ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING SECTIONS 5, 6 and 7 OF
ORDINANCE NO. 11970, AS AMENDED, THE ANNUAL
APPROPRIATIONS ORDINANCE FOR FISCAL YEAR
ENDING SEPTEMBER 30, 2001, THEREBY
INCREASING THE BUDGET FOR THE DEPARTMENT OF
COMMUNITY DEVELOPMENT, ESTABLISHING A
CAPITAL IMPROVEMENT PROJECT ENTITLED
"FLAGLER STREET MARKETPLACE", CAPITAL
IMPROVEMENT PROJECT ("CIP") NO. 341140, TO
BEGIN IN FISCAL YEAR 2001 AND INCREASING
APPROPRIATIONS TO CIP NO. 351283, "WATSON
ISLAND SANITARY SEWERS"; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11970,
the Annual Appropriations and Capital Improvements Ordinance on
September 28, 2000, which established revenues and
appropriations, revised ongoing capital improvement projects,
and made appropriations for new projects for the City of Miami,
Florida, for Fiscal Year ending September 30, 2001; and
WHEREAS, the operational budget of the Department of
Community Development needs to be increased by $500,000 to
reflect Community Development Block Grant program income that

will be allocated for use by the Community Redevelopment Agency;
and
WHEREAS, the Flagler Street Marketplace project is a joint
project of the Florida Department of Transportation, Miami -Dade
County, City of Miami and the Miami Downtown Development
Authority; and
WHEREAS, the project includes two-way traffic conversion,
transit mall, shuttle bus operation and streetscape enhancements
for a corridor along Flagler, North First and South First
Streets from Biscayne Boulevard to River Drive in downtown
Miami; and
WHEREAS, the City Commission passed Motion M-00-972 on
November 16, 2000, showing its support of and commitment to the
Flagler Street Marketplace project; and
WHEREAS, construction of the Flagler Street Marketplace
project is scheduled to begin in September 2001 with the
installation of the streetlights by Florida Power & Light
Company ("FP&L"); and

WHEREAS, it is necessary to establish a new capital
improvement project entitled "Flagler Street Marketplace", CIP
No. 341140, and make appropriations totaling $1,622,800 to fund
the streetlight work to be done by FP&L; and
WHEREAS, the City has reached a settlement agreement with
RIC -MAN International, Inc. which includes a new construction
contract for the completion of the installation of sewage pipes
on Watson Island; and
WHEREAS, it is necessary to appropriate an additional
$842,100 from 1995 Sanitary Sewer Bonds to capital project
351283, "Watson Island Sanitary Sewers", to cover the cost of
the construction contract;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 7. Section 6 of Ordinance No. 11705, as amended,
adopted September 28, 1998, and Section 5 of Ordinance No. 11839,

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon further grounds of the necessity to make the
required and necessary payments to its employees and officers,
payment of its debts, necessary and required purchases of goods
and supplies and to generally carry on the functions and duties
of municipal affairs.
Section 6. The requirements of reading this Ordinance
on two separate days are dispensed with by an affirmative vote
of not less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor.!'

by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon
the effective date stated herein, whichever is later.

ENCLOSURES:
It is respectfully requested that an amendment to the FY2001 Annual Appropriations
Ordinance No. 11970, as amended, be approved thereby establishing, new CIP No.
341140, Flagler Street Marketplace.
The Flagler Street Marketplace project, a joint project of the Florida Department of
Transportation, Miami -Dade County, City of Miami and the Miami Downtown
Development Authority, consists of two-way traffic conversion, transit mall, shuttle bus
operation and streetscape enhancements for a corridor along Flagler, North First and
South First Streets from Biscayne Boulevard to River Drive in downtown Miami.
The City has committed to fund the streetscape portion of this project which includes the
installation of streetlights by Florida Power & Light. Therefore, it is now necessary to
appropriate funds in the amount of $1,622,800 in a new capital project for the FP&L
work to begin in September 2001.
