HomeMy WebLinkAboutO-12133J-01-706 9/26/01 ORDINANCE NO. 12133 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING ORDINANCE NO. 11167, AS AMENDED, ADOPTED JULY 14TH, 1994, WHICH ESTABLISHED INITIAL RESOURCES AND INITIAL APPROPRIATIONS FOR A SPECIAL REVENUE FUND ENTITLED "OPERATION C.A.R.S.," TO INCREASE APPROPRIATIONS TO THE FUND, IN THE AMOUNT OF $40,764, CONSISTING OF A GRANT FROM THE STATE OF FLORIDA MOTOR VEHICLE THEFT PREVENTION AUTHORITY; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AND TO EXECUTE THE NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR SAID PURPOSE AND TO EXPEND MONIES FROM THE FUND NECESSARY TO CONTINUE "OPERATION C.A.R.S"; CONTAINING A REPEALER PROVISION AND SEVERABILITY CLAUSE. WHEREAS, the Department of Police has received a grant from the State of Florida Motor Vehicle Theft Prevention Authority ("MVTPA") for training officers and the community in auto theft awareness; and WHEREAS, the MVTPA has approved an additional award, in the amount of $40,764, for the purchase of equipment, training, and other operational activities related to "Operation C.A.R.S.,"(Comprehensive Auto Recovery Strike force) with no matching funds required of the City of Miami; and 12133 WHEREAS, the additional funds are for the period of October 1, 2001, through September 30, 2002; and WHEREAS, any expenditure of funds on purchases shall comply with applicable City Code purchasing requirements; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Section 2 of Ordinance No. 11167, as amended, adopted July 14th, 1994, is amended in the following particulars:l/ "ORDINANCE NO. 11167 Section 2. The following Special Revenue Fund is hereby established and resources are hereby appropriated as described herein: FUND TITLE: OPERATION C.A.R.S. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 6. This Ordinance shall become effective immediately upon adoption and signature of the Mayor.!' Grant City Manna ENCLOSURES: RECOMMENDATION It is respectfully recommended that the City Commission adopt the attached Ordinance, amending Ordinance No. 11167, adopted on July 14, 1994, which established initial resources and initial appropriations for a Special Revenue Fund entitled: "Operation C.A.R.S.," accepting an additional grant from the Florida Motor Vehicle Theft Prevention Authority, in the amount of $40,764.00 and appropriating said funds for the operation of same. BACKGROUND The Miami Police Department is continuing its efforts toward combating the lucrative crime of auto theft. The program labeled "Operation C.A.R.S." (Comprehensive Auto Recovery Strikeforce) will focus on the arrest and conviction of persons engaged in thefts, and alteration of vehicles and parts. Training will also be provided to better educate our patrol officers on basic auto theft investigation. Community presentations marketed under the name "PACT ATTACK" (Police and Community Together Against Auto Theft Through Awareness, Cooperation and Knowledge),. and Auto Theft Fairs will be conducted to educate citizens concerning the importance of layering auto theft protection, i.e. VIN etching, steering wheel inhibitors, alarms and tracking systems. The Florida Motor Vehicle Theft Prevention Authority has committed an additional $40,764.00 toward accomplishing these tasks. Funding is for the period of October 1, 2001 through September 30, 2002. The Miami Police Department intends to address a concern of great Importance in our geographical area, that of education. Auto theft prevention education assists our police officers with how to better Investigate auto theft on the street level, which should have an Impact on the number of vehicles stolen within our city. We project an increase In the number of auto theft arrests by a minimum of 5% while decreasing the number of auto thefts by 5°%. The training was designed by our Auto Theft Detail and the first "Basic Auto Theft Investigation" class was held in March of 2000. The class was for swom officers who work in radio patrol and it was a two day, 20 hour course. The course Included Instructors from the Miami Police Department, Miami -Dade Police Department, Division of Highway Safety and Motor Vehicles, the National Insurance Crime Bureau and LoJack. During the course the officers were taken into the field to tow yards and auto pounds. There they were instructed on how to locate VINs, recreate obliterated VIN's and actually received hands on training in same. The course was so well received that we have expanded the training into two (2) twenty hour blocks. The course will continue through the 2001 to 2002 Grant extension. The presentations to the community groups will be multimedia to include video tape, Power Point presentations, demonstrations