V __ A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT A QUIT CLAIM DEED, IN SUBSTANTIALLY THE ATTACHED FORM, FROM THE STATE OF FLORIDA, DEPARTMENT OF COMMUNITY AFFAIRS ("STATE"), FOR THE CONVEYANCE TO THE CITY OF MIAMI OF THE STATE'S INTEREST IN THE PROPERTY LOCATED AT 5925-5927 NORTHEAST 2ND AVENUE, MIAMI, FLORIDA, COMMONLY KNOWN AS THE CARIBBEAN MARKETPLACE; AUTHORIZING THE CITY MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 88-646, the City of Miami provided financial assistance to the Haitian Task Force ("HTF"), a community-based organization, in the amount of $150,000.00, for the development of the Caribbean Marketplace, a commercial center for the Little Haiti community; and WHEREAS, the City of Miami and the State of Florida Department of Community Affairs ("State") were two of the leaders that provided financial assistance for the project; and WHEREAS, the payment of all county taxes have not been paid since 1992, the same time period that the HTF organization was dissolved as an entity; and i Rn FM bS'.: CITY CQMUSSiON MEETING OE JAN 1 1 2001 t��so:uuon l�ro. WHEREAS, on January 23, 1997, the City of Miami, along with the State, acquired the Caribbean Marketplace through public auction; and WHEREAS, the City and the State automatically became liable for all unpaid taxes owed on the property; and WHEREAS, the State indicated it would not pay its proportionate share of the taxes due on the property nor did it wish to continue its partial ownership of the property; and WHEREAS, on February 9, 1998, the City Commission authorized the payment of the past due taxes in the amount of $190,197.23; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorizedll to accept a Quit Claim Deed, in substantially the attached form, to provide for conveyance to the City of Miami of the State's interest in the property located at 5925-5927 Northeast 2nd Avenue, Miami, Florida. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. This Resolution further authorizes the City Manager to execute any and all documents necessary, in a form acceptable to the City Attorney, to accept this deed. BACKGROUND: In July, 1998, the City of Miami provided financial assistance to the Haitian Task Force (HTF), a community-based organization, in the amount of $150,000.00, for the development of the Caribbean Marketplace, a commercial center for the Little Haiti community. The City and the State of Florida Department of Community Affairs were two of various leaders that provided financial assistance to this project. By 1992, the project experienced financial difficulties, due to management by HTF, resulting in the organization being dissolved as an entity. Accordingly, with ownership in question, all county taxes since 1992 were never paid. On January 23, 1997, the City of Miami, along with the State of Florida, which together held similar senior lien positions on the property, acquired the Caribbean Marketplace through a public auction. This acquisition resulted in the termination of all other inferior liens on the property; however, the City and the State automatically became liable for any unpaid taxes owed on the property. On February 9, 1998 the City notified the State of the delinquent taxes owed and that a certificate holder would be filing for a tax deed. The State advised that they would not be paying for the unpaid taxes and that they did not wish to continue their partial ownership of this property. On February 10, 1998 the City Commission authorized the payment of the outstanding taxes in the amount of $190,197.23. As a result of this situation the State of Florida, Department of Community Affairs, agreed to transfer their partial ownership to the City of Miami. , CAG:DB-&:MemoQC Deed 12-14.doc
