AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 11395, AS
AMENDED, ADOPTED SEPTEMBER 12, 1996, WHICH
ESTABLISHED INITIAL RESOURCES AND INITIAL
APPROPRIATIONS FOR A SPECIAL REVENUE FUND
ENTITLED "VICTIMS OF CRIME ACT," TO INCREASE
APPROPRIATIONS TO THE FUND, IN THE AMOUNT OF
$67,310, CONSISTING OF A GRANT IN THE AMOUNT
OF $50,500 FROM THE STATE OF FLORIDA, OFFICE
OF THE ATTORNEY GENERAL, AND MATCHING INKIND
SERVICE FUNDS IN THE AMOUNT OF $16,810
PROVIDED BY THE CITY OF MIAMI; AUTHORIZING
THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN
A FORM ACCETABLE TO THE CITY ATTORNEY, WITH
THE STATE OF FLORIDA FOR ACCEPTANCE OF THE
GRANT AND PROFESSIONAL SERVICES AGREEMENTS
WITH INDIVIDUALS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR THE PROVISION OF
VICTIM ADVOCATE SERVICES, IN. AN AMOUNT NOT
TO EXCEED $50,000, FOR A PERIOD OF ONE (1)
YEAR, WITH THE OPTION TO EXTEND FOR TWO (2)
ADDITIONAL ONE-YEAR PERIODS; AUTHORIZING THE
CITY MANAGER TO EXPEND FUNDS FOR THE
OPERATION OF THE PROGRAM; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the Department of Police had thirteen (13)
domestic violence related deaths in the year 2000, 400 child
abuse, lewd and lascivious and sexual assaults, 7,500 non-
domestic assaults and 5,288 domestic assaults; and

WHEREAS, victims of these incidents have certain rights
under the law which are addressed, in part, by the Department of
Police's Victim Advocate Program; and
WHEREAS, the victims and the Police Department benefit from
the services of in-house victim advocates who assist by
referring the victims to appropriate service agencies; and
WHEREAS, pursuant to Ordinance No. 11395, as amended,
adopted on September 12, 1996, the City Commission established a
Special Revenue Fund entitled "Victims of Crime Act", that
appropriated funds for that purpose and has been amended from
time to time to accept additional grant awards; and
WHEREAS, the State of Florida, Office of the Attorney
General, has approved an additional award, in the amount of
$50,500, to provide counseling and other services for the
"Victims of Crime Act" Program; and
WHEREAS, matching in-kind service funds, in the amount of
$16,810 which is the equivalent of 31% of the salary of the
Sergeant assigned to the Police Department's Violent Crime
Intervention Unit is required of the City of Miami; and
WHEREAS, any expenditure of the funds for purchases shall
comply with applicable City Code purchasing requirements; and
WHEREAS, due to the limited period permitted to use the
grant funds, it is necessary to adopt this Ordinance as an

Emergency Ordinance to ensure the grant is utilized to its
fullest potential;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11395, as amended, adopted
September 12, 1996, is further amended in the following
particulars:l/

Section 3. The City Manager is authorized 21 to execute
an agreement, in a form acceptable to the City Attorney, with
the State of Florida, for acceptance of a grant in the amount of
$50,500, and Professional Services Agreements, in a form
acceptable to the City Attorney, with individuals for the
provision of Victim Advocate Services for the Department of
Police, in an amount not to exceed $50,000, for a period of one
(1) year, with the option to extend for two (2) additional one-
year periods.
Section 4. The City Manager is authorized to expend funds
from this fund for the operation of Victims of Crime Act
Program.
Section 5. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami.
Section 6. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of
not less than four-fifths of the members of the Commission.

including but not limited to those prescribed by applicable City
Charter and Code provisions.

