AN ORDINANCE OF THE MIAMI CITY COMMISSION,
WITH ATTACHMENT(S), APPROVING THE AMENDMENT
TO THE CREATION OF THE "BAY HEIGHTS ROVING
SECURITY GUARD SPECIAL TAXING DISTRICT" BY
MIAMI-DADE COUNTY TO INCREASE THE OFF-DUTY
POLICE ROVING PATROL. SERVICES FROM EIGHT
HOURS TO SIXTEEN HOURS PER DAY FOR THE BAY
HEIGHTS NEIGHBORHOOD, MIAMI, FLORIDA; SUBJECT
TO COMPLIANCE WITH APPLICABLE CITY OF MIAMI
AND MIAMI-DADE COUNTY REQUIREMENTS; APPROVING
NECESSARY EXPENDITURES FOR SAID ROVING
OFF-DUTY POLICE PATROL SERVICE; REQUIRING
REIMBURSEMENT FOR ALL EXPENDITURES; REQUIRING
EXECUTION OF A NEW INTERLOCAL AGREEMENT, IN
SUBSTANTIALLY THE ATTACHED FORM, WITH
MIAMI-DADE COUNTY; CONTAINING A REPEALER
PROVISION, SEVERABILITY CLAUSE AND PROVIDING
FOR AN EFFECTIVE DATE.
WHEREAS, citizens of the City of Miami residing in Bay
Heights neighborhood petitioned Miami -Dade County, pursuant to
Chapter XVIII of the Miami -Dade County Code, to create a New
Special Taxing District .to provide increased hours of roving
off-duty Police Patrol Service for the Bay Heights neighborhood;
and

WHEREAS, the Bay Heights Civic Association requested,
through Ordinance No. 11476 adopted on April 10, 1997, obtained
the recommendation of approval from the Miami City Commission for
Miami -Dade County to hold a referendum vote of the registered
voters of the Bay Heights neighborhood, at no expense to the City
of Miami, to determine whether a Special Taxing District, to be
known as the "Bay Heights Roving Security Guard Special Taxing
District," should be created in the Bay Heights neighborhood of
the City of Miami; and
WHEREAS, Miami -Dade County passed and adopted Ordinance
No. 97-120 on July 8, 1997 creating the District and the District
was approved on September 9, 1997 by a majority vote of the
electors residing within the District; and
WHEREAS, the Bay Heights Civic Association has requested the
approval of the Miami City Commission for Miami -Dade County to
hold a second referendum vote of the registered voters of the Bay
Heights neighborhood, at no expense to the City of Miami, to
determine whether the Bay Heights Roving Security Guard Special
Taxing District shall be amended to increase the off-duty police
roving patrol services from eight hours per day to sixteen hours
per day; and
WHEREAS, the City Commission, after careful consideration of
this matter, deems it advisable and in the best interest of the
general welfare of the City. of Miami, in general, and the

residents of the Bay Heights neighborhood in particular, to allow
Miami -Dade County to proceed, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The amendment to the creation of the Bay
Heights Roving Security Guard Special Taxing District
("District") by Miami -Dade County, for the Bay Heights
neighborhood, Miami, Florida, in accordance with Chapter XVIII of
the Miami -Dade County Charter and Sections.18-2 and 18-3 of the
Miami -Dade County Code, for the purpose of providing increased
off-duty police roving patrol service, is approved, subject to
the requirements set forth herein.
Section 3. The amendment to the District and the levying
of annual special assessments to support the service shall also
require the execution of an interlocal agreement, in
substantially the form attached, between the City of Miami and
Miami -Dade County. The City Commission authorizes the City
Manager to execute the interlocal agreement on behalf of the City
of Miami.

Section 4. Upon the referendum approval of this
amendment to the District by, the District's 'registered voters,
and subject to the inclusion of a specific provision in the
interlocal agreement between the City and Miami -Dade County
providing for reimbursement to the City of expenses incurred, the
City shall provide a roving police patrol service, comprised of
off-duty police officers in marked patrol vehicles, during the
term of the aforesaid interlocal agreement or until terminated by
either the City or, Miami -Dade County, at any time, by sixty (60)
days prior notification in writing of desire to terminate.
Section 5. Upon the amendment to the District, and the
execution of the interlocal agreement, the City Manager is
authorized to expend wholly reimbursable funds necessary to
provide the specified roving police services.
Section 6. Said interlocal agreement shall provide that
Miami -Dade County shall reimburse the City for all costs
necessary to provide the roving police patrol service described
herein.
Section 7. The City of Miami shall be responsible for
providing roving security service in the District sixteen hours a
day, seven days a week, three hundred and sixty-five days a year,
through the use of uniformed off-duty police officers. This

service is subject to the availability of off-duty police
officers to perform this function and excludes coverage should
the City require its police officers for emergency situations
such as natural disasters, civil disturbances, special events,
and similar situations.
Section 8. All approvals and authorizations granted are
further conditioned upon and subject to the affirmative vote of
the registered voters of the Bay Heights neighborhood in an
election to be conducted according to Miami -Dade County Code, and
further, subject to the approval of the Miami -Dade County Board
of Commissioners.
Section 9. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 10. If any section, part of section, paragraph,
clause, phrase, or work of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.

