RESOLUTION NO.
A RESOLUTION OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), DECLARING SEVEN (7)
PARCELS OF CITY -OWNED REAL PROPERTY LOCATED
IN THE OVERTOWN HOME OWNERSHIP ZONE, AS MORE
PARTICULARLY DESCRIBED IN "EXHIBIT All
ATTACHED HERETO AND MADE A PART HEREOF, AS
SURPLUS PROPERTY AND DESIGNATING HABITAT FOR
HUMANITY OF GREATER MIAMI, INC., A
NOT-FOR-PROFIT CORPORATION, AS DEVELOPERS FOR
THIRTEEN (13) NEW SINGLE-FAMILY HOMES,
AFFORDABLE TO VERY LOW, LOW, AND MODERATE
INCOME FAMILIES AND INDIVIDUALS; AUTHORIZING
THE CITY MANAGER TO EXECUTE A PURCHASE AND
SALE AGREEMENT, IN A FORM ACCEPTABLE TO THE
CITY ATTORNEY, TO EFFECTUATE THE SALE IN AN
EXPEDITIOUS MANNER.
WHEREAS, the City of Miami ("City") has a severe shortage of
housing within the affordability range of families and
individuals of very low, low and moderate -income; and
WHEREAS, the City recognizes that the participation of both
the public and private sector is necessary to foster the
development of housing affordable to very low, low and moderate
income families and individuals in the City; and
WHEREAS, on June 22, 1999, the City Commission adopted and
approved a Five -Year Consolidated Plan that allows the City to
make available to private sector housing developers and

not-for-profit community development corporations, at no cost,
City -owned parcels in the Home Ownership Zone for the affordable
homeownership programs; and
WHEREAS, the Overtown Home Ownership Zone is bounded by
Northwest 22nd Terrace and 20th Street to the North, the FEC
railroad tracts to the East, I-95, SR 836, the Miami River to the
West, and Northwest 5th Street to the South; and
WHEREAS, on July 24, 2000, Habitat for Humanity of Greater
Miami, Inc., a not-for-profit corporation, ("Habitat") requested
that the City donate vacant City -owned parcels in the City's
designated Overtown Home Ownership Zone; and
WHEREAS, the affordable homeownership program would allow
Habitat to pass on to the homebuyer the savings on the donated
land; and
WHEREAS, the parcels are located in the designated Overtown
Home Ownership Zone and are suitable for the development of
thirteen (13) new single family homes, affordable to very low,
low and moderate income families and individuals; and
WHEREAS, Section 29-B of the City Charter allows for the
conveyance or disposition of City -owned property for the
implementation of City -assisted housing programs or projects
which are intended to benefit persons or households of very low,
low and moderate income without being subject to competitive
bidding requirements and fair market value return to the City;
and

WHEREAS, in an effort to promote the development of new
affordable housing in the City, the Administration recommends the
conveyance of the City -owned property to Habitat for Humanity of
Greater Miami, Inc., for the development of thirteen (13) new
single-family homes on the subject City -owned parcels, subject to
certain terms and conditions;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City -owned real property located in the
Overtown Home Ownership Zone, more particularly described in
"Exhibit A" attached hereto and made a part hereof, is declared
as surplus property and the purchase and sale of same to Habitat
for Humanity of Greater Miami, Inc. ("Habitat") for the
development of thirteen (13) new single-family homes, affordable
to very low, low, and moderate income families and individuals is
authorized.
Section 3. The City Manager is authorizedll to execute a
Purchase and Sale Agreement, in a form acceptable to the City
Attorney, to effectuate the sale in an expeditious manner.
1� The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.2/

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

ENCLOSURES:
The administration recommends that the City Commission adopt the attached Resolution
declaring surplus and further approving the designation of City -owned real property located in
Overtown, as described in Exhibit "A" attached hereto and made a part hereof, to Habitat for
Humanity of Greater Miami, Inc., ("Habitat"), as developer to undertake the development of
thirteen (13) new single-family homes, affordable to very low, low and/or moderate -income
families and/or individuals. The Resolution authorizes the City Manager to execute a Purchase
and Sale Agreement ("Agreement"), and to consummate such transaction in accordance with the
terms and conditions of the Agreement, which terms may be amended by the City Manager as
may be necessary in order to effect such sale in an expeditious manner.
BACKGROUND:
The City of Miami has a severe shortage of housing within the affordability range of families and
individuals of very low, low and moderate -income. On June 22, 1999, the City Commission
adopted and approved a Five -Year Consolidated Plan that provides for the donation of city -
owned lots located in the Home Ownership Zone to developers that offer new affordable
homeownership programs. The City's Five -Year Consolidated Plan allows for the City to make
available to housing providers City -owned parcels in the City's Home Ownership Zone to be
made available to both private sector housing developers and not-for-profit community
development corporations at no. cost.
On July 24, 2000, Habitat for Humanity of Greater Miami, Inc., a not-for-profit corporation,
("Habitat") made a request to the City in connection with the donation of vacant City -owned
parcels in the City's designated Overtown Home Ownership Zone. The subject parcels are
suitable for the development of thirteen (13) new single family homes, affordable to very low,
low and/or moderate income families and/or individuals. Section 29-B of the City Charter
allows for the conveyance or disposition of City -owned property in connection with the
implementation of City -assisted housing program or projects which are intended to benefit
persons or households of very low, low and/or moderate -income without being subject to
competitive bidding requirements and fair market value return to the City.

In an effort to promote the development of new affordable housing in the City, the City
Administration recommends the conveyance of the City -owned property to Habitat for the
development of thirteen (13) new single-family homes on the subject City -owned parcels, subject
to certain terms and conditions.
Habitat has agreed to the following restrictions which will be contained in the deed of
conveyance and/or covenant:
1. The Purchaser agrees for itself and any successor in interest, that the property, for a
period of fifteen (15) years, shall only be used to provide owner occupied housing for
individuals and/or families within the economic affordability range of very low, low
and/or moderate income families and/or individuals, based on criteria established by
federal and/or state law or by the City Commission of the City of Miami. In the event
that the property is not used for the purposes herein stated, or the building ceases to
be used to provide housing for individuals and/or families within the economic
affordability range herein required, then title to the property shall automatically revert
to the City.
2. Purchaser agrees to commence promptly the construction of thirteen (13) single
family homes (the "Improvements") and shall continue diligently * with the
construction of the Improvements to completion: provided, that, in any event,
construction shall commence within twelve (12) months from the date of the
conveyance, and shall be complete no later than twenty-four (24) months from
conveyance.
3. In the event the property is declared to "immune" or "exempt" from the payment of
ad -valorem taxes, Habitat, or any successor in interest shall pay to the City an annual
payment which shall be in an amount equal to the amount the City would have
received in ad valorem taxes.
