AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AUTHORIZING THE TRANSFER OF $100,000
OF HOME INVESTMENT PARTNERSHIPS PROGRAM (HOME)
FUNDS PREVIOUSLY COMMITTED TO THE MODEL CITY
HOMEOWNERSHIP ZONE PROJECT TO THE MIAMI RIVER
BROWNSFIELD PROJECT FUND; AMENDING ORDINANCE
NO. 12095, ADOPTED JULY 26, 2001, BY INCREASING
APPROPRIATIONS TO SAID FUND, FROM $296,000 TO
$396,000, TO PROVIDE FOR THE CITY OF MIAMI
DEPARTMENT OF REAL ESTATE AND ECONOMIC
DEVELOPMENT'S (REED) PROCUREMENT OF SERVICES
FOR REQUIRED ENVIRONMENTAL SITE AND BROWNSFIELD
ASSESSMENTS IN THE MODEL CITY HOMEOWNERSHIP
ZONE PROJECT AREA; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ANY NECESSARY DOCUMENTS, IN
A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
SAID PURPOSE; CONTAINING A REPEALER PROVISION
AND SEVERABILITY CLAUSE.
WHEREAS, at its meeting of February 15, 2001, the City
Commission adopted Resolution No. 01-160 which authorized and
directed the City Manager to move forward with certain
predevelopment and project related activities, including land
acquisition and relocation activities, analysis of infrastructure
needs, and site and environmental needs and issues impacting the
Model City Homeownership Zone Project Area; and
WHEREAS, the City of Miami Department of Real Estate and
Economic Development has a contract with the firm of Evans

Environmental and Geosciences for the purpose of performing
certain environmental site assessments and studies relative to
contaminated properties and Brownsfield sites; and
WHEREAS, recently the Department of Community Development
was required to secure the services of Evans Environmental and
Geosciences to perform a preliminary Phase I Environmental Site
Assessment and Inventory Findings for various Brownsfield sites
located in the Model City neighborhood bounded by Northwest 54th
to 62nd Streets, between Northwest 12th and 17th Avenues, and
Northwest 58th Street to State Route 112, between Northwest 17th
and 19th Avenues, for preparation of an application for funding
through the Brownsfield Economic Development Initiative Program
and the Economic Development Initiative Program from the U.S.
Department of Housing and Urban Development; and
WHEREAS, it has been determined that additional
environmental assessments and analyses will be required for
implementation in the Model City Homeownership Zone Project; and
WHEREAS, it is recommended that $100,000 in HOME Program
funds previously committed by Resolution No. 01-160 for the Model
City Home Ownership Zone Project be transferred to the Miami
River Brownsfield Project Fund;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The transfer of $100,000 of HOME Investment
Partnerships Program (HOME) funds previously committed to the
Model City Homeownership Zone Project to trie Miami xiver
Brownsfield Project Fund is authorized to provide for the City of
Miami Department of Real Estate and Economic Development's (REED)
procurement of services required for environmental site and
Brownsfield assessments required in the Model City Homeownership
Zone Project area.
Section 3. Ordinance No. 12095, adopted July 26, 2001,
is amended in the following particulars:ll

Section 4. The City Manager is authorized' to execute
any necessary documents, in a form acceptable to the City
Attorney, for said purpose.
Section 5. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and

supplies, and to generally carry on the functions and duties of
municipal affairs.
Section 8. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less that four-fifths of the members of the Commission.
Section 9. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.3

RECOMMENDATION•
It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance transferring $100,000 of HOME Investment Partnership (HOME) Program funds
previously committed to the Model City Homeownership Zone Project to the Department of Real
Estate and Economic Development for the purpose of securing environmental analyses and
studies of contaminated real properties in support of the aforementioned project.
The attached Ordinance further authorizes the City Manager to enter into an agreement, if
necessary in a form acceptable to the City Attorney for disbursement of the aforementioned funds
for said purpose.
BACKGROUND:
At its meeting of February 15, 2001, the City Commission approved and adopted Resolution No.
01-160, authorizing and directing the City Manager to move forward with predevelopment and
project related activities associated with the implementation of the Model City Homeownership
Zone Project. The predevelopment and project related activities included land acquisition and
relocation activities, analysis of all infrastructure needs, site and environmental needs, and issues
impacting the project area.
In order to prepare and complete two (2) applications for funding available from U.S. HUD
through the Brownsfield Economic Development Initiative and Economic Development Initiative
Programs, it was necessary for the Department of Community Development to utilize the
services of Evans Environmental and Geosciences, a firm presently under contract with the
Department of Real Estate and Economic Development to perform such environmental
assessments and inventory and various contaminated properties and potential Brownsfield sites in
the project area.