It is respectfully recommended that the City Commission adopt the attached Emergency
Ordinance, amending Ordinance No. 11395, as amended, which established initial resources and
initial appropriations for a Special Revenue Fund entitled: "Victims of Crime Act", thereby
increasing said appropriation by $67,310, consisting of a grant from the State of Florida, Office of
the Attorney General, in the amount of $50,500 and an in-kind match required of the City of
Miami, in the amount of $16,810 (31%). The City's contribution will come from in-kind services
of a Police Sergeant assigned to the Police Department's Violent Crime Intervention Unit.
It is also respectfully recommended that the City Commission authorize the City Manager to
execute Professional Services Agreements for Victim Advocate Services, in an amount not to
exceed $50,000, for the Police Department. Funding to be provided from the Victims of Crime
Act Grant.
BACKGROUND
The City of Miami had thirteen (13) domestic violence related deaths in the year 2000; the Sexual
Assault Unit investigated a total of 400 -child abuse, lewd and lascivious, and sexual assault cases.
In addition, 7,500 non-domestic assaults and 5,288 domestic assaults were handled. The
department has engaged in a successful effort to assist victims of assaults through a coordinated
community response. The Victim Advocate Program provided outreach to over 1,800 victims of
assaults. All these victims have certain mandated rights in our state. The department's Victim
Advocate Program provides advocacy, crisis intervention, information and referral to available
services, assistance in completing crime compensation forms, and follow-up services. The State
of Florida, Office of the Attorney General, has committed an additional $50,500, toward the
payment of salaries of the Victim Advocates, reporting requirements, and training for the
continuance of this successful program. The Victim Advocates will be utilized by the Department
of Police, under executed Professional Services Agreements, to assist victims and refer them to
available services.
This Ordinance is being presented on an emergency basis in order to insure that funds are available
for the payment of program expenses, otherwise, this program will be unable to operate.

Part 4: Statement of Need
The City of Miami Police Department provides services to individuals living in a compact area of Miami -
Dade County. The city is the fourth poorest in the United States and has a crime rate that is the highest in
the State of Florida. It is comprised of urban poor surrounded by high levels of affluence. It has significant
numbers of immigrants from South America, the Caribbean, and Haiti. The city also has high levels of
crime, drug abuse, and unemployment. The City of Miami had 13 domestic violence related deaths in the
year 2000; the Sexual Assault Unit investigated a total of 400 child abuse, lewd and lascivious, and sexual
assault cases. In addition, 7,500 non-domestic assaults and 5,288 domestic assaults were handled. The
victim advocate program provided outreach to over 1,800 victims of assault.
In order to assist with the problems of crime, the City of Miami has dedicated significant resources to assist
victims of domestic violence. However, the City of Miami Police Department recognizes the need to
maintain advocacy for victims of other crime. In order to accomplish this, the City has established the
Violent Crimes Intervention Unit that has the assigned mission of investigating and preventing violence:
This grant will continue critical funding outreach and advocacy for victims of violent crime in Miami who
are often afraid to utilize the services that could improve their safety and improve the quality of their lives.
Part 5: Project Proposal
A. Project Summary
The City of Miami Police Department currently has VOCA funded advocates working with volunteers who
provide support and advocacy for victims of violent crime. The victim advocates funded through this grant
will continue to develop services for victims of non-fatal crimes. The VCIU has divided violent crimes
into the following behavioral categories: sexual assault, domestic violence (stranger related/acquaintance
related), road rage, school-based, hate crimes, child abuse, work -place violence, and boy-fi-iend/girl-friend
domestic violence not covered by Florida law. Each of these categories has unique issues as well as the
common problems faced by crime victims. The advocates funded through this grant will be primarily
focused on non-domestic violence assaults but they will also assist tourists who are victims of crime.
Victims of violent crime in the City of Miami often live in an area that places them at risk for ongoing
assault and threats. The project will work from a philosophy of Restorative Justice through the use of a
team approach for intervention and assistance. The advocates will work in partnership with specially
trained detectives. This team will assess each case for risk and devise strategies to permanently abate the
threat of the victim, advocate for the victim a swift and complete police response, assist with issues
regarding the court process, and provide referrals to any needed service.
This team will examine each case to see if there is a possibility. for a repetitive pattern of assault. When
cases of repeat violence are located; the team will move to identify the nature of the violence and identify
predatory elements in the community. The sworn personnel will use enforcement powers and the
advocates shall work with the victims to increase their safety, provide access to resources, and
communicate concerns to the detective.
Through our collaboration with SafeZone-Miami, we have identified a significant level of victimization in
children resulting from peer violence in the school and on the street. In addition, there is significant
predatory violence directed at children from older youth offenders. The project hopes to reduce future
victimization through the use of intense focused responses to current victims of violent crimes with an
emphasis on reaching youth and child victims. One full time advocate will be hired to reach out to schools
and other locations where these victims can be found in order to assist them and their families.

