HomeMy WebLinkAboutO-12063J-01-330 5/3/01 ORDINANCE NO. . �J 0 6.3 AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION ESTABLISHING A NEW SPECIAL REVENUE FUND ENTITLED: "SUMMER FOOD SERVICE PROGRAM FOR CHILDREN 2001" AND APPROPRIATING FUNDS FOR THE OPERATION OF THE PROGRAM IN THE ESTIMATED AMOUNT OF $266,670, CONSISTING OF A GRANT FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE, THROUGH THE FLORIDA DEPARTMENT OF EDUCATION; AUTHORIZING THE CITY MANAGER TO ACCEPT THE GRANT AWARD FROM THE UNITED STATES DEPARTMENT OF AGRICULTURE AND TO EXECUTE ALL NECESSARY DOCUMENT(S), IN A FORM ACCEPTABLE TO THE CITY ATTORNEY; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. iC, WHEREAS, the Department of Parks and Recreation sponsors a Summer Food Service Program for children which provides nutritional meals in conjunction with a comprehensive recreational programs; and WHEREAS, the Florida Department of Education, Food and Nutrition Management Division, with funding from the U.S. Department of Agriculture ("USDA"), has agreed to allow the City of Miami to participate once again in its Summer Food Program; and WHEREAS, the USDA, through the Florida Department of Education, Food and Nutrition Management Division, awarded a 1206 grant the City of Miami in the estimated amount of $266,670, based on 1999 figures, to conduct a summer food service program from June 18, 2001 through August 17, 2001 for children up to the age of 18, with reimbursement rates of $2.23 for lunch meals and $.52 for afternoon supplements (snacks), as well as ,appropriate administrative expenses; and . WHEREAS, an estimated 75,000 lunches and 106,000 supplements will be served during the project period starting June 18, 2001 and ending August 17, 2001; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and included as if fully set forth in this Section. Section 2. The following Special Revenue Fund is established and resources are appropriated as described herein: Fund Title: Summer Food Service for Children 2001 Resources: United States Department of Agriculture, through the Florida Department of Education $266,670 Appropriations: $266,670 Section 3. This appropriation is contingent upon approval by the Florida Department of Education of the City's application for the grant and the City Manager's acceptance. Page 2 of 4 12063 Section 4. The City Manager is authorized!' to accept the grant from the USDA,' through the Florida Department of Education, and to execute all necessary documents(s), in a form acceptable to the City Attorney. Section 5. All Ordinances or parts of Ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 6. If any section, part .of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 7. This Ordinance is'declared to be an emergency measure on the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of municipal affairs. Section 8. The requirements of reading this Ordinance on two separate days is dispensed with by an affirmative vote of not less that four-fifths of the members of the Commission. 1� The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. Gimene z REFERENCES: for Children -2001 City Manager ENCLOSURES: RECOMMENDATION: It is respectfully recommended that the City Commission adopt the attached emergency ordinance to create a new Special Revenue Fund and to appropriate grant funds in the estimated amount of $266,670, to be received from the United States Department of Agri -culture (USDA) to conduct a summer food service program. for youth aged 18 and under from June 18, 2001 through August 17, 2001. BACKGROUND: Each year since 1968, the Department of Parks and Recreation has sponsored a Summer Food Service Program for children. Under this program, the City provides nutritional meals in conjunction with its comprehensive recreational program featuring arts and crafts, sporting activities, field trips and special events. This year, we plan to serve up to 1,666 lunches and 2,356 snacks per -day using no less than twenty- eight (28) sites throughout the City. Based on 2000 program totals, we estimate that 75,000 lunches and 106,000 snacks will be served during the upcoming summer program. These figures average out to 1,666 lunches and 2,356 snacks each day for the 45 day program. Funding is provided to the City from a USDA grant through Florida's Department of Education (DOE). This year's grant is estimated at $266,670 based on last year's meals figures and reimbursement rates of $2.23 for lunch and $.52 for afternoon supplements (snacks), as well as appropriate administrative expenses. This rate will provide sufficient funds to cover the meal cost and to hire the necessary temporary, part-time recreation aides to operate the program. The final grant award amount will be made available by Florida's Department of Education in April 2001. This grant does not require matching funds. 12063 Honorable Mayor and Members of the City Commission Page two This Ordinance is being presented as an emergency item because the department was just recently informed of the availability of grant funds; the need to meet the State of Florida established time constraints, deadlines for contract execution, and to ensure that funds are in place prior to the start of the Summer,Program on June 18, 2001. This item is companion to a resolution, which would authorize -the purchase of food from through the inclusion of the City's program requirements in the Miami -Dade County competitive bid package that allows vendors to offer Summer lunches and supplements at a rate lower than that which the Cit of Miami could obtain under.a separate bid.
