ORDINANCE NO. 12054
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION ESTABLISHING A NEW SPECIAL REVENUE
FUND ENTITLED "FEMA/USAR GRANT AWARD (FY
2001) FUND" AND APPROPRIATING FUNDS FOR THE
OPERATION OF SAME IN THE AMOUNT OF $150,000
CONSISTING OF A GRANT ALLOCATED BY THE
FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA),
FOR THE PURCHASE OF EQUIPMENT, PROVISION OF
TRAINING, MANAGEMENT, AND ADMINISTRATION OF
THE SOUTH FLORIDA URBAN SEARCH AND RESCUE
(USAR) PROGRAM; AUTHORIZING THE CITY MANAGER
TO ACCEPT THE GRANT AWARD AND TO EXECUTE THE
NECESSARY DOCUMENTS, IN A FORM ACCEPTABLE TO
THE CITY ATTORNEY, FOR ACCEPTANCE OF THE
GRANT; CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City of Miami has been advised that the South
Florida Urban Search and Rescue (USAR) Program, a Federal
Emergency Management Agency (FEMA), has been awarded a grant, in
the amount of $150,000, for operation of the Program for Fiscal
Year 2001; and
WHEREAS, the funds will be used by the Department of
Fire -Rescue to purchase specialized equipment and to provide
training, management and administration of the USAR Program, as
set forth in the grant award;

WHEREAS, it is appropriate for the City Manager to accept
said grant and to establish a special revenue fund for the
appropriation of said grant award;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to
this
Ordinance are
adopted by reference and
incorporated
as if
fully set forth
in this Section.
Section 2. The following new Special. Revenue Fund is
established and resources are appropriated as described below:
Fund Title: FEMA/USAR Grant Award (FY 2001) Fund
Resources: Federal Emergency Management
Agency ("FEMA") $150,000
Appropriations: $150,000
Section 3. This appropriation is contingent upon final
grant approval by FEMA and the City Manager's acceptance thereof.
Section 4. The City Manager is authorized!' to accept
the grant -from the Federal Emergency Management Agency ("FEMA")

requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

and to execute the necessary documents, in a form acceptable to
the City Attorney.
Section S. . All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed..
Section 6. If any section, part of section, paragraph,
clause, phrase, or word of this. Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be affected.
Section 7. This Ordinance is declared to be an emergency
measure on the grounds of necessity of the City of Miami to make
the required and necessary payments to its employees and
officers, necessary and required purchases of goods and supplies,
and to generally carry on the functions and duties of municipal
affairs.
Section 8. The requirements of reading this Ordinance,on
two separate days is hereby dispensed with an affirmative vote of
not less that four-fifths of the members of.the Commission.

Section 9. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor. -

RECOMMENDATION:
It is respectfully recommended .that the attached Emergency Ordinance be adopted
establishing a special revenue fund, "FEMA/US&R Grant Award (FY 2001)", and
appropriating funds, in the amount of $150,000 consisting of a grant from the Federal
Emergency Management Agency (FEMA) for the period starting March 30, 2001 in two
(2) increments of $75,000 each. The funds will be used, as stipulated by the grant, for
the purchase of equipment, training, management, and administration of the South
Florida Urban Search and Rescue Program (US&R).
BACKGROUND:
The South Florida Urban Search and Rescue (US&R) Program has been annually
awarded a FEMA grant for the operation of the Department of Fire -Rescue's US&R
Program. The grant award for FY 2001 is in the amount of $150,000 and will provided in
two (2) increments of $75,000 each. The Grant monies are now ready to be obtained
from the Federal government and the existing Grant expires on March 29, 2001.
It is now appropriate to accept said grant award, establish a special revenue fund, and
appropriate the $150,000 grant award therein for this fiscal year.

The Department of Fire Rescue is requesting your signature on the attached "FEMA Assistance
Award/Amendment and FEMA Standard Form 270, Request for Advance or Reimbursement" so
we may accept the annual operating grant allocation for the City sponsored Urban Search and
Rescue Task Force, Florida Task Force 2.
BACKGROUND
This is the fourth annual grant (non-matching) that our Task Force has been eligible to receive
since FEMA officially recognized the City sponsored program on December 15, 1996. This
year's allocation is for Fiscal Years 2001 beginning 3/30/01 through 4/01/2003. The paperwork
was distributed by FEMA March 9th and we were given a deadline of March 30`h to have the
completed documentation in FEMA's possession in Washington, DC. A grant of this nature will
be allocated annually by FEMA to assist the Task Force with administrative, training, equipment
maintenance, travel and other costs associated with the program for the next three years. The
Department of Fire Rescue will be presenting a package relative to this project and additional
US&R related issues for approval at the next commission meeting.
RECOMMENDATION
It is respectfully recommended that you sign the attached forms and documents to authorize
FEMA to process and award this years grant of $150,000.00.

