of a pump station. This easement will be used as a staging area in connection with
any project in the interest of flood control, reclamation, water storage and for depositing, storing
and removing dredged or excavated material, installing culverts and power facilities, laying,
operating and using dredge pipe lines, and storing equipment materials, vehicles and supplies,
with full right of ingress thereto and egress therefrom.
The City of Miami greatly benefits from the construction of this pump station because it will
alleviate severe flooding to City residents, and to the Melreese Golf Course that is in a flood
prone area.
