AN EMERGENCY ORDINANCE OF THE -MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 12054 WHICH
ESTABLISHES A SPECIAL REVENUE FUND ENTITLED,
"FEMA/USAR GRANT AWARD (FY 2001) FUND",
APPROPRIATED FUNDS FOR THE OPERATION OF SAME,
AND AUTHORIZED THE ACCEPTANCE OF A GRANT, TO
FURTHER AUTHORIZE THE EXPENDITURE OF FUNDS
FOR THE PURCHASE OF EQUIPMENT, TRAINING,
MANAGEMENT, AND ADMINISTRATION OF THE SOUTH
FLORIDA URBAN SEARCH AND RESCUE (USAR)
PROGRAM; CONTAINING A REPEALER PROVISION AND
A SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Ordinance No. 12054, adopted April 26, 2001,
is amended in the following'particulars:l/
"ORDINANCE NO. 12054
Section 5. The expenditure of grant
funds is authorized for purchase of
equipment, training, management and
administration of the South Florida Urban
Search and Rescue (USAR) Program.

in effect and remain unchanged. Asterisks indicate omitted and

Section 2. All ordinances or parts of ordinances that
are inconsistent or in conflict with the provisions of this
Ordinance are repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of
municipal affairs.
Section 5. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less that four-fifths of the members of the Commission.

Section 6. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.�'

RECOMMENDATION
It is respectfully recommended that the attached Emergency Ordinance be adopted amending
Ordinance No. 12054 which establishes a special revenue fund entitled, "FEMA/USAR Grant
Award (FY 2001)" Fund", and appropriated funds for the operation of same, and authorized the
acceptance of a Grant from the Federal Emergency Management Agency (FEMA) in the amount
of $150,000 for the fiscal year 2001 beginning March 30, 2001 in two increments of $75,000, to
further authorize the expenditure of funds for the purchase of equipment, training, management,
and administration of the South Florida Urban Search and Rescue (USAR) Program.
BACKGROUND
The South Florida Urban Search and Rescue (US&R) Program has been annually awarded a
FEMA grant for the operation of the Department of Fire -Rescue's USAR Program. Pursuant to
Ordinance No. 12054, adopted April 26, 2001, a special revenue fund for the above grant was
established and the funds were appropriated therein.
The Department of Fire -Rescue has received this grant award for the continued operation of the
USAR Program, as specified above, and it is now timely to accept and appropriate said grant
funds.

CONSISTING OF A GRANT ALLOCATED BY THE
FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA),
FOR THE PURCHASE OF EQUIPMENT, PROVISION OF
TRAINING, MANAGEMENT, AND ADMINISTRATION OF
THE SOUTH FLORIDA URBAN SEARCH AND RESCUE
(USAR) PROGRAM; AUTHORIZING •THE CITY MANAGER
TO ACCEPT THE GRANT AWARD AND TO EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR ACCEPTANCE OF THE
GRANT; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City of Miami has been advised that the South
Florida Urban Search and Rescue (USAR) Program, a Federal
Emergency Manag.ement Agency (FEMA), has been awarded a grant, in
the amount of $150,000, for operation of the Program for Fiscal
Year 2001; and
WHEREAS, the funds will be used by the Department of
Fire -Rescue to purchase specialized equipment and to provide
training, management and administration of the USAR Program, as
set forth in the grant award;

WHEREAS, it is appropriate for the City Manager to accept
said grant and to establish a special revenue fund for the
appropriation of said grant award;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by .reference and
incorporated as if fully set forth in this Section.
Section 2. The following new Special Revenue Fund is
established and resources are appropriated as described below:
Fund Title: FEMANSAR Grant Award (FY 2001) Fund
Resources: Federal Emergency Management
Agency ("FEMA") $150,000
Appropriations: $150,000
Section 3. This appropriation is contingent upon final
grant approval by FEMA and the City Manager's acceptance thereof.
Section 4. The City Manager is authorized!/ to accept
the grant from the Federal Emergency Management Agency ("FEMA")

limited to those prescribed by applicable City Charter and Code