You are invited to submit an application for FY 2001 grant funding under the.National Urban
Search and Rescue (US&R) Response System. Enclosed for your completion is an application
package (Enclosure A) for the development and maintenance of a US&R Team. Included in the
package are the following:

In an effort, to make the grant application process less burdensome, this application will cover a
3 -year performance period that will be funded annually. The funding for your organization
under the US&R program for FY 2001 is $150,000. For fiscal years 2002 and 2003, the
estimated funding is $200,000 per year for a total of $550,000 over 3 years. The budget
submitted with your application must support the activities included in your program narrative
and reflect the appropriate use of these funds, by fiscal year, as outlined in the enclosed
statement of work (Enclosure A)
You are to develop a three-year plan for fiscal years 2001, 2002, and 2003. Breakout tasks for
each year will be based on annual availability of funds and awarded without additional
submission of a Budget Narrative Statement unless your budget changes or FEMA deems it
necessary to request a revised budget from the grantee. A streamlined application package will
be required for each subsequent award of funds. Please be advised that if funding is not
appropriated by the U.S. Congress for the remaining two years, the grant will be terminated.
Funding for subsequent fiscal years is also dependent upon FEMA's determination of
satisfactory performance. The multi-year plan must be submitted with your application package
by March 30, 2001
Detailed instructions for completing the application are contained in the enclosed application
package. A sample of a completed SF 424, FEMA Form 20-20, and Assurances and
Certifications are provided for your use (Enclosure B).
FEMA will be providing an initial allocation of 50% of total grant funds for FY 2001, which will
be issued for the first half of this agreement. After completing a new SF 270 for the balance and
providing a financial report, which shows the expenditure of the initial funding, the Task Force
will receive the remaining balance of funds.
The original and one copy of the application package must be received no later than March 30,
2001 at 3:00 p.m., by the issuing. office. The issuing office.and location designated for receipt

ARTICLE I — PROJECT DESCRIPTION
The Grantee shall fumish the necessary personnel, materials, services, equipment, facilities and
otherwise do all things necessary for the.performance of the work set forth in the Program
Narrative.
ARTICLE II — PERIOD OF PERFORMANCE
The period of performance shall be from the effective date Iof this cooperative agreement through
the following twelve (12) months.
ARTICLE III - AMOUNT AWARDED
This agreement is for the administration and completion of an approved National Urban Search
and Rescue (US&R) Response System. Agreement funds shall not be used for other, purposes.

identified in block 14 of the coversheet (FEMA Form 40-21), "ASSISTANCE AMOUNT"
during the time identified as-the "PERFORMANCE PERIOD" are contained in the Statement of

ARTICLE IV — REQUEST FOR REIMBURSEMENT
A. FEMA uses the Direct Deposit/Electronic Funds Transfer (DD/EFT) method of payment
to Recipients. To enroll in the DDIEFT, the Grantee must complete a Standard Form
1199A, Direct Deposit Form.
B. The Grantee may be paid in advance, or reimbursed by completing the Standard Form
SF-270', Request for Advance or Reimbursement. In accordance with Treasury
regulations at 31 CFR 205, the Grantee must maintain or"demonstrate the willingness and
ability to maintain procedures to minimize the time elapsing between the transfer of the
'funds and their expenditure. The timing and amount of cash advances should be as close
as administratively possible to the actual cash disbursement by the Grantee. Grantees that
require an advance may submit an original and two copies of SF —270 at the time of
award for up to $75,000. Submit additional SF-270's as needed, to request remaining .

funds for a total award amount of $150,000.
ARTICLE V — FINANCIAL REPORTS
Standard Form 270, Request for Advance or Reimbursement, will be used in lieu of the Standard
Form 269, Financial Status Report, for reporting purposes.
A final FEMA Form 20-10, Financial Status Report, will be due 90 days after project
completion. Copies of the FF 20-10 are to be submitted to the FEMA Office of Financial
Management, Grants and Acquisition Support Division with a copy to the FEMA program office.