B. Coordination of Services
This project shall interact with SafeZone-MIAMI which combines resources from Safespace Shelter, City
of Miami Police Department, Miami -Dade Public Schools, and Domestic Violence Court. The project is
led by the City of Miami Police Department. The basic concept calls for the development of a coordinated
effort to reduce crime in a targeted area with a school as the epicenter. Personnel from the partner agencies
will provide a wide range of community education regarding identification and management of violent
crime. As victims are identified, the advocates will be called upon for direct assistance to the victims.
C. Goals and Objectives
Goal 1: Enhance the quality of services to victims of violent crimes.
Objective 1: Between October 15t, 2001 and September 30`h, 2002, the program will provide telephone
advocacy (information, safety planning, referrals) to 700 victims of non -sexual violent crimes.
Objective 2: Between October 1", 2001 and September 30`h, 2002, the program will provide direct
services to 100 victims of sexual assault.
Objective 3: Between October 1" 2001 and September 30'', 2002, the program will provide intensive case
management to 35 victims of stalking.
Goal 2: The project will expand services to meet the immediate needs of victims.
Objective 1: Between October 1", 2001 and September 30a', 2002 the project will provide 25 public
presentations designed to identify crime victims for the purpose of providing referrals for needed service.
Objective 2: Between October 15i, 2001 and September 30`h, 2002 the project will provide comprehensive
advocacy/case management to young victims of violent crime by providing advocacy to 250 child victims.
Objectives 3: Between October 1", 2001 and September 30a', 2002 the project will provide follow up
contact to 50 high-risk victims.
D. Volunteers
The City of Miami Police Department has a Community of Affairs Unit that actively recruits volunteers.
The current VOCA funded project has drawn individuals from this pool. We have had several volunteers
over the past several years. At this time we have one active volunteer. These volunteers are difficult to get
in this city but we will continue to recruit them. These volunteers call victims and assess their needs,
follow up on identified high-risk cases and assist in case management issues such as setting up files, threat
communication, and background forms.
E. Victim Compensation Forms
All of the victim advocates are trained to assess each victim for needs and eligibility for victim
compensation. As the case is opened and eligibility requirements are established, the advocate shall make
appropriate arrangements for the victim to get assistance. This will involve setting an appointment for the
victim to come in. Should the victim be unable to come to us, we will go to them.
F. Continuation of Funding
The City of Miami Police Department has made a substantial commitment to developing ongoing services
for victims of crime. The Department has created a city funded advocate in the Homicide Unit. In
addition, they are providing City Funds for the Domestic Violence Administrator who is responsible for
developing a coordinated intervention plan for victims of violent crime. We are currently seeking funds to
establish a full time advocate within the Sexual Assault Unit.

PART 10. PROGRAM MATCH
The Program Match section of the VOCA Application is an itemized description by budget category of proposed matching
contributions. The budget categories are personnel, contractual services, training, equipment and operating expenses.
The applicant must provide a detailed (itemiied) list and a budget narrative for each budgeted category,. The applicant
must also show the funding source and whether it is a cash or in-kind match. Match is determined by dividing amount

VICTIM ADVOCATE PROTOCOL.
Philosophy: The Violent Crimes Intervention Unit under the community Oriented Policing
concept. The unit operates from the perspective that violence is both a crime and a preventable
health risk. The overall mission is reduce violent crime through the use of comprehensive
intervention and investigation strategies using both sworn and non -sworn personnel in order to
reduce the impact of violence on individuals and the community. To fulfill this mission the unit
combines sworn and non -sworn personnel to intervene in potentially violent situations using
formal risk assessment and risk communication. Service within this unit requires flexibility and
the capacity for intervention.
I.
A. Advocates will make at least one wTitten or telephonic contact in the first week a
target case is assigned. When deemed necessary (or possible), the advocate and/or a
detective will make a face to face visit with the victim. Each victim will receive at
least three outreach attempts. Cases involving high risk will require notification to the
victim advocate administrator if contacts are not resulting in the reduction of risk.
B. All cases will be reviewed for risk. If the advocate finds more than one case, they will
immediately notify a Sergeant and the victim advocate administrator. - When there are
three reported cases, the advocate will notify the Sergeant, Administrator, and the Unit
Commander. For issue related to advocacy, the Administrator will assume direction
of the case.
C. Advocates will assess each Original Incident Report (OIR) for risk factors. Advocates
need to focus on cases that meet the criteria for acute risk and cases involving chronic
repeat offenders.
D. For high-risk cases, the advocates will request a background check after the detective
signs off with his/her IBM number and name.
E. Advocate will review all high-risk, school, workplace, and police involved cases with
the administrator.
F. Advocates will focus on the primary area they are assigned, but they can assist victims
of any crime if they are directly contacted by that victim, or asked for help by any
police officer.
G. After assisting the victim (that is outside his/her assigned area of concern) the
advocate will notify the assigned area advocate and discuss the issues to ensure
continuation of care.
H. All victims will be assessed for victim's qualification for State Crime Compensation.
Appropriate steps will be taken to assist the victim with completion of the
compensation forms.

