ORDINANCE NO. 1215 "
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED: "'HISTORIC PRESERVATION" AND
APPROPRIATING FUNDS IN THE AMOUNT OF
$250,000, CONSISTING OF A GRANT FROM THE
FLORIDA DIVISION OF HISTORICAL RESOURCES IN
THE AMOUNT OF $25,000 AND FUNDS IN THE AMOUNT
OF $225,000 FROM THE BUDGET OF THE CITY OF
MIAMI DEPARTMENT OF COMMUNITY DEVELOPMENT;
AUTHORIZING THE CITY MANAGER TO ACCEPT THE
GRANT FROM THE FLORIDA DIVISION OF HISTORICAL
RESOURCES AND TO EXECUTE ALL NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; AND AUTHORIZING THE EXPENDITURE OF
SAID FUNDS FOR HISTORIC PRESERVATION PURPOSES
IN THE CITY OF MIAMI; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The following Special Revenue Fund is
established and resources are appropriated as described herein:
FUND TITLE: HISTORIC PRESERVATION
RESOURCES: Florida Division of
Historic Resources $ 25,000
City of Miami Department
of Community Development $225,000
APPROPRIATIONS: $250,000
Section 2. The City Manager is authorized!' to accept
the grant from the Florida Division of Historical Resources and
to execute all necessary documents, in a form acceptable to the
City Attorney, for the acceptance of said grant.
Section 3. The expenditures of said funds is authorized
for historic preservation purposes in the City of Miami.
Section 4. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and supplies
and to generally carry on the functions and duties of municipal
affairs.
ii The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 7. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.Z'

If the Mayor does not sign this Ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached Ordinance
accepting a grant from the Florida Division of Historical Resources, establishing a new
special revenue fund entitled "Historic Preservation", and appropriating funds for said
project in the amount of $25,000, consisting of $25,000 from the Florida Division of
Historical Resources and $225,000 from the City of Miami Department of Community
Development.
BACKGROUND:
On April 19, 2001 the Florida Division of Historical Resources awarded a grant of
$25,000 to the City of Miami Planning & Zoning Department to aid in the development
of an historic resources survey of portions of Little Haiti and Model City. On July 10,
2001 the City Commission allocated $225,000 in Community Development Block Grant
(CDBG) funds to the City of Miami Planning & Zoning Department, including $25,000
to match the State grant and $200,000 for additional historic preservation purposes.
Adoption of this Ordinance will appropriate these awards. Work on the State -funded
historic resources survey then will proceed according to the work plan outlined in the
grant application; use of the remaining funding will proceed according to a work plan
now being prepared by the Planning & Zoning Department.

WITH THE "FLORIDA BUILDING CODE" AND CHAPTER 8 OF
THE CODE OF ORDINANCES OF MIAMI-DADE COUNTY,
FLORIDA ("CHAPTER 8 OF THE COUNTY CODE"); HAVING
ALL REFERENCES TO THE S.F.B.C. REFERRED TO AS THE

All interested persons may appear at the meeting and may be heard
with respect to the proposed ordinances. Should any person desire to ap-
peal any decision of the City Commission with respect to any matter to be
considered at this meeting, that person shall ensure that a verbatim
record of the proceedings is made including all testimony and evidence
upon which any appeal may be based.
