ORDINANCE NO. 12130
AN ORDINANCE OF THE MIAMI CITY COMMISSION
MAKING APPROPRIATIONS FROM THE DOWNTOWN
DEVELOPMENT DISTRICT AD VALOREM TAX LEVY AND
OTHER MISCELLANEOUS INCOME FOR THE DOWNTOWN
DEVELOPMENT AUTHORITY OF THE CITY OF MIAMI,
FLORIDA, FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 2001 AND ENDING SEPTEMBER 30,
2002; AUTHORIZING THE DOWNTOWN DEVELOPMENT
AUTHORITY TO INVITE AND ADVERTISE REQUIRED
BIDS; PROVIDING FOR BUDGETARY FLEXIBILITY;
PROVIDING THAT THIS ORDINANCE BE DEEMED
SUPPLEMENTAL AND IN ADDITION TO THE ORDINANCE
MAKING APPROPRIATIONS FOR THE FISCAL YEAR
BEGINNING OCTOBER 1, 2001 AND ENDING
SEPTEMBER 30, 2002 FOR THE OPERATIONS FOR THE
CITY OF MIAMI; CONTAINING A REPEALER
PROVISION, SEVERABILITY CLAUSE AND PROVIDING
FOR AN EFFECTIVE DATE
WHEREAS, the Board of Directors of the Downtown Development
Authority of the City of Miami, Florida has approved and
submitted to the City Commission an estimated budget of the
expenditures and revenues of the Downtown Development Authority
for the Fiscal Year beginning October 1, 2001 and ending
September 30, 2002, as prepared by the Executive Director of the
Downtown Development Authority, a copy of said budget having been
made available in a newspaper of general circulation of the City;
and

WHEREAS, the City Commission has reviewed the Downtown
Development Authority's Budget;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as fully set forth in this Section.
Section 2. The following appropriations for Fiscal Year
2001-2002 are approved for the maintenance and for the purpose of
financing the operations and other legal and proper purposes of
the Downtown Development Authority of the City of Miami, Florida:

Section 3. Said appropriations are the anticipated
expenditure requirements for the Downtown Development Authority
for the period October 1, 2001 to September 30, 2002, but are not
mandatory should efficient administration of the Downtown

Development Authority or altered economic conditions indicate
that a curtailment in certain expenditures is necessary. The
Board of Directors of the Downtown Development Authority is
specifically authorized to withhold any of these appropriated
funds from encumbrance or expenditure shall such action appear
advantageous to the economic and efficient operation of the
Downtown Development Authority.
Section 4. The Downtown Development Authority is
authorized to make transfers between the detailed accounts
comprising any of the amounts appropriated by Section 2 hereof,
in order that the available and required balance in any such
account may be used for other necessary and proper purposes,
however, no provision contained in this Ordinance shall be
construed to violate the Anti -Deficiency Act, as set forth in
Sections 18-500 through 18-503 of the Code of the City of Miami,
Florida, as amended.
Section 5. The Downtown Development Authority is
authorized to invite or advertise for bids for the purpose of any
material, equipment or services embraced in the aforementioned
appropriations, for which formal bidding is required, such bids
to be returnable as required by law.

Section 6. The Ordinance shall be deemed supplemental
and in addition to the Ordinance making appropriations for the
Fiscal Year beginning October 1, 2001 and ending September 30,
2001, for operations of the City of Miami.
Section 7. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 8. If any section, part of this section,
paragraph, clause, phrase or word of the Ordinance is declared
invalid, the remaining provisions of this Ordinance shall not be
affected.
Section 9. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof."
PASSED ON FIRST READING BY TITLE ONLY this 13th day of
September , 2001.
1 This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

It is respectfully requested that the City Commission adopt the attached Appropriations
Ordinance for the Downtown Development Authority for the fiscal year beginning October 1,
2001 and ending September 30, 2002.
Background
Chapter 14 of the City of Miami Code authorizes the City Commission to levy an additional ad
valorem tax on all real and personal property within the Downtown Development Authority
District for the purpose of financing the operations of the Downtown Development Authority.
The proposed DDA budget for the Fiscal Year 2001-2002 is based on an estimated increase in
revenues of S 207,618.00 (11 %).
Attached for City Commission approval is an Appropriations Ordinance for the Downtown
Development Authority for the Fiscal Year beginning October 1, 2001 and ending September 30,
2002.

