HomeMy WebLinkAboutO-12093J-01-620 7/16/01 RESOLUTION NO. 12093 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION REPROGRAMMING $185,000 OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS PREVIOUSLY APPROVED FOR CAPITAL IMPROVEMENT PROJECTS AND ALLOCATING SAID AMOUNT TO BELAFONTE TACOLCY CENTER, INC. (NNTACOLCY".), A NON-PROFIT ORGANIZATION PROVIDING DIVERSIFIED SERVICES FOR THE YOUTH IN THE MODEL CITY REVITALIZATION DISTRICT, TO COMPLETE RENOVATIONS TO THE CITY -OWNED FACILITY OCCUPIED BY TACOLCY, LOCATED AT 6161 NORTHWEST 9TH AVENUE, MIAMI, FLORIDA; AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, WITH TACOLCY FOR SAID PURPOSE. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Community Development Block Grant (CDBG) funds previously approved for Capital Improvement Projects, in the amount of $185,000, are reprogrammed and allocated to the Belafonte Tacolcy Center, Inc. ("Tacolcy"), a non-profit organization providing diversified services for the youth in the Model City Revitalization District, to complete renovations to �2093 e the City -owned facility occupied by Tacolcy, located at 6161 Northwest 9th Avenue, Miami, Florida. Section 2. The City Manager is authorized" to enter into an agreement, in a form acceptable to the City Attorney, with Tacolcy for said purpose. Section 3.. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 5. This Ordinance is declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 6. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less that four-fifths of the members of the Commission. ii The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. BACKGROUND: Belafonte Tacolcy Center, Inc. is a non-profit organization providing diversified services to youth in the. Model City Revitalization District. This organization operates out of a City owned park located at 6161 N.W. 9 Avenue which is need of extensive renovations. To meet this need, $185,000 of Community Development Block Grant funds were identified in the available pool to fund Capital Improvement (CIP) projects. However, due to a technicality, Belafonte Tacolcy is unable to access these funds to proceed with these much-needed renovations. It has been determined that the City is unable to pay the contractor selected to complete the renovations because, although this is a City owned facility, the contract is directly between the Belafonte Tacolcy Center and the contractor. As a result, the Administration does not have authorization to reimburse the contractor directly or disburse funds to Belafonte Tacolcy for that purpose. To mitigate this situation, it is recommended that the City Commission adopt the proposed emergency ordinance that reprograms the CDBG funds set aside in the CIP pool for this purpose and reallocates $185,000 directly .to Belafonte Tacolcy. The proposed resolution further authorizes the City Manager to enter into contract with the aforesaid Agency, in a form acceptable to the City Attorney for this purpose.
