MARTIN AFFORDABLE LTD. FOR PREDEVELOPMENT ACTIVITIES, CONSTRUCTION AND PERMANENT FINANCING, PURSUANT TO RESOLUTION NO. 00-170, ADOPTED FEBRUARY 17, 2000; AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH ST. MARTIN AFFORDABLE HOUSING, LTD., FOR SAID PURPOSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Home Investment Partnership Program funds, in the amount of $250,000, are allocated to St. Martin Affordable, Ltd. for predevelopment activities, construction and permanent financing relating to the Miami Stadium Apartments Project in the Allapattah Community Revitalization District, pursuant to Resolution No. 00-170, adopted February 17, 2000. 1200 4 0 0 Section 2. The City Manager is authorized'I to enter into an agreement with St. Martin Affordable Housing, Ltd., in a form acceptable to the City Manager, for said purpose. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not. be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts-, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less that four-fifths of the members of the Commission. - The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. The emergency ordinance reaffirms the City's financial commitment to the project by allocating $250,000 in Home Investment Partnership Program previously allocated by the City Commission pursuant to Resolution No. 00-170, adopted February 17, 2000. The attached emergency ordinance further authorizes the City Manager to enter into an agreement with St. Martin Affordable Housing, Ltd., in a form acceptable to the City Attorney, for said purpose. BACKGROUND: At its meeting of February 17, 2000, the City Commission adopted Resolution No. 00-170, authorizing the City Manager to allocate Home Investment Partnership Program (Home) funds in an amount not to exceed $500,000 to St. Martin Affordable Housing, Ltd., in connection with the financing and construction of the proposed Miami Stadium Apartments Project planned in the Allapattah Community Revitalization .District. The proposed project will consist of approximately 336 rental units with the cost of construction estimated at approximately $29,820,791. To date, St. Martin Affordable Housing, Ltd. has identified and/or secured preliminary financial commitments from the following sources:. Developer's Loans $1,572,631 TOTAL: $28,820,791 The attached emergency ordinance reaffirms the.City's financing commitment to theproject by allocating $250,000 in Home Investment Partnership Program funds pursuant to Resolution No. 00-170. The emergency ordinance further authorizes the City Manager to execute an agreement and/or documents in a form acceptable to the City Attorney with St. Martin Affordable Housing, Ltd. for the financing and construction of the aforementioned housing project.