ARTICLE VI — PERFORMANCE REPORTS
Performance reports are due to the FEMA Office of Financial Management, Grants and
Acquisition Support Division andto the Headquarters program office semi-annually. The first
report will be submitted six (6) months after award and additional reports will be submitted every
six (6) months thereafter. A final report will be submitted to the FEMA Office of Financial
Management, Grants and Acquisition Support Division and to the Headquarters program office
listed in Article V, 90 days after project completion. Refer to Section VI of the attached
Statement of Work for specific instructions.
ARTICLE VII — FEMA OFFICIALS
A. FEMA officials for the US&R agreement are as follows:

responsible for the technical monitoring of the stages of work and technical performance
of the activities described in the Statement of Work.

ARTICLE VIII — BUDGET
A. The Grantee shall follow prior approval requirements. found in the Emergency Management
and Assistance Regulations, 44 CFR Part 13.30. for non -construction grants, transfers of
fundssbetween total direct cost categories in the approved budget shall receive the prior
approval of FEMA when such cumulative transfers among those direct cost categories
exceed ten percent of the total budget. The Grantee shall, obtain prior written approval for
any budget revision that would result in the need for additional funds. If a cooperative
agreement provides funding for both construction and non -construction activities, the
Grantee must obtain written approval from FEMA before making any fund or budget
transfer from non -construction to construction or vice versa.
B. No transfer of funds to agencies other than those identified in the approved cooperative
agreement application shall be made without prior. approval of FEMA.
C. If a Grantee estimates that it will have unobligated funds. remaining after the end of the
performance period, the Grantee should report this to FEMA Headquarters at the earliest
possible time and ask for disposition instructions:
D. No monetary increase amendments hereto, or time extension amendments hereto, will be
approved unless all financial or performance reports are current.
ARTICLE IX — OTHER TERNIS AND CONDITIONS
The other terms and conditions of this agreement are as follows:
A. Prior to the. start of any construction activity, the Grantee sfiall.ensure that all applicable
Federal, State, and local permits and clearances are obtained.,
B. Grantees are encouraged to integrate National Environmental Policy Act (NEPA) compliance
and related legislation as implemented under 44CFR, Part 10, with the initial planning and
decision making process for this program. Grantees are encouraged to seek support from
FEMA Environmental Officers in complying with NEPA requirements.
C. _ The Grantee shall transfer to FEMA the appropriate share, based on the Federal support
percentage, of any refund, rebate, credit of other amounts arising from the performance of
this agreement, along with accrued interest, if any. The Grantee shall take necessary action
to effect prompt collection of all monies due or which may become due and to cooperate with
FEMA in any claim, or suit in connection, with amounts` due.
D. The Grantee is free to copyright any original work developed in the course.of or under the

agreement. FEMA reserves a royalty -free, non-exclusive and irrevocable right to reproduce,
publish, or otherwise use, and to authorize others to use, the work for Government program
purposes. Any publication resulting from work performed under this agreement shall include
an acknowledgement of FEMA's financial support and a statement that the publication does
not necessarily reflect FEMA's views.

