ORDINANCE NO. 12096
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 11970, AS
AMENDED, THE ANNUAL APPROPRIATIONS AND CAPITAL
IMPROVEMENTS ORDINANCE FOR FISCAL YEAR ENDING
SEPTEMBER 30, 2001; REVISING ON-GOING CAPITAL
IMPROVEMENT PROJECTS SCHEDULED TO BEGIN IN FISCAL
YEAR 2000-2001; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11970,
the Annual Appropriations Ordinance, on September 28, 2000,
establishing revenues and appropriations for. the City of Miami,
Florida, for Fiscal Year ending September 30, 2001; and
WHEREAS, the City has been awarded $40,242 in grants from
Miami -Dade County Office of ADA Coordination for capital
improvements. related to wheelchair accessibility in Shenandoah
and Kinloch Parks; and
WHEREAS, it is necessary to revise previously approved
Capital Improvement Projects appropriations to reflect said grant
awards.
NOW, THEREFORE; BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11970, as amended, adopted
September 30, 2000, the Annual Appropriations Ordinance for
Fiscal Year ending September 30, 2001, is hereby amended in the
following particulars:
Section 7. Section 6 of Ordinance No. 11705, as amended,
adopted September 28, 1998, and Section 5 of Ordinance No. 11839,
as amended, adopted September 28, 1999, are hereby further
amended in the following particulars to revise previously
approved Projects and establish new Projects to be initiated
during Fiscal Year 2000-2001:1/
The following appropriations in all Capital Improvement Projects
are in the thousands of dollars.

Section 3. All ordinances or parts of ordinances that
are inconsistent or in conflict with. the provisions of this
Ordinance are repealed.

remaining provisions of this Ordinance shall not be affected.

Section 5. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and supplies
and to generally carry on the functions and duties of municipal
affairs.
Section 6. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.2/
If the Mayor does not sign this Ordinance, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the
City Commission.

In accordance with Miami Code Sec. 2-36, since the Mayor did not indicate Fapprovai or
this legislation by signing in the designated place provided, said legislation 110\,v

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached emergency
ordinance amending FY 2001 Annual Appropriation Ordinance No. 11970, as amended,
to revise ongoing capital improvement projects to reflect grants awarded by Miami -Dade
County Office of ADA Coordination.
BACKGROUND:
The Miami -Dade County Office of ADA Coordination has awarded the City two (2)
grants in the total amount of $40,242 for handicap accessible improvements at
Shenandoah and Kinloch parks. In Shenandoah Park, $34,123 will be utilized to build
handicap accessible walkways, and parking spaces and in Kinloch park the remaining
$6,119 will be utilized to expand the existing handicap accessible playground.
The proposed legislation is a companion item to two items scheduled for the July 26,
2001 Commission Meeting; (1) a Resolution accepting the grant awards and (2) a
Resolution increasing the construction contract of EDFM Corporation to build the
walkways and parking spaces at Shenandoah Park.