Section 11. This Ordinance shall become effective thirty
days after final reading and adoption thereof.!'

INTERLOCAL AGREEMENT BY AND BETWEEN MIAMI-
DADE COUNTY, FLORIDA AND THE CITY OF MIAMI
FOR POLICE ROVING PATROL SERVICES WITHIN THE
BAY HEIGHTS ROVING PATROL SECURITY GUARD
SPECIAL TAXING DISTRICT
THIS INTERLOCAL AGREEMENT, made and entered into this day
of , 2001 (hereinafterreferred to as "Agreement"); by and between MIAMI-DADE
COUNTY, FLORIDA (the "COUNTY"), a political subdivision of the State of Florida, and the
CITY OF MIAMI, FLORIDA (the "CITY"), a municipality organized and existing under the
laws of the State of Florida.
WHEREAS, Section 163.01, Florida Statutes (1999) and the Miami -Dade County Home
Rule Charter, as amended, permit the COUNTY, and the CITY to enter into interlocal
agreements; and
WHEREAS, the City Commission passed and adopted Ordinance No. on ,
2001 amending Ordinance No. 11476 adopted on April 10, 1997, approving the creation of the
BAY HEIGHTS ROVING PATROL SECURITY GUARD SPECIAL TAXING DISTRICT
(hereinafter referred to as "District"), and entering into an interlocal agreement in order for the
CITY to provide off-duty police roving patrol services for the District; and
WHEREAS, the Board of County Commissioners passed and adopted Ordinance
No. on , 2001 amending Ordinance No. 97-120 adopted on July 8, 1997, creating
the District, pursuant to Chapter 18 of the Code of Miami -Dade County, Florida, and Section
1.01 (A) (11) of the Miami -Dade County Home Rule Charter and authorizing the execution of an
interlocal agreement in order for the CITY to provide off-duty police roving patrol services for
the District; and
WHEREAS, the District was approved on September 9, 1997 by a majority vote of
qualified electors residing within the District; and
WHEREAS, the District has requested and will vote on an amendment to the District
providing for an increase to their level of service to increase off-duty police roving patrol
services from 8 hours per day to 16 hours per day; and
WHEREAS, the CITY and COUNTY desire to enter into this two (2) year interlocal
agreement, in order for the CITY to provide the increased off-duty police roving patrol services
requested by and for the District if approved by a majority vote of qualified electors residing
within the District (hereinafter referred to as "Agreement");
NOW, THEREFORE, the COUNTY and the CITY herein mutually agree as follows:
1. The recitals and findings contained in the "Whereas" clauses set forth above are
hereby adopted by reference and incorporated as if fully set forth in this Section.
2. The CITY will furnish management, supervision, personnel, equipment, vehicles
and supplies as required to provide the police patrol service for the District. This service shall
consist of one roving uniformed off-duty police officer, sixteen (16) hours per day, three hundred
and sixty five (365) days per year within the District boundaries. This service is subject to the
availability of off-duty police officers to perform this function and excludes coverage should the
CITY require the utilization of its police officers for emergency situations such as natural
disasters, civil disturbances, special events, and similar situations.
3. The COUNTY agrees to pay the CITY a fixed hourly rate of twenty-three dollars
($23) per hour for the actual number of roving patrol service hours performed plus an
administrative fee of ten dollars ($10) per officer, per day, which amount includes all
administrative fees, for the actual number of roving patrol service hours performed. . Holiday

Rate at $34.50 per hour per Police Officer, Holiday Rate after Midnight at $36.00 per hour per
Police Officer. Holiday days are subject to change in the event of a change in the CITY policy.
Currently the CITY approved and designated off-duty officer holidays are: Thanksgiving Day,
Christmas Day, New Years Day, and Independence Day. Furthermore, the differential rate for
off-duty assignments between midnight and 0700 hours will be an additional $1.00 per hour.
The aforementioned rate has been established using the base off-duty rate as set by the CITY
Police Department. This rate is subject to change in the event of a change in the CITY Police
Department's off-duty rate. Any such rate change will require an amendment to this Agreement,
which shall be subject to approval by both the CITY and the COUNTY. Realizing the
competitive market for off-duty police officer services, and the gap between the provision of
services and collection of special assessments for paid services, the parties hereto acknowledge
the fact that the COUNTY delivered to the CITY a security deposit of five thousand dollars
($5,000.00) to ensure a minimum of two week's service at fifty six (56) hours of service per
week at the commencement of the services being provided to the District. Said prepaid fund will
be recouped as a credit against the CITY'S invoices received within the final 90 day period of
this Agreement or any extension thereof.
4. From special assessments collected within the District, the COUNTY shall pay
all costs incurred by the CITY pursuant to Sections 2 and 3 above, within 30 days of receipt of
itemized invoices.
5. Post orders shall be prepared and published by the COUNTY and posted at a
mutually agreed upon location within the District. All officers must comply with and have
access to these post orders at all times while on duty. All post orders (initial or revised) must be
approved by the COUNTY. Said post orders may be amended from time to time by the