ARTICLE XII — CONTENTS
OF AGREEMENT
This Cooperative Agreement consists of the following:
NATIONAL URBAN SEARCH AND RESCUE RESPONSE SYSTEM
TASK FORCE PREPAREDNESS COOPERATIVE AGREEMENT
STATEMENT OF WORK
I. BACKGROUND
The Federal Emergency Management Agency (FEMA), in cooperation with other federal, State,
and local agencies, created The National Urban Search and Rescue (US&R) Response System to
provide a national heavy rescue capability that provides lifesaving resources to victims of
structural collapse. It was particularly designed to rescue victims entrapped in collapsed
structures of heavy reinforced concrete construction. When this System was developed in 1990,
there was limited capability in only a few States to perform this mission, and no resources
available for a national response.
In 1992, The Federal Response Plan was published by FEMA and coordinated with 26 federal
agencies. The federal government's response to disasters was classified into 12 Emergency
Support Functions. ESF-9, Urban Search and Rescue was established with FEMA as the
Primary Agency. FEMA maintains a national consensus on standard operating procedures,
organizational structure, equipment, training, and exercise requirements. Currently, 27 local
sponsoring agencies in 18 States participate in the National US&R Response System by making
their US&R Task Forces available for national disaster assignments.
Since FEMA had no organic heavy rescue capability of its own and the best sources for US&R
knowledge and skill reside at the State and local levels, The National Urban Search and Rescue
Response System was developed as a federal—State—local partnership, based on a system of
Memoranda of Agreement (MOA) and Comprehensive Cooperative Agreements (CCA). While
the MOAs provided the basic operational "contract" between FEMA, the State, and sponsoring
agency, the CCAs provided the mechanism for channeling federal grant funds through each
participating State to the sponsoring agencies for National US&R Task Forces. In Fiscal Year
1996, the Performance Partnership Agreement replaced the CCAs. In Fiscal Year 1997, the
Agency decided to fund preparedness efforts of the US&R Task Forces through individual
cooperative agreements with the sponsoring organizations of each of the nation's 27 Task Forces.
H. PURPOSE
The purpose of this agreement is to continue the development and maintenance of National
US&R Response System resources to be prepared to provide qualified, competent US&R
personnel in support of ESF-9 activities under the Federal Response Plan. Specifically, this
agreement provides a mechanism for distribution of grant funding for certain purposes in
preparation for disaster response. Funds are being made available to accomplish the following
objectives.

III. OBJECTIVES
1. Equip the task force in accordance with FEMA approved cache list dated January 28, 2000
and subsequent revisions approved by FEMA to. perform National US&R mission
assignments as described in the. Urban Search and Rescue Response System Task Force
Operations Manual (TF OM).
2. Train Task Force members and other National US&R Response System personnel to perform
assigned US&R duties in accordance with established, FEMA approved standards (e.g., TF
OM, Field Operations Guide (FOG)).
3: Manage and administer Task Force affairs and activities in accordance with accepted
standard business practices.
IV. DIVISION OF RESPONSIBILITY
The Task Force Sponsoring Agency shall be responsible for the following:
1. Ensuring that all equipment and supplies purchased or procured are specifically identified on
the FEMA -approved equipment cache list dated January 28, 2000, or subsequent editions
approved by FEMA.
2. Ensuring that the Task Force maintains and repairs equipment, regularly to ensure operational
capability.
3. Providing technical assistance and information to FEMA US&R program staff.
4,- Ensuring that training courses or other training and exercise activities meet FEMA's
specifications and requirements.
5. Reimbursing personnel salaries and expenses relating to task force development activities, in
accordance with established sponsoring organization policies.
6. Attending FEMA -sponsored US&R meetings, conferences, and training sessions, including
Task Force Leader's meetings.
7. Ensuring that Task Force' members are vaccinated and in good physical condition.
8. Reporting of expenditures for preparedness activities carried out under this agreement.
FEMA will be responsible for the following:
1. Reviewing, approving, and adopting products, including technical manuals, operational
procedures, training curriculum and supporting manuals, meeting agendas, etc.;
2. Providing financial support for approved activities through this cooperative agreement.
3.. Establishing and disseminating policy for the National US&R Response System;

