A RESOLUTION OF THE MIAMI CITY COMMISSION BY A FOUR-FIFTHS (4/5 THS) AFFIRMATIVE VOTE RATIFYING, APPROVING, AND CONFIRMING THE CITY MANAGER'S FINDING OF AN EMERGENCY, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, AND AUTHORIZING THE PROCUREMENT OF UNIFORM CLOTHING AND ACCESSORIES FOR THE DEPARTMENT OF POLICE FROM MARTIN'S LAMAR UNIFORMS, IN AN AMOUNT NOT TO EXCEED $9,950; ALLOCATING FUNDS FROM THE POLICE GENERAL OPERATING BUDGET, ACCOUNT CODE NO. 001000.290201.6.075. WHEREAS, on April 18, 2000, Invitations for Bids Nos. 99-00-115 and 99-00-116 were issued for the procurement of uniform clothing and accessories; and WHEREAS, Bid Nos. 99-00-115 and 99-00-116 were rejected based on non-compliance with bid requirements of sample submittal and failure to submit certain required documents; and WHEREAS, Martin's Lamar Uniforms' contract for the provision of uniform clothing and accessories expired on September 30, 2000, and Martin's Lamar Uniforms agreed to extend its contract through November 30, 2000 under the same terms, price and conditions; and CITY COMMISSION MEETING OF i%usolution No. 0i- ,C WHEREAS, the City Manager made a written finding that a valid emergency existed and authorized procurement of uniform clothing and accessories from Martin's Lamar Uniforms through November 30, 2000; and WHEREAS, funds are available from the Police General Operating Budget, Account Code No. 001000.290201.6.075; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four-fifths (4/5ths) affirmative vote of the members of the City Commission, the City Manager's finding of an emergency, waiving the requirements for competitive sealed bidding procedures, and authorizing the procurement of uniform clothing and accessories for the Department of Police from Martin's Lamar Uniforms, in an amount not to exceed $9,950 is hereby ratified, approved and confirmed, with funds allocated from the Police General Operating Budget, Account Code No. 001000.290201.6.075. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.'/ 1� If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. Funding is available from the Police General Operating Budget, Account 001000.290201.6.075. BACKGROUND On April 18, 2000, the Purchasing Department issued an Invitation for Bid for these services. Per the City Manager's approval, all bids received pursuant to Bid No. 99-00-115 and Bid No. 99-00- 116, were rejected based on non-compliance with bid requirements regarding sample submittal and failure to submit certain required documents. The sample requirements for the new bid will be revised to maximize competition and bid compliance. The contract with Martin's Lamar Uniforms for the provision of uniforms and uniforms accessories expired on September 30'h, 2000. All allowable contract extensions have been exhausted; therefore, the department received approval from the City Manager to issue an Emergency Purchase for the continuation of these services for a two (2) month period, from October 1', 2000 to November 30'`, 2000. Martin's Lamar Uniforms has agreed to provide these goods under the same terms, price and conditions. Martin's Lamar Uniforms has provided these goods to the department for the last ten (10) years.
