A RESOLUTION OF THE MIAMI CITY COMMISSION BY
A FOUR-FIFTHS (4/5T11) AFFIRMATIVE VOTE,
AFTER A DULY ADVERTISED PUBLIC HEARING,
RATIFYING, APPROVING AND CONFIRMING THE CITY
MANAGER'S FINDING OF AN EMERGENCY, WAIVING
THE REQUIREMENTS FOR COMPETITIVE SEALED
BIDDING PROCEDURES, AND AUTHORIZING THE
ACQUISITION OF SERVICES FOR THE DEPARTMENT
OF PUBLIC WORKS FOR CAPITAL IMPROVEMENT
PROJECT NO. 341203, ENTITLED MODEL CITY
ROADWAY IMPROVEMENTS, LOCATED AT NORTHWEST
41ST STREET BETWEEN NORTHWEST 12TH AND
NORTHWEST 17TH AVENUES, MIAMI, FLORIDA, AS
FOLLOWS: DESIGN AND ENGINEERING SERVICES IN
AN AMOUNT NOT TO EXCEED $100,000 AND AWARD
OF A CONSTRUCTION CONTRACT TO THE LOWEST
RESPONSIVE RESPONSIBLE BIDDER IN AN AMOUNT
NOT TO EXCEED $650,000; AUTHORIZING THE CITY
MANAGER TO EXECUTE THE NECESSARY DOCUMENTS,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PROJECT.
WHEREAS, on December 14, 2000, the City Manager made a
written finding that roadway improvements required at Northwest
418t Street between Northwest 12th and 17th Avenues, Miami,
Florida, were of an emergency nature; and
WHEREAS,

December 14, 2000, increased the appropriations for Capital
Improvement Project ("CIP") No. 341203, entitled Model City
Street Improvements, to reflect the appropriation of funds in
the amount of $750,000 for said CIP; and
WHEREAS, pursuant to Resolution No. 00-1109, adopted
December 14, 2000, the City Commission authorized the allocation
of funds, in an amount not to exceed $750,000, and authorized
the City Manager to execute agreement(s), for design and
engineering services for said CIP; and
WHEREAS, the City Manager was further directed to schedule
a public hearing at the January 11, 2001 City Commission meeting
for purposes of waiving competitive bidding procedures for the
selection of the contractor(s) for said improvements;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

Section 2. By a four-fifths (4/5ths) affirmative vote of
the members of the City Commission, after a duly advertised
public hearing, the City Manager's finding of an emergency,
waiving the requirements for competitive sealed bidding
procedures, and authorizing the acquisition of services for the
Department of Public Works for Capital Improvement Project
No. 341203, entitled Model City Improvements, located at
Northwest 41St Street between Northwest 12th and Northwest 17th
Avenues, Miami, Florida, from as follows: design and engineering
services in an amount not to exceed $100,000, and the award of
the construction contract to the lowest responsive and
responsible bidder, in an amount not to exceed $650,000, is
ratified, approved and confirmed.
Section 3. Funds in the amount of $750,000 were
previously allocated pursuant to Resolution No. 00-1109 for
Capital Improvement Project No. 341203.
Section 4. The City Manager is authorized" to execute
an agreement(s), in a form acceptable to the City Attorney, with
the appropriate entities for said project.
i/ The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but
not limited to those prescribed by applicable City Charter and Code
provisions.

Section 5. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.2/

2/ If the Mayor does not sign this Resolution, it shall become effective
at the end of ten calendar days from the date it was passed and
adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Resolution
ratifying, approving and confirming the City Manager's finding of an Emergency, waiving
the requirements for competitive sealed .bidding procedures, and authorizing the
acquisition of services for the Department of Public Works for Capital Improvement
Project No. 341203, entitled Model City Roadway Improvements, located at NW 41
Street between NW 12th and NW 17th Avenue, Miami, Florida, and awarding to the
lowest responsive and responsible bidder and to proceed with the construction of the
project.
BACKGROUND
On December 14, 2000, the City Manager made a written finding that roadway
improvements are required at NW 41 Street between NW 12th and 17th Avenues. Public
Works Department conducted a block -by -block condition survey of NW 41 Street
between NW 12 and NW 17 Avenues and found the .driving surface in poor condition,
deteriorated pavement edges, and the absence of drainage systems for the roadway.
Design, engineering and job advertising costs are estimated at $100,000 with the
estimated construction cost of $650,000.
The City Commission, pursuant to Ordinance No. 11970, as amended by Ordinance No.
12005, adopted December 14, 2000, increased the appropriations for Capital
Improvement Project (CIP) No. 341203, entitled Model City Street Improvements to
reflect the appropriation of funds in the amount of $750,000 for the design and
engineering services and the construction costs. In order to expedite the project, the
City Manager shall award the construction contract to the lowest and responsive and
responsible contractor and proceed with the construction of the project.

Emergency Finding
Waiver of Formal Bids for
NW 41 Street improvements
Based on my investigation of the condition of NW 41 Street between NW 12 and NW 17
Avenues, I have found that an emergency exists on this roadway, which justifies the
design and selection of an engineering consultant and contractor by informal bids.
The Public Works Department requests authorization to complete the project work by
using a design consultant and awarding a contract, or by design -build
consultant/contractor on an informal basis. The amount of $750,000 shall be made
available. All costs of this project will be funded from Capital improvement project funds.

NOTICE TO THE PUBLIC
A public hearing will be held by the City Commission of the City of Miami,
Florida, on January 11, 2001 at 9:30 a.m. in the City Commission Chambers at
City Hall, 3500 Pan American Drive, Miami, Florida, for discussions pertaining to
the ratification of the City Manager's finding of an emergency on the Model City
Roadway Improvements project located at NW 41 Street between NW 12 and NW
17 Avenues, Miami, Florida.
All interested persons are invited to appear and may be heard concerning this
Resolution. Should any person desire to appeal any decision of the City
Commission with respect to any matter considered at this hearing, that person
shall ensure that a verbatim record of the proceedings is made, including all
testimony and evidence upon which any appeal may be based.