All advocates will be cross -trained in order to have the capacity to cover non -primary
areas.
J. Field response represents on of the most important aspects of the unit's advocacy
response. Each Advocate must use. a great deal of independent judgement when
allocating time to any case. Field responses are time intensive and should be reserved
for either serious emergencies or as 'a last resort to assist with high-risk cases. When
an Advocate wishes to make a field response they should first attempt to review the
case with the Administrator. If responding is an immediate concern they will need to
fill out the field response sheet and send it to the administrator upon return.
Advocates should not use field contacts in order to do routine victim contact.
When Advocates go to the scene of a violent event they are to page the Administrator
to notify thefn that they are being dispatched. If the situation involves mass victims at
least two advocates need to be dispatched. Upon arrival the advocates should make a
plan to coordinate intervention. At the first opportunity they will page the
Administrator to provide an update and begin to establish a plan for follow up or
increasing services. If there is a need for more Advocates they will page additional
team members to respond to the scene and then notify the Administrator.
A. The advocates will:
- Explain services and possibility of compensation to victim
- Explain participation is voluntary -
- Offer assurance that concern is for their safety as well as the children's safety
- Explain to victim limits of confidentiality
B. If responses indicate domestic violence, the advocate will:
- Ask victim if there is a way to stay safe in case of emergency
- Evaluate effectiveness of client's safety strategies. If victim plan appears to
consider strategies listed on the Initial Safety Plan, validate the plan and proceed.
If there are gaps in their strategy, use Initial Safety Plan as a guide to ask client if
they have thought about the remaining items.
- Complete Initial Safety Plan.
C. If responses do not indicate domestic violence, but advocate senses that it exists, the
victim advocate will:

- Explain advocacy services, offer our telephone number, and invite them to feel free
to call if they have questions or concerns.
- In all cases an advocate will report to the Florida State Department of Children and
Families "Hot Line" any unreported incident of abuse or children involved 'in
domestic violence cases.
- Advocates must be familiar with the advanced case management plan and be
prepared to provide an intervention based on level of need.
When working on community projects the advocate will discuss all activities with
administrator to keep continuity of planning and program development.
A. All REACT cases will be evaluated for:
- Pending cases: In the event that there are pending charges the advocates will find
out who the assigned detective is and notify them of the risk.
- Any uncharged cases: In the event that the advocate recognizes that charges could
be filed but have not been the advocate will take the case to a Sergeant and request
a review.
- Needs for tracking: If there are no possible criminal aspects of a case then it will
be placed in the tracking component of REACT.
B. All stalking cases are to be reviewed with the Administrator
If the case is pending or there is a potential case, it will be referred to a detective
immediately. If the advocate believes it is social action, only, they will refer it to the
administrator who will have it reviewed by a sergeant.
A. Sexual Battery
Confidentiality: No information pertaining to the victim/case should be' discussed
with outside parties.

Each month the Advocates will turn in a schedule to the unit secretary who will post it
on the P sheet. In addition they must fill out the daily activity sheet and send it to the
unit Commander.

