ORDINANCE NO. 12 167
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 12128, AS AMENDED, THE
ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENTS
PROJECTS ORDINANCE, TO INCREASE APPROPRIATIONS
FOR CAPITAL IMPROVEMENTS PROJECT NO. 331312,
ENTITLED "LEGION PARK IMPROVEMENTS" IN THE
AMOUNT OF $90,000 RECEIVED AS A RESULT OF A
GRANT AWARD FROM THE FLORIDA INLAND NAVIGATION
DISTRICT (FIND), IN THE AMOUNT OF $90,000, FOR
THE IMPLEMENTATION OF SHORELINE STABILIZATION;
AUTHORIZING THE CITY MANAGER TO ACCEPT SAID
GRANT AND EXECUTE THE NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, shoreline stabilization at Legion Park (the "Park")
will allow for the presentation and the continuation of active
and passive use of the Park; and
WHEREAS, the City has been awarded a grant in the amount of
$90,000 from the Florida Inland Navigation District (FIND); and
WHEREAS, the City was also awarded a $90,000 grant match
from the Safe Neighborhood Park Bond Funds for Waterfront
Enhancement at the Park; and
WHEREAS, the City Commission adopted Ordinance No. 12128,
the Annual Appropriations and Capital Improvements Projects
Ordinance, on September 25, 2001, establishing revenues and
appropriations for the City of Miami, Florida, for fiscal year
ending September 30, 2002;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 12128, as amended, adopted
September 25, 2001, the Annual Appropriations and Capital
Improvements Projects Ordinance for Fiscal Year ending September
30, 2002, is further amended in the following particulars: 1/

Section 7. Section 6 of Ordinance No. 11705, as amended, adopted
September 28, 1998, Section 5 of Ordinance No. 11839, as amended, adopted
September 28, 1999, and Section 7 of Ordinance No. 11970, as amended,
adopted September 28, 2000, are further amended in the following
particulars to revise previously approved Projects and establish new
Projects to be initiated during Fiscal Year 2001-2002: (Footnote
omitted.)

Section 3. The City Manager is authorized�lto accept the
grant award from the FIND in the amount of $90,000 for the
implementation of shoreline stabilization and waterfront
enhancement at Legion Park and execute the necessary documents,
in a form acceptable to the City Attorney.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
zi The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.'

by the Mayor within ten days from the date it was passed and adopted. If
the Mayor vetoes this Ordinance, it shall become effective immediately
upon override of the veto by the City Commission or upon the effective

Ordinance Accepting
a Grant from Florida
Inland Navigation
District
It is respectfully recommended that the City Commission adopt
the attached Ordinance authorizing the City Manager to accept a
grant award from the Florida Inland Navigation District (FIND)
in the amount of $90,000 for the implementation of shoreline
stabilization and other waterfront enhancements at Legion Park.
BACKGROUND:
The City of Miami Department of Parks and Recreation applied for
a grant from the Florida Inland Navigation District in the
amount of $90,000 for waterfront enhancement to Legion Park.
The City already has $90,000 allocated from the Safe
Neighborhood Parks Bond program for shoreline stabilization at
Legion Park. The total project cost is $180,000. The grant
award from FIND will assist in providing the design, project
administration, shoreline stabilization, grading, sand fill and
removal of invasive exotic vegetation. Approval of the attached
Ordi��n�e accepts the award for said purposes.
