AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING SECTION VII OF ORDINANCE NO. 11970, AS AMENDED, THE ANNUAL APPROPRIATIONS AND CAPITAL IMPROVEMENTS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30,2001; REVISING ONGOING CAPITAL IMPROVEMENT PROJECTS AND MAKING APPROPRIATIONS FOR NEW PROJECTS SCHEDULED TO BEGIN IN FISCAL YEAR 2000-2001; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 11970, the Annual Appropriations Ordinance, on September 28, 2000, establishing revenues and appropriations for the City of Miami, Florida, for Fiscal Y,ear ending September 30, 2001; and WHEREAS, the City Commission has previously accepted grant awards for capital improvements in various parks from various sources: Miami -Dade County Safe Neighborhood Parks Program, Bond Series 2001 and Interest Funds; and private donations from the Inner City Children's Touring Dance Company and the YMCA; and WHEREAS, it is necessary to revise previously approved Capital Improvement Project appropriations or to appropriate funds for new projects to reflect said grant awards; -; '� 0 d NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Ordinance No. 11970, as amended, adopted September 30, 2000, the Annual Appropriations Ordinance for Fiscal Year ending September 30, 2001, is amended in the following particulars:-/ "Section 7. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its Page 7 of 8 0 . 0 debts, necessary and required purchases of goods and supplies and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less than four-fifths of the members of the Commission. Section 7. Page 8 of 8 111 I'd" CITY OF MIAMI FLORIDA INTER -OFFICE MEMORANDUM, TO: Honorable Mayor and DATE Members of the City Commission SUBJECT: FROM: REFERENCES: ACityManage e ezENCLOSURES: RECOMMENDATION: 12 AUG 2 9 FILE: Emergency Appropriation Ordinance/Capital Projects It is respectfully recommended that the City Commission approve the attached emergency ordinance amending the FY 2001 Annual Appropriation Ordinance No. 11970, as amended, to revise and/or establish new ongoing capital projects. BACKGROUND: The City of Miami Commission has previously accepted various grants for the Parks and Recreation Department. These grants are from the Miami -Dade County Safe Neighborhood Parks Program, Bond Series 2001 and Interest funds; and private donations from the Inner City Children's Touring Dance Company and the YMCA; Resolution No.01-557 accepted the Miami -Dade County Safe Neighborhood Parks Program, Bond Series 2001 on June 14, 2001, to fund capital projects totaling $4,513,945 for several parks. On July 26`h, Resolution No. 01-748 accepted the Safe Neighborhood Parks Program, Interest funds in the total amount of $204,950 for the expansion of Maximo Gomez Park and the acquisition of land in Little Haiti known as the "Little River Preserve". The same day, Resolution No. 01-766 accepted a private donation, from the Inner' City Children's Touring Dance Company in the amount of $97,500, as a contribution toward the construction of the new Hadley Park Recreation Building project. Finally, the City of Miami Commission accepted private donations, from YMCA in the amount of $159,605 to pay for additional architectural fees needed to complete the design of the International Water Sports Center project. It is therefore, necessary to revise previously approved Capital Improvement Project appropriations or to appropriate funds for new projects to reflect said grant awards in the FY 2001 Annual Appropriation Ordinance No. 11970, as amended. Since citizens are anxiously awaiting these improvements and some of the grant funds being appropriated are for on-going projects in the design or construction phases, we have prepared the legislation as an emergency to ensure that these projects are completed as expeditiously as possib`Y��?o�3'� �101 7 CAG/FKR/AR/mp 12107
