HomeMy WebLinkAboutO-12160J-01-871 10/16/01 ORDINANCE NO. 12160 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI FLORIDA, BY AMENDING PAGE NO. 27 OF THE ZONING ATLAS BY CHANGING THE ZONING CLASSIFICATION FROM C-2 "LIBERAL COMMERCIAL" TO C-1 '.'RESTRICTED COMMERCIAL" FOR THE PROPERTY LOCATED AT APPROXIMATELY 4041 NW 7TH STREET, MIAMI, FLORIDA; MAKING FINDINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning Advisory Board, at its meeting of September 12, 2001, Item No. 3, following an advertised hearing, adopted Resolution No. PAB-72-01, by an eight to zero vote (8-0), RECOMMENDING APPROVAL of a change of zoning designation, as hereinafter set forth; and WHEREAS, the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, Page 12, Article 4, Section 401, Schedule of District Regulations, is hereby amended by changing the zoning classification from C-2 "LIBERAL COMMERCIAL" to C-1 "RESTRICTED COMMERCIAL" for the property located at approximately 4041 NW 7 t Street, Miami, Florida; more particularly described as Lots 11 & 12 of Block 4, WHITEHEAD & BLAIR SUB Plat Book 44-78 of the Public Records of Miami -Dade County Florida. Section 2. It is found that the proposed change is consistent with the intent of the area and will not impose an adverse impact on the adjacent community. It is also found that the zoning change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; Page 2 of 4 12160 (b) is consistent with the "La Rosa Restaurant" Cuban Cuisine located on the premises; (c) to C-1 "Restricted Commercial" is consistent with the use of the adjacent properties; (d) will provide consistency between the Zoning Atlas of Zoning Ordinance 11000 and the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000. Section 3. Page No. 27 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, is hereby amended to reflect the changes made necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section G. This Ordinance shall become effective simultaneously with its companion Comprehensive Plan amendment (Ordinance No. 11000), which takes effect thirty-one (3 1) days Page 3 of 4 12160 after final reading and adoption thereof pursuant to Section §163.3187(3)(c), Fla. The following findings have been made: • It is found that the subject property is located immediately adjacent to additional commercially zoned properties. • It is found that the subject property has a restaurant "LaRosa Restaurant Cuban Cuisine" located on the premises. • It is found that the recommendation of (C-1) "Restricted Commercial" is consistent with the use of the aforementioned property. • It is found that the recommendation with provide consistency between the Zoning Atlas of Zoning Ordinance 11000 and the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000.