A. The Sergeant's participation in the VOCA grant will involve working with the Administrator of
the Violent Crimes Intervention Unit.
B. The Sergeant will assist in risk assessment and risk management strategies.

upon a required in-kind service match of $15,000 which was not
reflected in said Ordinance, for a total appropriation of
$114,641.08; and
WHEREAS, pursuant to Ordinance. No. 11697, adopted
September 28, 1998, Ordinance No. 11395 was further amended to
accept grant monies in the amount of $35,000.00; and

General, has approved an additional award, in the amount of
$48,000.00, for the continued operation of said Program with a

AMENDED, ADOPTED SEPTEMBER 12, 1996, WHICH
ESTABLISHED INITIAL RESOURCES AND INITIAL
APPROPRIATIONS FOR A SPECIAL REVENUE FUND
ENTITLED "VICTIMS OF CRIME ACT," THEREBY
INCREASING SAID APPROPRIATION IN THE AMOUNT
OF $63,125, CONSISTING OF A GRANT IN THE
AMOUNT OF $50,500 FROM THE STATE OF FLORIDA,
OFFICE OF THE -ATTORNEY GENERAL, AND MATCHING
IN-KIND FUNDS IN THE AMOUNT OF $12,625 FOR
SERVICES PROVIDED BY THE CITY OF MIAMI;
AUTHORIZING THE CITY MANAGER TO: (1) ACCEPT
SAID GRANT AND EXECUTE THE NECESSARY
DOCUMENTS, IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY; (2) EXPEND MONIES FROM THIS FUND
FOR NECESSARY EXPENSES TO CONTINUE THE
OPERATION OF THE PROGRAM; AND (3) EXECUTE
PROFESSIONAL SERVICES AGREEMENTS WITH
INDIVIDUALS,. IN A FORM ACCEPTABLE TO THE CITY
ATTORNEY, FOR THE PROVISION OF VICTIM
ADVOCATE SERVICES, IN ANNUAL AMOUNT NOT TO
EXCEED $50,000, FOR A PERIOD OF ONE (1) YEAR,
WITH THE OPTION TO EXTEND FOR TWO (2)
ADDITIONAL ONE YEAR PERIODS; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the Department of Police responded to calls for
more than.. 20,000 incidents of domestic violence, 29,517
aggravated assaults, 22,205 robberies, 1,098 sexual assaults and
506homicides from 1995 to 1999; and
WHEREAS, victims of the incidents have certain rights under
the law which are addressed, in part, by the Department of
Police's Victim Advocate Program; and

WHEREAS, these victims and the Police Department benefit
from having the services of in-house victim advocates who assist
by referring the victims to` appropriate service agencies; and
WHEREAS, pursuant to Ordinance No. 11395, as amended,
adopted September 12, 1996, the City Commission established a
Special Revenue Fund entitled "Victims 'of Crime Act", which
appropriated funds for said purpose and which has been amended
from time to time to accept additional grant awards; and
WHEREAS, the State of Florida, Office of. the Attorney
General, has approved an additional award, in the amount of
$50,500, to provide counseling and other services for the
"Victims of Crime Act" Program; and
WHEREAS, a required in-kind service match, in the amount of
$12,625, which is an amount equal to 25% of the grant award
received, will provide for the services of a Sergeant assigned to
the Police Department's Violent Crime Intervention Unit; and
WHEREAS, any purchases for the expenditure of said funds
will comply with applicable City Code purchasing requirements;
and
WHEREAS, due to the time parameters established for use of
said grant funds,. it is necessary to adopt this Ordinance as an
Emergency Ordinance so the grant may be utilized to its fullest
potential;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this,. Ordinance are hereby adopted by reference
thereto and incorporated herein as .if fully set forth in this
Section.
Section 2. Ordinance No. 11395, as amended, adopted
September 12, 1996, is hereby amended in the following
particulars:1/

accept the grant from the State of Florida, Office of the
Attorney General, and execute the necessary documents, in a form

acceptable to the City Attorney, for acceptance of said monies
for the operation of the "Victims of Crime Act" Program.
Section 4. The City Manager is hereby authorized to
expend monies from this Fund for the operation of said Program.
Section S. The City Manager is herby further authorized
to execute Professional Services Agreements, in a form acceptable
to the City Attorney, with individuals for the provision of
victim advocate services for the Department of Police, in an
annual amount not to exceed $50,000, for a period of - one (1)
year, with the option to extend for two (2) additional one (1)
year periods, subject to the availability of funds, with funds
therefor hereby allocated from the "Victims of Crime Act" Special
Revenue Fund.
Section 6. This Ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds that due to the parameters
established for use of the grant award, the grant may be utilized
to its fullest potential.
Section 7. The requirement of reading this Ordinance on.
two separate days is hereby dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.

Section 8. .This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.!/
