AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 11000, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, BY
AMENDING ARTICLE 9, SECTION 917, TO MODIFY THE
PROVISIONS FOR REDUCTIONS IN PARKING TO ALLOW
REDUCTIONS FOR MULTIFAMILY RESIDENTIAL USES IN
COMMUNITY REVITALIZATION DISTRICTS (CRD)
SUBJECT TO SPECIAL EXCEPTION; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE;
AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of March 21, 2001, Item No. 7, following an advertised hearing,
adopted Resolution No. PAB 30-01 by a vote of seven to one (7-1),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City'Commission after careful consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is further amended in
the following particulars:l/
"ARTICLE 9. GENERAL AND SUPPLEMENTARY REGULATIONS
Sec.917.7. Reduction in parking requirements.
917.7.1. Reduction in parking requirements . for
combinations of commercial and office uses on the same
premises.
Where commercial and office uses are combined and
proposed parking facilities are so located and designed
as to serve both uses conveniently and with reasonable
security, the combined parking requirements may be
reduced to ninety (90) percent of the total required
spaces only by Class II Special. Permit.
917.7.2. Reduction in parking requirements for
multifamily residential development when located in
Community Revitalization Districts (CRD).
Reductions in parking requirements for multifamily
residential development may be approved, pursuant to a
Special Exception Permit, when such development is
located within a CRD as determined by the Planning and
Zoning Department.
Such reductions by Special Exception Permit shall not
fall below the following minimum requirements and such
developments shall not be eligible for variances in
conjunction with this reduction:
1� Words and/or figures stricken through shall be deleted. Underscored
words and/or figures shall be added. The remaining provisions are now
in effect and remain unchanged. Asterisks indicate omitted and
unchanged material.

1. One bedroom and studio units (with or without dens
or other such similar spaces): one parking space
per unit;
2. Two bedroom units: one parking space per unit;
3. Three or more, bedroom units: two parking spaces
per unit.
Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21

This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

PETITION Consideration of amending Ordinance 11000, as
amended, the Zoning Ordinance of the City of Miami,
Florida, by amending Article 9, Section 917 in order to
provide for parking reductions for multifamily
development within a Community Revitalization District
(CRD) area, subject to a Special Exception Permit.

RECOMMENDATION
Approval.
BACKGROUND AND A recent amendment to the zoning ordinance was passed
ANALYSIS which required that one bedroom residential units require
an additional parking space for any additional room
(whether it be labeled a den, recreation room or office,
etc.). This has proven to serve as a dis-incentive within
the City's Community Revitalization Districts (CRD's) in
that it has driven the cost of certain projects beyond
economic feasibility. It is the City's objective to promote
development and redevelopment efforts within the CRD's,
therefore, the proposed amendment is to allow reductions
in parking within the CRD's pursuant to a Special
Exception Permit. The purpose of the Special Exception
is for the Planning and Zoning Department to be able to
evaluate each case individually and assist the developers
in providing the maximum number of parking spaces
without discouraging the development from an economic
standpoint.
