ORDINANCE NO. 12095
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 11980,
ADOPTED OCTOBER 12, 2000, WHICH ESTABLISHED
INITIAL RESOURCES AND APPROPRIATIONS FOR A
SPECIAL REVENUE FUND ENTITLED: "MIAMI RIVER
BROWNFIELDS PROJECT FUND", TO INCREASE
APPROPRIATIONS IN THE AMOUNT OF $111,000,
CONSISTING OF A GRANT FROM THE STATE OF
FLORIDA OFFICE OF TOURISM, TRADE, AND
TECHNOLOGY; AUTHORIZING THE EXPENDITURE OF
FUNDS FOR THE BROWNFIELDS ASSESSMENT AND
REMEDIATION PROJECT IN THE WYNWOOD AREA; AND
AUTHORIZING THE CITY MANAGER TO EXECUTE THE
NECESSARY DOCUMENTS FOR ACCEPTANCE OF THE
GRANT; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. Ordinance No. 11980, adopted October 12,
2000, is amended in the following particulars:l/

Section 2. The following Special Revenue Fund
is established and resources are appropriated as
described herein:
FUND TITLE: MIAMI RIVER BROWNFIELDS PROJECT FUND
RESOURCES: U.S. Environmental
Protection Agency $185,000
Florida Office of Tourism,
Trade and Technology $111,000
APPROPRIATIONS: $185,000 $296,000
Section 2. The expenditure of grant funds is authorized
for the Brownfields Assessment and remediation Project in the
Wynwood area.
Section 3. The City Manager is authorized' to execute
the necessary documents, in a form acceptable to the City
Attorney, for acceptance of the grant.
Section 4. All ordinances or parts of ordinances that
are inconsistent or in conflict with the provisions of this
ordinance are repealed.
2/ The herein authorization is further subject to compliance with
all requirements that may be imposed by the City Attorney,
including but not limited to those prescribed by applicable City
Charter and Code provisions.

Section 5. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami, and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and
supplies, and to generally carry on the functions and duties of
municipal affairs.
Section 7. The requirements of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of not
less that four-fifths of the members of the Commission.
Section 8. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor.3/
3/ If the Mayor does not sign this Ordinance, it shall become
effective at the end of ten calendar days from the date it was
passed and adopted. If the Mayor vetoes this Ordinance, it shall
become effective immediately upon override of the veto by the
City Commission.

Ordinance No. 12095, adopted July 26, 2001, contains a scrivener's error as the phrase "in
the amount of" typed on the eighth line of the title is superfluous.
The attachment, which is a substitute original ordinance to replace the document you
presently possess as Ordinance No. 12095, has been revised to delete the phrase.
After the correct document has been executed, please forward a copy to this Office. This
memorandum may be attached to Ordinance No. 12095 so that any concern regarding the
substitution of said Ordinance is clarified.

RECOMMENDATION:
It is respectfully recommended that the City Commission adopt the attached emergency
Ordinance that accepts a grant in the amount of $111,000 from the State of Florida Office
of Tourism, Trade & Technology and appropriates these funds to an existing Special
Revenue Fund entitled "Miami River Brownfields Project".
BACKGROUND:
The Department of Real Estate & Economic Development has established a viable
Brownfields Redevelopment Program that was initiated by the infusion of both Federal
and State grant funding. The Department of Real Estate & Economic Development
initially received $100,000 from the U.S. EPA in October 1996 for the Wynwood
Brownfields Project and received supplemental assistance of $100,000 in October 1997.
In January 1998, the City was awarded $500,000 from the State of Florida for
Browndields Redevelopment.
This new State of Florida grant will enable the City to build on the Brownfields spurred
private sector investment and subsequent job creation in Wynwood.