COUNTY in its discretion as it deems appropriate in its administration of the District. The
COUNTY will furnish at no cost to the CITY a sufficient number of all required forms and a
desk book with Post Orders.
6. The CITY agrees to indemnify and hold harmless the COUNTY and its officers,
employees, agents and instrumentalities from any and all liability, losses or damages, including
attorney's fees and cost of defense, which the COUNTY or its officers, employees, agents or
instrumentalities may incur as a result of claims, demands, suits, causes of actions or proceedings
of any kind or nature arising out of, relating to or resulting from the performance of this
Agreement by the CITY or its employees, agents, servants, partners, principals or
subcontractors. The CITY agrees to pay all claims and losses in connection therewith and shall
investigate and defend all claims, suits or actions of any kind or nature in the name of the
COUNTY, where applicable, including appellate proceedings, and shall pay all costs, judgments,
and attorney's fees which may issue thereon. Provided, however, this indemnification shall only
be to the extent and within the limitations of Section 768.28 Florida Statutes. Prior to execution
of this Agreement by the COUNTY, and commencement of work, the CITY must provide to the
COUNTY proof of the CITY's self-insurance pursuant to Chapter 440 and Section 768.28(5),
Florida Statutes, for the following:
(1) Worker's Compensation
(2) Comprehensive General Liability
(3) Automobile Insurance
All such insurance required hereunder shall remain in effect during the term of this
Agreement.

7. The CITY or its agent shall not in any event be considered nor shall it represent
itself as an agent, officer, servant or employee of the COUNTY in the performance of its
activities under this Agreement.
8. The term of this Agreement is for a two (2) year period from the effective date of
the enabling Ordinance. This Agreement may be terminated by either party, at any time, by sixty
(60) days prior notification in writing of desire to terminate.
9. The COUNTY retains the option of renewing this Agreement for successive two-
year periods with the consent of the CITY. At the time of Agreement renewal, the COUNTY
will consider an adjustment based upon the then current off-duty police officer rates as
determined by the CITY. Any renewal of this Agreement may be terminated by either party, at
any time, by sixty (60) days prior notification in writing of desire to terminate.
10. All written notices under this Agreement will be sent by certified mail addressed
to the following address of the COUNTY:

11. Nothing expressed or implied herein is intended or shall be construed to confer
upon or to give any person, firm, corporation or other entity, other than the parties hereto, any
right, remedy or claim under or by reason of this Agreement or by reason of any term, covenant,
condition, promise or agreement contained herein, all said rights, remedies and any claims

whatsoever hereunder being for the sole and exclusive benefit of the parties hereto, their
successors and assigns. No third party beneficiary rights are intended or implied.
12. This Agreement shall be binding upon the parties hereto.
13. This Agreement has been duly authorized, executed and delivered by each party
hereto and constitutes a legal, valid and binding obligation of each party in accordance with its
terms.
14. The terms of this Agreement shall be enforceable by either party hereto in a court
of competent jurisdiction by use .of all available equitable and legal remedies.
15. This Agreement shall be effective when approved, executed and delivered by the
City Manager and the County Manager as authorized by CITY Ordinance No. and
COUNTY Ordinance No. , respectively.
16. As a condition precedent to the effectiveness of this Agreement and any
subsequent amendments thereto, this Agreement and such amendments must be filed with the
Clerk of the Circuit Court, in and for Miami -Dade County, Florida.
17. This document embodies the entire agreement and understanding between the
parties hereto, and any other agreements and understandings, whether oral or written, with
reference to the subject matter of this Agreement are merged herein or superseded hereby.
18. 'No alteration, change or modifications of the terms of this Agreement shall be
valid unless made in writing and signed by all parties and, if deemed by either the City Attorney
or the County Attorney to be a material amendment, then only upon approval by both the City
Manager and the County Manager.

It is respectfully recommended that the City Commission adopt the attached Ordinance, amending
Ordinance No. 11467, which established the Bay Heights Roving Patrol Security Guard Special
Taxing District ("District), in order to provide for an increase in the police off-duty roving patrol
services from eight (8) hours to sixteen (16) hours, and further authorizing the City Manager to
execute an Interlocal Agreement with Miami -Dade County.
BACKGROUND
The citizens of the City of Miami residing in the Bay Heights neighborhood petitioned Miami -
Dade County, pursuant to Chapter XVIII of the Metropolitan Dade County Code, to create a
Special Taxing District to provide roving off-duty police patrols for their neighborhood. The
citizens of the Bay Heights Roving Patrol Security Guard Special Taxing District ("District") has
requested and will vote on an amendment to provide for an increase to their level of service to
increase off-duty police roving patrol services from eight (8) hours per day to sixteen (16) hours
per day.
The City of Miami and Miami -Dade County desire to enter into this two (2) year Interlocal
Agreement, in order for the City to provide the increase off-duty police roving patrol services
requested by and for the District if approved by a majority vote of qualified electors residing within
the District.