4. Approving and implementing the policy, procedure and evaluation criteria.
5. Determining annual funding levels for preparedness activities described below.
6. Reviewing expenditure reports for this agreement.
7. Approving any cost deviations from those outlined in this agreement.
V. TASK REQUIREMENTS
This agreement is for emergency preparedness measures needed to be able to respond to a
national Urban Search and Rescue disaster activation within a 6 -hour mobilization time -frame.
Reimbursement of disaster response activities is accomplished through a separate cooperative
agreement specifically for that purpose. Under this agreement, the Sponsoring Agency may use
funding to accomplish the following tasks. The selection, priority, and quantity of tasks to be
performed are at the discretion of the Sponsoring Agency, subject to the continuing approval of
the Project Officer.
1. Procurement of US&R equipment and supplies specifically identified on the FEMA -
approved equipment cache list dated January 28, 2000, or subsequent revision approved by
FEMA.
2. Maintenance and repair of US&R equipment that appears on the equipment cache list dated
January 28, 2000 or subsequent revision approved by FEMA, which was purchased with
FEMA funding during a US&R field response, or was acquired with FEMA approval through
the Federal Excess Property Program.
3. Construction, maintenance, or lease of storage facilities and associated equipment for US&R
equipment and supplies.
4. US&R-related training courses for task force personnel, including the development and
delivery of local US&R training courses.
5. Construction, maintenance, or purchase of US&R training facilities or materials
6. Conduct of partial or full-scale US&R exercises and drills, including mobilization drills.
Drills must fall within the scope of US&R Task Force missions identified in FEMA's for
US&R Task Force Operations Manual.
7. Management and administration of US&R day-to-day task force activities, to include
personnel salaries and expenses relating to Task Force maintenance and development, record-
keeping, inventory of equipment, correspondence with Task Force members and parties who
support task force activities, and similar management and administrative tasks.
8. Payment of overtime or related personnel expenses incident to US&R-related training or
exercises involving task force personnel.
9. Travel to and from US&R meetings, conferences, and training sessions, including regional
Task Force Leaders' meetings and Incident Support Team activities.
10. Vaccinations and immunizations required to meet standards outlined by FEMA for US&R
task force personnel.
11. Expenses related to the acquisition, training and certification of US&R search canines and
handlers.
12. ,Costs, including personnel costs, required to prepare for FEMA;, -Sponsored readiness
evaluations and site visits.
Use of grant funds provided through this agreement for: any activity that occurs outside the
Continental United States (CONUS) are expressly prohibited. Therefore, activities outlined
in the Task Requirements above that occur outside CONUS are not allowable expenditures under
this agreement.
Approval for activities or expenditures not identified above must be obtained in advance in
writing from the Project Officer.
VI.. ' REPORTS
1. There are two types of reports required for this agreement, which are a financial report and a
performance report. The financial report (SF 270) is a breakout of expenditures, as shown
below:. ' The Performance Report is a written report of the expenditures. Both reports are due
every 6 months to the FEMA Office of Financial Management, Grants and Acquisition
Support Division and to, the Headquarters US&R Program office for the duration of this
agreement. The'Sponsoring Agency will deliver the first report 6 months after the award and
the second, which will be final report that will be delivered on or before March 2002. Each
report will detail accomplishments and actual expenditures of grant funding by the following
categories and subcategories:

We will be providing an initial allocation of 50% of total grant for FY 2001, which will be
issued for the first half of this agreement. Then after completing anew SF 270 for the
balance and providing a financial report, which shows the expenditure of the initial funding,
the Task Force will receive the remaining balance of funds.

2. For each US&R mobilization drill (of any duration), training activity or exercise delivered
locally of duration of more than 2 days, the Sponsoring Agency will prepare and deliver an
activity report within 30 days following the activity. This report shall include the names of
all participants, a narrative description of the activity including modifications or deviations
from established curricula (where applicable), a brief critique summarizing lessons learned
and recommending changes for improvement, and an accurate summary of the costs
associated with the activity.

You are invited to submit an application for FY 2001 grant funding under the National Urban

In an effort, to make the grant application process less burdensome, this application will cover a
3 -year performance period that will be funded annually. The funding for your organization
under the US&R program for FY 2001 is $150,000. For fiscal years 2002 and 2003, the
estimated funding is $200,000 per year for a total of $550,000 over 3 years. The budget
submitted with your application must support the activities included in your program narrative
and reflect the appropriate use of these funds, by fiscal year, as outlined in the enclosed
statement of work (Enclosure A)
You are to develop a three-year plan for fiscal years 2001, 2002, and 2003. Breakout tasks for
each year will be based on annual availability of funds and awarded without additional
submission of a Budget Narrative Statement unless your budget changes or FEMA deems it
necessary to request a revised budget from the grantee. A streamlined application package will
be required for each subsequent award of funds. Please be advised that if funding is not
appropriated by the U.S. Congress for the remaining two years, the grant will be terminated.
Funding for subsequent fiscal years is also dependent upon FEMA's determination of
satisfactory performance. The multi-year plan must be submitted with your application package
by March 30, 2001

Certifications are provided for your use (Enclosure B).

