AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING ORDINANCE NO. 11000, AS AMENDED, THE
ZONING ORDINANCE OF THE CITY OF MIAMI, BY
AMENDING ARTICLE 6, SECTION 602, TO MODIFY
PROVISIONS REGARDING PARKING WITHIN THE SD -2
COCONUT GROVE CENTRAL COMMERCIAL DISTRICT
("DISTRICT") TO ALLOW FOR OFFSITE PARKING
WITHIN THOSE PORTIONS OF THE DISTRICT WHICH
LIE WEST OF MARGARET STREET, MIAMI, FLORIDA;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Miami Planning Advisory Board, at its meeting
of January 31, 2001, Item No. 9, following an advertised hearing,
adopted Resolution No. PAB 18 -01,, -by a vote of six to zero (6-0),
RECOMMENDING APPROVAL of amending Zoning Ordinance No. 11000 as
hereinafter set forth; and
WHEREAS, the City Commission after careful, consideration of
this matter deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to amend
Ordinance No. 11000 as hereinafter set forth;

NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section:
Section 2. Ordinance No. 11000, as amended, the Zoning
Ordinance of the City of Miami, Florida, is amended by amending
the text of•.said Ordinance as follows:l/
"ORDINANCE NO. 11000
ARTICLE 6. SPECIAL DISTRICTS
Sec. 602., Coconut.Grove Central Commercial District.
602.10.4 Off-site Parking.
602.10.4.1. For portions of SD -2 located east
of Margaret Street:
1. For all nonresidential development, all required
parking may be permitted off-site anywhere within
that part of the SD -2 district that lies east of
Margaret Street, or that portion of the G/I
district, as designated by the City of Miami's
Official Zoning Atlas, in Coconut Grove which is

bounded by Charles Avenue on the south, and Main
Highway on the east and presently occupied by the
Coconut Grove Playhouse, after a certificate of
occupancy is issued for a parking garage within
such portion, subject to an annually renewable
Class I Special Permit which shall be accompanied
by an updated parking calculation survey;
provided, however: (a) that such required off-site
parking shall not be located on any property for
which subsidies or other financial assistance was
or is obtained from the Coconut Grove Parking
Trust Fund as described in chapter 35 of the City
Code; (b) that such parking is not required for
any other use on the subject property. All leases
under this section shall be in recordable form and
approved by the city attorney's office and filed
with the zoning administrator prior to each
issuance and renewal'of Class I Permit.
2. All off-site parking arrangements outside of the
SD -2 district shall be terminated upon expiration
of existing leases or phased out over a period of
thirty-six (36) months commencing from January 1,
1997, whichever occurs earlier. Parking spaces
which are required and located off-site as well as
outside of the SD -2 district at that time shall
come into compliance with the provisions set forth
herein. However, that certain parcel of land
designated G/I by the City of Miami's Official
Zoning Atlas that is located in Coconut Grove and,
more particularly, bounded by Charles Avenue on
the south, and Main Highway on the east and is
presently occupied by the Coconut Grove Playhouse,
shall continue to be eligible for off-site parking
arrangements pursuant to subsection 1., above.
602.10.4.2. For portions of SD -2 located west
of Margaret Street:
1. For all nonresidential development, all required
parking may be permitted off-site anywhere within
that part of the SD -2 district or adjoining SD -12
district that lies west of Margaret Street,
subject to an annually renewable Class I Special
Permit which shall be accompanied by an updated
parking calculation survey; provided, however that
such parking is not required for any other use on

the subject property. All leases under this
section shall be in recordable form and approved
by the city attorney's office and filed with the
zoning -administrator prior to each issuance and
renewal of Class I Permit.
Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 4. If any - section, part of section,
paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance
shall not be affected.
Section 5. This Ordinance shall become effective
thirty (30) days after final reading and adoption thereof."
PASSED ON FIRST READING BY TITLE ONLY this 29th day.

This ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein,. whichever is later.

SECOND READING
PETITION Consideration of amending Ordinance 11000, as amended, the
Zoning Ordinance of the City of Miami, Florida by amending
Article 6, Section 602 in order to modify provisions related to
parking requirements in the wester portions of the SD -2 Coconut
Grove Central Commercial Districts.
PLANNING
RECOMMENDATION Approval.
BACKGROUND AND This amendment is being proposed in order to allow for
ANALYSIS more flexibility and development incentives within portions of
SD -2, which lie in the West Grove area (west of Margaret Street).
The way this section of the current ordinance reads, these areas
are not permitted to utilize offsite parking in the same manner as
the Central Grove area, nor are variances permitted, even in
cases where hardship exists. The West Grove area has been
economically challenged and in order to promote development,
the city is proposing this amendment to allow for more options
in resolving parking issues for new or rehab development in this
area.