and handouts. The community programs are being marketed under the name, "PACT ATTACK", Police and Community Together Against Auto Theft Through Awareness, Cooperation and Knowledge. These programs are presented In English, Spanish and Creole. They will be facilitated by the auto theft detective who teaches the "Basic Auto Theft Investigation" courses. The primary objective of the training Is to educate the citizens about the importance of layering auto theft protection. It is widely believed that the best way to avoid becoming a victim of auto theft is to layer your protection i.e. VIN etching, steering wheel Inhibitors, alarms and tracking devices. The training will also demonstrate several items connected t auto theft protection such as Lo -Jack, tracking systems and disabling devices to name a few. In an effort to measure the success of our program the attendants will be asked to complete a survey concerning auto theft prevention prior to the presentation. Our goal is to educate 2,000 people at the community presentations and auto theft fairs. This will require $1,400.00 for postage and $700.00 for 2,000 survey at .35 each. In the weeks following the presentation, a second survey will be mailed to the participant and asked to complete it and return It to the Miami Police Department, in a provided self-addressed stamped envelope. The data from the list survey will be compared with the second survey and comparisons made on our success in educating the public. The Auto Theft Detail has already conducted several of the community presentations and the reception has been very positive. All the materials utilized in the presentation will display the F.M.V.T.P.A. as a sponsor. Fifty auto theft prevention devices will be given away at each presentation. The Auto Theft Detail will also conduct a minimum of 4 Auto Theft Fairs. These fairs will offer free V.I.N. etching, information on auto theft prevention and the Importance of layering protection. There will be a display of information video tapes, brochures and the give away of auto theft prevention devices. The V.I.N. etching material is currently in our inventory from our previous grant. Local distributors of theft prevention devices and insurance companies will also be invited to participate. One hundred theft prevention devices will be given away at each fair. As a result of the financial hardship being experienced the City of Miami, the request is being made that a portion of the employees' salaries be paid by the grant. Only the percentage of time that the employee actually spends accomplishing the goals of the grant are being calculated for reimbursement. The exact breakdown for each employee is included with the budget. (See attached summary of benefits) SECTION 5. (001/200 121-33 ATTACHMENT D Florida Motor Vehicle Theft Prevention Authority Grant Pamphlet Purpose The Florida Motor Vehicle Theft Prevention Act, passed by the Legislature in 1992, is designed to prevent, combat and reduce motor vehicle theft in Florida. The Act also serves to improve and support the enforcement, prosecution and administration of motor vehicle theft laws. The Legislature established the Florida Motor Vehicle Theft Prevention Authority, which makes grant funds available annually to carry out the purposes of the Act. Grant Availahility Each year, the Authority publicly distributes a notice of grant availability to inform prospective applicants of the availability of funds. Notices of grant availability are automatically sent to all Florida law enforcement agencies, state attorney offices and interested individuals and businesses that have identified themselves to the Authority. Anyone interested in a grant must submit an application to the Authority. Applications may be submitted for the following types of projects related to motor vehicle theft prevention and reduction: • Training (criminal justice, citizens, business, etc.) • Public education (public meetings, literature, public service announcements, neighborhood and business watch promotions, etc.) • Protracted or complex investigations • Equipment (including, but not limited to, locks, alarms, monitoring, tracking or surveillance devices, specialty tools intended to prevent or deter motor vehicle theft, etc.) • Programs designed to improve or expand the resources of existing motor vehicle theft prevention, investigation, apprehension, or prosecution activities • Multi jurisdictional projects combining the resources of different agencies in a task force approach to prevent, investigate, and prosecute motor vehicle theft • Long tern or specialized training to further develop the expertise of motor vehicle theft investigators and/or prosecutors • Statewide public education programs • Statewide training conferences Mv03 (01/01) 1 12133 need. Grant Award Procedures Grants will be awarded annually by the Authority. The Board of Directors of the Authority will consider grant applications at a publicly noticed meeting, and the Authority may approve any portion of a grant budget up to the total amount requested. Proposals that merely replace existing motor vehicle theft prevention programs will be given a ;,s.r priority for funding. Approval of a grant application is subject to: • availability of funds; • an applicant's performance and compliance with the terms and conditions of a current or prior year grant agreement; • priorities for projects, activities or initiatives that are identified by the Authority; and • a limit of one grant award for each eligible applicant per year, unless otherwise approved by the MVTPA Applicants for initial and continuation funding will be notified within 30 days following approval or disapproval of a grant application by the'Authority. An applicant who disagrees with the decision of the Authority may request a hearing within 30 days following the date of the notice that the grant was not approved. The request fora hearing must be in writing. Proceedings in which the Authority may make a determination regarding substantial interests of a party shall be conducted and disposed of in accordance with the provisions of Section 120.57, Florida Statutes, and Chapter 28-5, Florida Administrative Code. (rant Terms and Conditions Agreement. If approved for funding, an applicant will be required to execute a contract or agreement that includes, as part of the contract, the grant application as approved or amended by the Authority. Orientation.. Grant recipients are required to attend an urientation meeting prior to the release of funds, unless specifically exempted by the Authority. MV03 (01/01) 3 grant for the purchase of property, the Authority may: • require the recipient to reimburse the Authority for an amount equal to the acquisition cost of the property; • deduct the cost of the property from any future payments to the grant recipient; • transfer the property to another recipient; or • transfer, sell, or dispose of the property. Multi Agency Agreements. For all grants involving two or more participating agencies or organizations, the grant recipient must have all participants sign an agreement that establishes the equitable distribution of any property, miscellaneous revenue, donations, or reimbursements- for the cost of investigations that may accrue to the grant recipient during the grant period. Property includes property purchased with grant funds and any contraband property that is forfeited to or seized by the grant recipient. Amendments. Any request to amend the grant program or budget must be submitted to the Authority in writing. The Authority will respond to requests within 30 days of receipt. Material amendments to the goals, objectives, activities or budget require approval by the Authority in a vote conducted at a regularly scheduled meeting. A grant recipient may transfer up to 10 percent of the total approved budget between budget categories without prior approval: All other budget amendments require advance approval by the Authority. Audits. The Authority or an authorized representative may conduct periodic Performance Reviews of grant recipients to ensure compliance with the terms and conditions of the grant. In addition, grant recipients who are required by law to conduct an annual audit must submit a copy of the audit to the Authority. Termination. If a grant is terminated, all unexpended grant funds must be returned to the Authority within 60 days. 12iseretion2ry Gr2nts At the discretion of the Board of Directors, the Authority may identify and fund unique or exemplary projects of an exceptional or extraordinary nature. An agency may request continuation of a project funded by the Florida Motor Vehicle Theft Prevention Authority (MVTPA) for a maximum of two years past the initial year of funding. A request for continuation must be submitted annually. Grant continuation is limited in scope to the objectives and activities of the current MVTPA project. Minor modifications that will contribute to the success of the project and which require no additional budget may be proposed for the continuation project. 2. Fundings Unless otherwise approved by the MVTPA, the funding cycle for continuation requests is October 1, 2001 through September 30, 2002. 3. instructions Complete all sections of the Request for Continuation, included as Attachment A. Read and follow all instructions. The accompanying forms, information, instructions, materials and attachments are part of the official Request for Continuation.