ARTICLE I — PROJECT DESCRIPTION
The Grantee shall furnish the necessary personnel, materials, services, equipment, facilities and
otherwise do all things necessary for the performance of the work set forth in the Program
Narrative.
ARTICLE II — PERIOD OF PERFORMANCE
The period of performance shall be from the effective date of this cooperative agreement through
the following twelve (12) months.
ARTICLE III — AMOUNT AWARDED
This agreement is for the administration and completion of an approved National Urban Search
and Rescue.(US&R) Response System. Agreement -funds shall not be used for other purposes.
The scope and conditions of the tasks to be undertaken by the Grantee with the amount of money
identified in block 14 of the coversheet (FEMA Form 40--;2l),," ASSISTANCE AMOUNT"
during the time identified as the "PERFORMANCE PERIOD" are contained in the Statement of
Work.

ARTICLE IV — REQUEST FOR REIMBURSEMENT
A. FEMA uses the Direct Deposit/Electronic Funds Transfer (DD/EFT) method of payment
to Recipients. To enroll in the DD/EFT,, the Grantee must complete a Standard Form
I I99A, Direct Deposit Form.
B. The Grantee may be paid in advance, or reimbursed by completing the Standard Form
SF -270, Request for Advance or Reimbursement. In accordance with Treasury
regulations at 31 CFR 205, the Grantee must maintain,or demonstrate the willingness and
ability to maintain procedures to minimize the time elapsing between the transfer of the
-funds and their expenditure. The timing and amount of cash advances should be as close
as administratively possible to the actual cash disbursement by the Grantee. Grantees that
require an advance may submit an original and two copies of SF —270 at the time of
award for,up to $75,000. Submit additional SF -270's as needed, to request remaining

funds for a total award amount of $150,000.
ARTICLE V — FINANCIAL REPORTS
Standard Form 270, Request for Advance or Reimbursement, will be used in lieu of the Standard
Form 269, Financial Status Report, for reporting purposes.
A final FEMA Form 20-10, Financial Status Report, will be due 90 days after project
completion. Copies of the FF 20-10 are to be submitted to the FEMA Office of Financial
Management, Grants and Acquisition Support Division with a copy to the FEMA program office.

Performance reports are due to the FEMA Office of Financial Management, Grants and

six (6) months thereafter. A final report will be submitted to the FEMA Office of Financial
Management, Grants and Acquisition Support Division and to the Headquarters program office
listed in Article V, 90 days after project completion. Refer to Section VI of the attached
Statement of Work for specific instructions.
ARTICLE VII — FEMA OFFICIALS
A. FEMA officials for the US&R agreement are as follows:
1. The Program Officer (PO) shall be an official at FEMA Headquarters who will be
responsible for the technical monitoring of the stages of work and technical performance
of the activities described in the Statement of Work.

2. The Assistance Officer (AO) s.the FEMA official who has -full. authority to negotiate,
administer and execute all business matters of the agreement.

ARTICLE VIII — BUDGET
A. The Grantee shall follow prior approval. requirements found in the Emergency Management
and Assistance Regulations, 44 CFR Part 13.30. for non -construction grants, transfers of
funds between total direct cost categories in the approved budget shall receive the prior
approval of FEMA when such cumulative transfers' among those direct cost categories
exceed ten percent of the total budget. The Grantee shall obtain prior written approval for
any budget revision that would result in the need for additional funds. If a cooperative
agreement provides funding for both construction and non -construction activities, the
Grantee must obtain written approval from FEMA before making any fund or budget
transfer from non -construction to construction or vice versa.
B. No transfer of funds to agencies other than those. identified in the approved cooperative
agreement application shall be made without prior approval. of. FEMA.
C. If a Grantee estimates that it will have unobligated funds remaining after the end of the
performance period, the Grantee should report this to FEMA Headquarters at the earliest
possible time and ask for disposition instructions.
D. No monetary increase amendments hereto, or time extension amendments hereto, will be,
approved unless all .financial or performance reports are current.
ARTICLE IX — OTHER TERMS AND CONDITIONS
The other terms and conditions of this agreement are as follows:
A. Prior to the start of any construction activity, the Grantee shall ensure that all applicable
Federal, State, and local permits and clearances are, obtained. .
B. Grantees are encouraged to integrate National Environmental Policy Act (NEPA) compliance
and related legislation as implemented under 44CFR, Part 10, with the initial planning and
decision making process for this program. Grantees are encouraged to seek support from
FEMA Environmental Officers in complying with NEPA 'requirements.
C. The Grantee shall transfer to FEMA the appropriate share, based on the Federal support
percentage, of any refund, rebate, credit of other amounts arising from the performance of
this agreement, along with accrued interest, if any. The Grantee shall take necessary action
to effect prompt collection of all monies due or which may.become due and to cooperate with
FEMA in any claim or suit in connectionwith amounts due.
D. The Grantee is free to copyright any original work developed in the course of or under the