THE DOWNTOWN DEVELOPMENT AUTHORITY
("DDA") OF THE CITY OF MIAMI, FLORIDA
APPROVING THE ANNUAL BUDGET OF THE
DOWNTOWN DEVELOPMENT AUTHORITY FOR THE
FISCAL YEAR BEGINNING OCTOBER 1, 2001 AND
ENDING SEPTEMBER 30, 2002, REQUESTING THAT
THE MIAMI CITY COMMISSION ESTABLISH THE
MILLAGE AND ALLOCATE OTHER FUNDS TO
SUPPORT THE FINANCIAL REQUIREMENTS OF THE
BUDGET; AUTHORIZING THE EXECUTIVE DIRECTOR
AND TREASURER OF THE DOWNTOWN
DEVELOPMENT AUHTORITY TO EXPEND FUNDS
UNDER THE NEW BUDGET; DIRECTING THE
EXECUTIVE DIRECTOR TO FILE A DETAILED
STATEMENT OF THE PROPOSED EXPENDITURES
AND ESTIMATED REVENUES FOR THE FISCAL YEAR

WHEREAS, the Board of Directors of the DDA has reviewed said budget, said
budget being based on the Estimated Tax Roll provided by Miami -Dade County; and
WHEREAS, the Board of Directors of the DDA finds that the proposed budget is
necessary in order to further the objectives of the Downtown Development Authority, as
authorized by City Ordinance.

NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS
OF THE DOWNTOWN DEVELOPMENT AUTHORITY.
Section 1.. 'The budget of the DDA, as submitted by the Executive Director, is
made part of this Resolution and is hereby approved as shall be known as the "Annual
Budget of the Downtown Development Authority: Fiscal Year October 1, 2001 through
September 30, 2002".
Section'2. The .following appropriations for. the' Fiscal Year beginning
October 1, 2001 and ending September 30, 2002 are hereby made for the maintenance
and for the purpose of financing the operation and other legal and proper purposes of the
Downtown Development Authority of the City of Miami, Florida, to wit:
PERSONAL SERVICES $587,622.
PROFESSIONAL SERVICES AND SPECIAL PROJECTS $1,117,560

Section 3. The Commission of the City of Miami is requested to adopt said
budget'and establish the millage, authorized by law, to support the financial requirements

Section 4. The Executive Director and the Treasurer of the Downtown
Development Authority are authorized to expend funds, including new salary rates, as

provided in said budget, after adoption and establishment of the millage by the Miami
City Commission, upon the first day of the 2001-2002 Fiscal Year, October 1, 2001.
Section 5. The Executive Director of the DDA is directed to prepare and file
with the City Clerk of the City Miami, Florida detailed statement of the proposed
expenditures and estimated revenues for the Fiscal Year 2001-2002 which shall be
entitled "Annual Budget of the Downtown Development Authority: Fiscal Year October
1, 2001 through September 30, 2002".
Section 6.. A copy of this Resolution and the attachment shall be filled with
the City Clerk of the City of Miami, Florida after adoption of the millage.by the City of
Miami Commission.

AUTHORITY ("DDA") TO ESTABLISH A PROPOSED
MILLAGE RATE OF ONE-HALF (1/2) MILL FOR THE
DOWNTOWN DEVELOPMENT DISTRICT OF THE CITY OF
MIAMI, FLORIDA FOR THE FISCAL YEAR BEGINNING
OCTOBER 1, 2001 AND ENDING SEPTEMBER 30,
2002, PURSUANT TO SECTION 200.065, FLORIDA
STATUTES (2000); AUTHORIZING AND DIRECTING
THE DDA TO SUBMIT SAID PROPOSED MILLAGE RATE
TO THE MIAMI DADE COUNTY TAX COLLECTOR,
TOGETHER WITH THE DATE, TIME AND PLACE OF THE

Section 2. The DDA is authorized and directed to submit
said proposed millage rate for the Downtown Development District'

to the Miami -Dade County- Property Appraiser and the Miami -Dade
County Tax Collector together with, the date, time and place at.
which the Miami City Commission will hold public hearings to
consider said 'millage rate and the DDA's tentative budget for
said Fiscal Year.as follows: September'13, 2001 at 5.05 P.M. and
September 25 2001, at 5:05' P.M. in the Commission Chambers
at Miami City Hall, 3500 Pan American Drive, Miami,, Florida.
Section 3. This Resolution shall become effective
immediately upon its, adoption and signature'of the Mayor.1/
