HomeMy WebLinkAboutO-12056J-01-132 3/1/01 ORDINANCE NO. 12056 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 19 OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "FIRE PROTECTION," WHICH SETS FORTH FEES FOR FIRE INSPECTIONS AND PERMITS, TO: (1) ADD FEES FOR CERTAIN NEW SERVICES, (2) COVER COSTS OF PERFORMING CERTAIN REVIEWS AND ENFORCEMENT, AND (3) CLARIFY AND MODIFY CERTAIN SERVICES AND FEES; MORE PARTICULARLY BY AMENDING SECTION 19-2 OF SAID CODE; CONTAINING A REPEALER PROVISION, SEVERABILITY CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the State Fire Marshal issued a response to a Petition for Declaratory Statement by Miami -Dade County ("the County") in reference to Fire Sprinkler System inspections; and WHEREAS, the State Fire Marshal determined that any inspection of any portion of a fire sprinkler system, layouts, or fabrication shall be performed only by those individuals certified under Chapter 633, Florida Statutes; and 1205, WHEREAS, upon receipt of the Statement by the State Fire Marshal, the County sent a memorandum to all building officials in the County requesting that the practice of allowing individuals who are not certified under Chapter 633, Florida Statutes, to perform fire sprinkler inspections, shall immediately cease; and WHEREAS, inspections and fees related to fire sprinklers are currently contained in Chapter 10 of the Code of City of Miami, Florida, as amended ("the Code"), but to comply with the mandate by the State Fire Marshal, the such sections must be relocated to Chapter 19 of the Code; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 19 of the Code of the City of Miami, Florida, as amended, is further amended in the following particulars:'/ Words and/or figures stricken through shall be deleted. (f) Permit application fee (non- refundable) $ 35.00 (g) Fire flow, pump and generator test departmental section involved in test $ 60.00 (h) Fee for each inspection for tests conducted after normal working hours (example: smoke -removal system test): (1) Up to four (4) hours minimum for each test $180.00 (2) After four (4) hours (each inspector) per hour $ 45.00 (i) Fire Protection: (1) Jockey pump $ 30.00 (2) Water supply to fire sprinkler system $ 30.00 (3) Fire pump or domestic pump (new or replacement $ 35.00 (4) Each standpipe $ 30.00 (5) Each hose rack or fire department outlet $ 10.00 Page 3 of 5 12056 (6) (7) Each Siamese or roof manifold Each sprinkler head $ $ 25.00 1.00 (8) Each fire flow test $ 40.00 (9) Each fire hydrant (Miami standard only) $ 40.00 (10) Minimum fire sprinkler permit fee $ 60.00 (11) Backflow preventer (fireline) $ 60.00 (j) Fire Suppression System: (1) CO2, halon and dry powder systems and other piped fire extinguishing systems, including reinstallation, modification, or alternation, (full installation including discharge test Minimum fee $105.00 Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not, be affected. BACKGROUND In response to a Petition for Declaratory Statement by Miami -Dade County in reference to Fire Sprinkler System inspections, the State Fire Marshal determined that any inspections of any portion of a fire sprinkler system, layouts, or fabrications shall be performed only by those individuals certified under F.S. Chapter 633. Miami -Dade County issued a memorandum to all Building Officials in Miami -Dade County requesting that the practice of allowing individuals who are not certified under F.S. Chapter 633 to perform fire sprinkler inspections cease immediately. To comply with this mandate, only City of Miami Fire Inspector certified under F.S. Chapter 633 are performing these inspections. Therefore, the permits fees must be transferred from Chapter 10, Buildings, to Chapter 19, Fire Protection.