agreement. FEMA reserves a royalty -free, non-exclusive and irrevocable right to reproduce,
publish, or otherwise use, and to authorize others to use, the work for Government program
purposes. Any publication resulting from work performed under this agreement shall include
an acknowledgement of FEMA's financial support and a statement that the publication does .
not necessarily reflect FEMA's views.
ARTICLE X — AUDIT REQUIREMENTS
All Grantees and Subgrantees must follow the audit requirements of OMB Circular No. A-133
Revised.

NATIONAL URBAN SEARCH AND RESCUE RESPONSE SYSTEM
TASK FORCE PREPAREDNESS COOPERATIVE AGREEMENT
STATEMENT OF WORK
I. BACKGROUND
The Federal Emergency Management Agency (FEMA), in cooperation with other federal, State,
and local agencies, created The National Urban Search and Rescue (US&R) Response System to
provide a national heavy rescue capability that provides lifesaving resources to victims of
structural collapse. It was particularly designed to rescue victims entrapped in collapsed
structures of heavy reinforced concrete construction. When this System was developed in 1990,
there was limited capability in only a few States to perform this mission, and no resources
available for a national response.
In 1992, The Federal Response Plan was published by FEMA and coordinated with 26 federal
agencies. The federal government's response to disasters was classified into 12 Emergency
Support Functions. ESF-9, Urban Search and Rescue was established with FEMA as the
Primary Agency. FEMA maintains a national consensus on standard operating procedures,
organizational structure, equipment, training, and exercise requirements. Currently, 27 local
sponsoring agencies in 18 States participate in the National US&R Response System by making
their US&R Task Forces available for national disaster assignments.
Since FEMA had no organic heavy rescue capability of its own and the best sources for US&R
knowledge and skill reside at the State and local levels, The National Urban Search and Rescue
Response System was developed as a federal—State—local partnership, based on a system of
Memoranda of Agreement (MOA) and Comprehensive Cooperative Agreements (CCA). While
the MOAs provided the basic operational "contract" between FEMA, the State, and sponsoring
agency, the CCAs provided the mechanism for channeling federal grant funds through each
participating State to the sponsoring agencies for National US&R Task Forces. In Fiscal Year
1996, the Performance Partnership Agreement replaced the CCAs. In Fiscal Year 1997, the
Agency decided to fund preparedness efforts of the US&R Task Forces through individual
cooperative agreements with the sponsoring organizations of each of the nation's 27 Task Forces.
II. PURPOSE
The purpose of this agreement is to continue the development and maintenance of National
US&R Response System resources to be prepared to provide qualified, competent US&R
personnel in support of ESF-9 activities under the Federal Response Plan. Specifically, this
agreement provides a mechanism for distribution of grant funding for certain purposes in
preparation for disaster response. Funds are being made available to accomplish the following
objectives.

