RESOLUTION NO. 01— 008
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE FUNDING OF THE DOMINICAN -
AMERICAN NATIONAL FOUNDATION, INC., IN AN
AMOUNT NOT TO EXCEED $35,000, ALLOCATING
FUNDS FROM THE LAW ENFORCEMENT TRUST FUND,
PROJECT NO. 690001, SUCH EXPENDITURE HAVING
BEEN APPROVED BY THE CHIEF OF POLICE AS
COMPLYING WITH SECTION 932.7055, FLORIDA
STATUTES (1999) .
WHEREAS, Section 932.7055, Florida Statutes (1999),
authorizes the expenditure of forfeited cash or proceeds for
certain law enforcement purposes not considered normal operating
expenses; and
WHEREAS, the Police Department is committed to the education
and development of the youth of the community; and
WHEREAS, Dominican -American National Foundation, Inc., (the
"Foundation") offers a crime prevention and intervention program
for at -risk youth of the Allapattah, Model City and Wynwood areas
by offering computer skills training, monthly workshops on
substance abuse, conflict resolution, tutoring and counseling
services, and a baseball program; and

WHEREAS, funding by the City will assist the Foundation with
expenses relating to its crime prevention and intervention
program; and
WHEREAS, funds for this expenditure have not been included
in the Police Department's normal operating budget and are
available in the City of Miami Law Enforcement Trust Fund; and
WHEREAS, pursuant to the provisions of Section 932.7055(c),
Florida Statutes (1999), the recipient, the Foundation, shall (1)
certify that the funds appropriated will be used lawfully and for
the purpose stated, (2) be required to maintain proper accounting
records for the expenditure of such monies, and (3) provide any
reports, including, but not limited to, audit reports, as may be
required by the City of Miami or applicable law; and
WHEREAS, the Chief of Police has recommended adoption of
this Resolution and has determined that the expenditure proposed
complies with Section 932.7055, Florida Statutes (1999);
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Funding for the Dominican -American National
Foundation, Inc., in an amount not to exceed $35,000, is
authorized, with funds allocated from the Law Enforcement Trust
Fund, Project No. 690001, such expenditure having been approved

by the Chief of Police as complying with Section 932.7055,
Florida Statutes (1999).
Section 3. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.11

11 If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.

ENCLOSURES:
It is respectfully recommended that the City Commission adopt the attached Resolution
authorizing the funding of the Dominican -American National Foundation, Inc., and allocating
funds therefor, in an amount not to exceed $35,000. Funding is available from the Law
Enforcement Trust Fund, Florida State Statute Chapter 932.7055, Florida Project Number 690001.
BACKGROUND
The Dominican -American National Foundation, Inc., offers a "Crime Prevention and Intervention
Program," in the Allapattah, Model City, and Wynwood areas serving at -risk youths. This
program has received $25,000 in funding from the Miami -Dade County Crime Task Force.
Youths are referred to program by the YMCA, Miami Jackson Senior High School and Allapattah
Middle School. The requested funds will be used to expand the program to serve additional
youths and offer computer skills training, monthly workshops on substance abuse, conflict
resolution and crime prevention. In addition, tutoring and counseling services and a baseball sports
program will be available to area youths. The baseball program will target up to forty-five (45)
youths, between the ages of 7 thru 17 years.

The Police Department has reviewed your request for financial support, from the Law
Enforcement Trust Fund (L.E.T.F.), for the Dominican -American National Foundation, Inc.
In response to the aforementioned request, please be advised that I have authorized a
contribution in the amount of $35,000. Legislation, however, must be submitted to the City
Commission for final approval. This funding recommendation is tentatively scheduled for
approval at the January 111x, 2001, City Commission Meeting. Once, this has been
accomplished, the Police Department will inform you as to the procedure for disbursement
of funds.
