A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), TRANSFERRING AND THEREBY ADDING AND A PORTION OF NORTHWEST 14TH STREET, NORTHWEST 42ND COURT, AND NORTHWEST 18TH STREET, TOGETHER WITH ALL PUBLIC RIGHTS- OF-WAY ADJACENT THERETO, MORE PARTICULARLY DESCRIBED IN "EXHIBITS A, B AND C" ATTACHED HERETO AND MADE A PART HEREOF, TO THE JURISDICTIONAL RESPONSIBILITY OF THE STATE OF FLORIDA HIGHWAY SYSTEM IN CONFORMANCE WITH SECTION 337.29, FLORIDA STATUTES; CONDITIONING SAID TRANSFER AND ADDITION UPON FDOT AGREEING TO ASSUME THE RESPONSIBILITY OF THE MAINTENANCE OF THE LANDSCAPING IMPROVEMENTS INSTALLED AS PART OF THE CONSTRUCTION OF THE MIAMI INTERMODAL CENTER; AUTHORIZING THE FLORIDA DEPARTMENT OF TRANSPORTATION ("FDOT") TO RECORD RIGHTS-OF-WAY MAPS OF THE SUBJECT ROADS IN THE PUBLIC RECORDS OF MIAMI-DADE COUNTY, FLORIDA; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE. WHEREAS, Northwest 14th Street, Northwest 42nd Court and Northwest 18th Street, are dedicated public rights-of-way within the City of Miami, Florida; and WHEREAS, the Florida Department of Transportation ("FDOT") is currently preparing plans for the construction of the Miami ATTACHME E'011 CONTAINED CITY C MON ME=ice _ W AIV 1.1 2001 AMM:; 01--,010 Intermodal Center ("MIC") located adjacent to the Miami International Airport and Mel Reese Golf Course; and WHEREAS, a critical component of the MIC plan includes access through Northwest 14th Street, between Northwest 34th Avenue and Northwest 42nd Court, Northwest 42nd Court between Northwest 12th Street Drive and through Northwest 14th Street, and Northwest 18th Street between Northwest 42nd Avenue and Northwest 42nd Court, Miami, Florida; and WHEREAS, FDOT wishes to include a portion of the rights-of- way of Northwest 14th Street, Northwest 42nd Court, and Northwest 18th Street, Miami, Florida, in the State Highway System to accommodate the proposed roadway and access improvements required for the construction of the MIC; and WHEREAS, as a condition of the said rights-of-way transfer and addition to the State Highway System, FDOT agrees to assume responsibility for the maintenance of the landscaping improvements installed as part of the construction of MIC; and WHEREAS, in conformance with Section 337.29, Florida Statutes, rights-of-way maps of the subject roads, more particularly described in 'Exhibits A, B and C" attached hereto and made a part hereof, have been prepared and will be duly recorded in the Public Records of Miami -Dade County, Florida, by the FDOT; 41- 410 Page 2 of 4 NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A portion of Northwest 14th Street, Northwest 42nd Court, and Northwest 18th Street, together with all public rights-of-way adjacent thereto, more particularly described in "Exhibits A, B and C" attached hereto and made a part hereof, are transferred and thereby added to the jurisdictional responsibility of the State of Florida Highway System in conformance with Section 337.29, Florida Statutes. Section 3. As a condition of said transfer and addition, FDOT agrees to assume the responsibility of the maintenance of the landscaping improvements installed as part of the construction of the Miami Intermodal Center. Section 4. The Florida Department of Transportation ("FDOT") is authorized to record rights-of-way maps of the subject roads in the Public Records of Miami -Dade County, Florida. BACKGROUND The Florida Department of Transportation (FDOT) is currently preparing plans for the construction of the Miami Intermodal Center (MIC) located adjacent to Miami International Airport and the City's Mel Reese Golf Course. A critical component of this plan includes access through N.W. 14 Street from N.W. 34 Avenue to N.W. 42 Court, N.W. 42 Court from N.W. 12 Street Drive to N.W. 14 Street and N.W. 18 Street from N.W. 42 Avenue to N.W. 42 Court. FDOT is formally requesting the transfer of the jurisdiction of these existing City of Miami roadways to the State to accommodate the design and construction of the MIC. In order for FDOT to complete its MIC plans, it is necessary that N.W. 14 Street between N.W. 34 Avenue and N.W. 42 Court, N.W. 42 Court from N.W. 12 Street Drive to N.W. 14 Street and N.W. 18 Street between N.W. 42 Avenue and N.W. 42 Court be transferred to the jurisdiction of the State Highway System so that the FDOT may assume reconstruction and maintenance responsibility of the mentioned right of ways. The FDOT has prepared the necessary right of way map for the subject area to be transferred and will be responsible for all costs to construct the MIC improvements. This resolution permits the proper recording of the required right- of-way map to effect the transfer of jurisdiction. It is respectfully recommended that as a condition of the transfer of these right -of ways, that the FDOT assume maintenance responsibility for all landscaping installed in this project.
