HomeMy WebLinkAboutO-12168J-01-1018 11/28/01 ORDINANCE NO. 12168 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED "'CHILD DAY CARE FOOD PROGRAM" AND APPROPRIATING AND AUTHORIZING THE EXPENDITURE OF FUNDS FOR THE OPERATION OF SAME IN THE ESTIMATED AMOUNT OF $100,135 CONSISTING OF A GRANT FROM THE FLORIDA DEPARTMENT OF EDUCATION; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. _11,14V WHEREAS, the Department of Parks and Recreation Day Care Division of the City of Miami sponsors a year-round Food Service Program for preschool age children which provides nutritional meals as a part of its child day care services programs; and WHEREAS, the Florida Department of Education, Bureau of Child Nutrition Program, with funding from the U.S. Department of Agriculture ("USDA") grants funds to conduct a food service program from October 1, 2001 through September 30, 2002 for children up to the age of 18; and WHEREAS, the grant from the Florida Department of Education for implementation of the program for Fiscal Year 2002 is estimated to be $100,135 based on year 2001 figures and reimbursement rates of $1.013 for breakfast, $1.86 for lunch and $.48 for afternoon supplement; and WHEREAS, an estimated 32,075 lunches and 33,688 supplements will be served during the project period starting October 1, 2001 and ending September 30, 2002; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby adopted by reference and included as if fully set forth in this Section. Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: Page 2 of 5 12168 FUND TITLE: Child Day Care Food Program RESOURCES: Florida Department of Education (as funded by the U.S. Department of Agriculture) $100,135 APPROPRIATIONS: $100,135 Section 3. This appropriation is contingent upon the approval by the Florida Department of Education of the City's application for the grant and the City Manager's acceptance thereof. Section 4. The City Manager is authorized!' to accept the grant from the Florida Department of Education, Bureau of Child Nutrition Program, and to execute all the necessary documents, in a form acceptable to the City Attorney, for acceptance of said grant. Section 5. The expenditure of the grant funds is authorized for the operation of the Program. Section 6. The herein authorization shall remain valid and outstanding even if the anticipated grant award is reduced or increased. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Page 3 of 5 12 161 8 Section 7. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are hereby repealed. Section 8. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 9. This Ordinance is hereby declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 10. The requirements of reading this Ordinance on two separate days is hereby dispensed with an affirmative vote of not less that four-fifths of the members of the Commission. Page 5 of 5 12108-- CITY OF MIAMI, FLORIDA INTER -OFFICE MEMORANDUM TO: Honorable Mayor and Members DATE: NOV 2 7 2MI FILE: of the City Commission SUBJECT: Emergency Ordinance for The Child Day Care Food Service Program for 10/1/01 FROM: REFERENCES: through 9/30/2002 imenez City Mana r ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached emergency ordinance to create a new Special Revenue Fund and to appropriate grant funds in the estimated amount of $100,135 to be received from the State of Florida Department of Health, Bureau of Child Nutrition Programs Day Care Division to conduct a food service program for youth aged 18 and under from October 1, 2001 through September 20, 2002. BACKGROUND: Each year since 1976, the Department of Parks and Recreation has sponsored a Child Nutrition Program for preschool children. Under this program, the City provides nutritional meals in conjunction with its child program featuring arts and crafts, field trips and special events. This year, we plan to serve up to 180 breakfasts, 180 lunches and 180 p.m. supplements per day using no less than five (5) sites throughout the City. Based on 2000 program totals, we estimate that 33,875 lunches and 33,688 snacks will be served during the ensuing year. These figures average out to 18,675 breakfasts and 38,875 lunches and p.m. supplements per day for the 261 day program. Funding is provided to the City from a grant through the State of Florida Department Of Health Bureau of Child Nutrition program. This year's grant is estimated at $100,135 based on last years meal figures and reimbursement rates of $1.013 for breakfast, $1.86 for lunch and $.48 for p.m. supplements, and a.m. supplement of $.37.GJhis grant does not require matching funds. ,74 q�� � jar CAG/ KR/AR/s 12165 Renewal instructions Prior to the expiration of the original contract, the institution and caterer will need to complete the reverse side of this form if both parties mutually agree to extend the terms and conditions of the original contract for an additional year. Re -negotiation of price shall be the only change (increases or decreases) allowed. Any price increases shall not exceed the Consumer Price index as determined by the Florida Department of Health, Bureau of Child Nutrition Programs. The Institution must indicate the Renewal Year and anticipated period to be covered by the Renewal Contract and complete Columns 2 and 5 or a new Price Schedule (see Attachment 7, page 22 of the Invitation to Bid) before submitting to Caterer. The Institution must not execute (sign) the Renewal contract prior to submitting to Caterer. If needed, the Institution shall submit to the caterer a new Delivery Schedule. If the Caterer agrees to renew, the Caterer must complete columns 3 and 5 or a new Price Schedule (if a new Price Schedule is completed, the Caterer must sign before submitting to the institution.) The Caterer must execute the Renewal Contract and submit to the Institution prior to the expiration of the original contract. If the Institution agrees to renew, the Institution must execute the Renewal Contract. The original signed renewal contract shall be attached to the original Invitation to Bid contract. Each of the following parties shall retain one copy of the renewal contract: the institution; the Caterer, and the Bureau of Child Nutrition Programs. Special Note: Original contracts may only be renewed for two (2) additional one (1) year periods.