III. OBJECTIVES
1. Equip the task force in accordance with FEMA approved cache list dated January 28, 2000
and subsequent revisions approved by FEMA to perform National US&R mission
assignments as described in the Urban Search and Rescue Response System Task Force
Operations Manual (TF OM).
2. Train Task Force members and other National US&R Response System personnel to perform
assigned US&R duties in accordance with established, FEMA, approved standards (e.g., TF
OM, Field Operations Guide (FOG)).
3. Manage and administer Task Force affairs and activities in 'accordance with accepted
standard business practices.
IV. DIVISION OF RESPONSIBILITY
The Task Force Sponsoring Agency shall be responsible for the following:
1. Ensuring that all equipment and supplies purchased or procured are specifically identified on
the FEMA -approved equipment cache list dated January 28, 2000, or subsequent editions
approved by FEMA.
2. Ensuring that the Task Force maintains and repairs equipment regularly to ensure operational
capability.
3: 'Pro viding.technical assistance and information to FEMA.US&R program staff.
4. Ensuring that training courses or other training and exercise activities meet FEMA's
specifications and requirements. ,
5.: Reimbursing personnel salaries'and expenses relating to task force development activities, in
accordance with established sponsoring organization policies.
6. Attending FEMA -sponsored US&R meetings, conferences, and training sessions, including
Task Force Leader'smeetings.
7. Ensuring that Task Force members are vaccinated and in good physical condition.
8. Reporting of expenditures for preparedness activities carried out"under this agreement.
FEMA will be responsible for the following:
1. Reviewing, approving, and adopting products, including technical manuals, operational
procedures, training curriculum and supporting manuals, meeting agendas, etc.;
2. Providing financial support for approved activities through this cooperative agreement.
3. Establishing and disseminating policy for the National US&R Response System;
4. Approving and implementing the policy, procedure and evaluation criteria.
5. Determining annual funding levels for preparedness activities described below.
6. Reviewing expenditure reports for this agreement.
7. Approving any cost deviations from those outlined in this agreement.
V. TASK REQUIREMENTS
This agreement is for emergency preparedness measures needed to be able to respond to a
national Urban Search and Rescue disaster activation within a 6 -hour mobilization time -frame.
Reimbursement of disaster response activities is accomplished through a separate cooperative
agreement specifically for that purpose. Under this agreement, the Sponsoring Agency may use
funding to accomplish the following tasks. The selection, priority, and quantity of tasks to be
performed are at the discretion of the Sponsoring Agency, subject to the continuing approval of
the Project Officer.
1. Procurement of US&R equipment and supplies specifically identified on the FEMA -
approved equipment cache list dated January 28, 2000, or subsequent revision approved by
FEMA.
2. Maintenance and repair of US&R equipment that appears on the equipment cache list dated
January 28, 2000 or subsequent revision approved by FEMA, which was purchased with
FEMA funding during a US&R field response, or was acquired with FEMA approval through
the Federal Excess Property Program.
3. Construction, maintenance, or lease of storage facilities and associated equipment for US&R
equipment and supplies.
4. US&R-related training courses for task force personnel, including the development and
delivery of local US&R training courses.
5. Construction, maintenance, or purchase of US&R training facilities or materials.
6. Conduct of partial or full-scale US&R exercises and drills, including mobilization drills.
Drills must fall within the scope of US&R Task Force missions identified in FEMA's for
US&R Task Force Operations Manual.
7. Management and administration of US&R day-to-day task force activities, to include
personnel salaries and expenses relating to Task Force maintenance and development, record-
keeping, inventory of equipment, correspondence with Task Force members and parties who
support task force activities, and similar management and administrative tasks.
8. Payment of overtime or related personnel expenses incident to US&R-related training or
exercises involving task force personnel.

9. Travel to and from US&R meetings; conferences, and training sessions, including regional
Task Force Leaders' meetings and Incident Support Team activities.
10. Vaccinations and immunizations required to meet standards outlined by FEMA for US&R
task force personnel.
11. Expenses related to the. acquisition, training and certification of US&R search canines and
handlers.
12 -Costs, including personnel costs, required to prepare for FEMA -Sponsored -readiness
evaluations and --site visits.
Use of grant funds provided through this agreement for any activity that occurs outside the
Continental United States. (C ONUS) are expressly prohibited. Therefore,. activities outlined
in the Task Requirements above that occur outside CONUS are not allowable expenditures under
this agreement:.
Approval for activities or expenditures not identified above must be obtained in advance in
writing from the Project Officer,
VI. REPORTS
1. There are two types of reports required for this agreement, which are a financial report and a
performance report. The, financial report (SF 270) is a breakout of expenditures, as shown
below. The Performance Report.is a written report of the expenditures. Both reports are due
every 6 months to the FEMA Office of Financial Management, Grants and Acquisition
Support Division and to the Headquarters US&R Program office for the duration of this
agreement. The Sponsoring Agency will deliver the first report 6 months after the award and
the second, which will be final report that will be delivered on or before March 2002. Each
report will detail accomplishments and actual expenditures of grant funding by the following
categories and subcategories:

2. For each US&R mobilization drill (of any duration), training activity or exercise delivered
locally of duration of more than 2 days, the Sponsoring Agency will prepare and deliver an
activity report within 30 days following the activity. This report shall include the names of
all participants, a narrative description of the activity including modifications or deviations
from established curricula (where applicable), a brief critique summarizing lessons learned
and recommending changes for improvement, and an accurate summary of the costs
associated with the activity.