It has been determined by the Department of Community Development that additional
environmental assessments and analyses of real properties in the Model City Homeownership
Zone Project Area will be required to move the project forward.
In an effort to meet this need and reimburse REED for expenses already incurred in performing
the environmental study, the attached Emergency Ordinance transfers $100,000 in HOME
Program funds previously awarded to support the Model City Homeownership Project to the
Department of Real Estate and Economic Development for the purpose of securing necessary
environmental assessments and studies of various contaminated properties relating to the Project.
Funding for these required services is available pursuant to Resolution No. 01-160, adopted by
the City Commission at its meeting of February 15, 2001.
City Commission approval of the attached Emergency Ordinance is recommended.

AND CITY ATTORNEY TO EXPEDITIOUSLY MOVE
FORWARD WITH CERTAIN PREDEVELOPMENT AND
PROJECT RRLATED ACTIVITIES, INCLUDING, BUT
NOT LIMITED TO, LAND ACQUISITION,
RELOCATION ACTIVITIES, SECURING OUTSIDE
PROFESSIONAL SERVICES TO PERFORM ANY
LEGAL, ARCHITECTURAL, INFRASTRUCTURE,
ENVIRONMENTAL/SITE ASSESSMENT AND ANY
OTHER SERVICES NECESSARY TO FACILITATE
REVITALIZATION IN THE MODEL CITY
HOMEOWNERSHIP ZONE; FURTHER AUTHORIZING
THE ALLOCATION OF FUNDS, IN THE AMOUNT OF

WHEREAS, at ,its meeting of July 21, 1998, the
Administration recommended that the City Commission allocate
$1,500,000 in HOME Investment Partnership ("HOME") Program funds
annually for a five (5) year period for implementation of a
Homeownership Program in the Model City neighborhood bounded by
Northwest 62nd and 54ch Streets between Northwest 12tb and 17th
Avenues, Miami, Florida; and
WHEREAS, with the adoption of Resolution No. 98-800, the
City Commission authorized and directed the City Manager to

allocate the City's first year financial commitment in the
amount of $1,500,000 for the development of affordable housing
units in the Model City neighborhood; and
WHEREAS, with the adoption of Resolution No. 99-429, the
City Commission approved and adopted the City's Five Year
Consolidated Plan (1999-2004), which outlined 'the City's various
housing and community revitalization strategies and the proposed
use of funds received from the U.S. Department of Housing and
Urban Development ("HUD"); and
WHEREAS, with the adoption of the City's Five Year
Consolidated Plan, the City Commission approved the
establishment of seven (7) homeownership zones throughout the
City with the City's initial homeownership development efforts
to begin in the Model City neighborhood; and
WHEREAS, an May 11, 2000, the City Commission adopted
Resolution No. 00-416, allocating an additional $3,000,000 in
HOME Program funds to fund the City's second and third year
baseline five (5) year financial commitment for the development
of new affordable homeownership units in the Model City
Homeownersh p.Zone; and

WHEREAS, the Administration has recommended that the City
Commission allocate the funding as follows: (a) $3,000,000 in
HOME Program funds to fund the City's fourth and fifth year
baseline five (5) year financial commitment to the Model City
Homeownership Zone, (b) $6,000,000 in unexpended and prior year
Section 8 Moderate Rehabilitation Program funds, (c) $4,134,364
in HOME and Community Development Block Grant funds available as
a result of the repayment to HUD in connection with the
Northwestern Estates Housing Project, (d) $1,000,000 from Fannie
Mae Foundation, and (e) $3,000,000 from Miami -Dade County; and
WHEREAS, in an effort to expedite and facilitate
revitalization activities in the Model City Homeownership Zone,
it is recommended that the City Commission authorize and direct
the City Manager and City Attorney to move forward with certain
predevelopment and project related activities to include land
acquisition and relocation activities, conduct an analysis of
all legal, site assessment and infrastructure needs and
environmental issues impacting the Model City Homeownership
Zone; and
WHEREAS, project related funding in the amount of
$21,634,364 is available to assist in defraying the cost of

facilitating the predevelopment and project related activities
for the Model City Homeownership Zone;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1, The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager and the City Attorney are
authorized and directed to expeditiously move forward with
certain predevelopment and project related activities, including
but not limited to, land acquisition, relocation activities, and
securing outside professional services to perform any legal,
architectural, infrastructure, environmental/site assessment and
any other services necessary to facilitate revitalization in the
Model City Homeownership Zone.
Section 3. The allocation of funds, in the amount of
$21,634,364, is authorized for the purposes set forth in
Section 2 as follows:
