HomeMy WebLinkAboutO-12146J-01-746 9/14/01 ORDINANCE NO. 12146 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE V/SECTION 54-190 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/BASE BUILDING LINES/NONSTANDARD STREET WIDTHS, TO REDUCE THE STREET AT FEDERAL HIGHWAY, BETWEEN I-195 AIRPORT EXPRESSWAY AND NORTHEAST 39TH STREET, FROM 70 TO 50 FEET; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR INCLUSION IN THE CITY CODE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 54/Article V/Section 54-190 of the Code of the City of Miami, Florida, as amended, entitled "Streets and Sidewalks/Base Building Lines/Nonstandard Street Widths" is amended in the following particulars:'/ 1� Words and/or figures stricken through shall be deleted. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Gimenez City Manager RECOMMENDATION DATE: 12 FILE SUBJECT: Amendment to City Code First Reading of Ordinance REFERENCES: Amending Code Section 54-190 ENCLOSURES: Location May It is respectfully recommended that the City Commission adopt the attached Ordinance amending Chapter 54 of the Code of the City of Miami entitled "Streets and Sidewalks" by amending Section 54-190 entitled "Nonstandard Street Widths". BACKGROUND The owners of commercial property in Miami's Design District located along Federal Highway are currently contemplating developing new commercial buildings on the east side of Federal Highway. Since the zoned right of way width of Federal Highway reserved for future widening is wider than the currently developed roadway width, the owners are prevented from developing the property to full capacity. The owners have requested that the City consider the reduction of the zoned width of Federal Highway between the Airport Expressway (I-195) and NE 39 Street. This request prompted the Public Works Department to undertake a complete review to assess the necessity for continuing the protection of the additional zoned street width for the Federal Highway corridor between the Airport Expressway (I-195) and NE 39 Street, with the following results and recommendations. The original platted subdivisions that created Federal Highway within the described limits dedicated a right of way width of approximately 50 feet. The road was subsequently developed with pavement, curb and gutter and sidewalk conforming to the 50 foot wide right of way and many of the improvements on private property were constructed abutting the 50 foot wide roadway. Federa]Hwy-Amend-Sec.54-190-ORD-MEMO 12146 The Honorable Mayor and Members of the City Commission Page No. 2 Amendment to City Code — First Reading of Ordinance Amending Code Section 54-190 Subsequent to the creation of Federal Highway and development of the roadway improvements, the City of Miami Commission, by Ordinance, established a zoned base building line width of 70 feet for this roadway thereby reserving additional property in anticipation of future roadway widening. None of the additional reserved right of way has been developed for street purposes for vehicular or pedestrian traffic. The Public Works Department's review of this transportation corridor reveals that a 50 foot wide roadway will adequately serve the transportation needs of the public and the business district. The existing and future planned development within the district is consistent with the City's Zoning Ordinance and Comprehensive Plan and the protection of the additional property is no longer necessary for this transportation facility. The reduction of the zoned street width will not be detrimental to the public welfare or injurious to the other property in the vicinity. The requested reduction in zoned width will not burden City services and there will be no physical impact or change to the current street improvements. It is respectfully recommended to the City of Miami Commission that the zoned base building line width of Federal Highway between the Airport Expressway (1-195) and NE 39 Street be reduced from 70 feet wide to 50 feet wide right of way width to confirm with future regulated development and permit the adjacent landowners to enjoy full use of their property to enhance the commercial district.
