I 204k AN ORDINANCE OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT, AMENDING PAGE NO. 35 OF THE ZONING ATLAS OF THE CITY OF MIAMI, FLORIDA, BY CHANGING THE ZONING CLASSIFICATION FROM "R-2 TWO FAMILY RESIDENTIAL" TO "R-3 MULTIFAMILY MEDIUM DENSITY RESIDENTIAL" FOR THE PROPERTIES LOCATED AT APPROXIMATELY 1650, 1651 AND 1675 NORTHWEST 2ND STREET, 1639, 1651, 1658 AND 1670 NORTHWEST 3RD STREET, 1652 AND 1690 NORTHWEST 4TH STREET, 1653 NORTHWEST 5TH STREET AND 115-117, 191-193, 221, 227 AND 329 NORTHWEST 17TH AVENUE, MIAMI, FLORIDA; MAKING FINDINGS; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Planning Advisory Board, at its meeting of January 17, 2001, Item No. 2, following an advertised hearing, adopted Resolution No. PAB-02-01, by a five to zero (5-0) vote, RECOMMENDING APPROVAL of a change of zoning designation, as hereinafter set forth; and WHEREAS; the City Commission, after careful consideration of this matter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this change of zoning classification as hereinafter set forth; sia c A-CHMENT (S) CONTAINED OF.Ili.,1.'r ytl,n 12040 NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Zoning Atlas of Ordinance No. 11000, as, amended, the Zoning Ordinance of the City of Miami, Florida, Page 35, Article 4, Section 401, Schedule of District Regulations, is amended by changing the zoning classification from "R-2 Two Family Residential to 11R-3 Multifamily Medium Density Residential" for the properties located at approximately 1650, 1651 and 1675 Northwest 2nd Street, 1639, 1651, 1658 and 1670 Northwest 3rd Street, 1652 and 1690 Northwest 4th Street, 1653 Northwest 5th Street and 115-117, 191-193, 221, 227 and 329 Northwest 17th Avenue, Miami, Florida, more particularly described on "Exhibit A," attached and incorporated. Section 2'. It is found that the proposed change is consistent with the intent of the area and will not impose an adverse impact on the adjacent community. It is also found that the change: (a) is in conformity with the adopted Miami Comprehensive Neighborhood Plan; (b) is not contrary to the established land use pattern; (c), will not create an isolated district unrelated to adjacent and nearby districts; Page 2 of 4 1P040 (d) will not materially alter the population density pattern or increase or overtax the load on public facilities such as the said school; and (e) is necessary due to the inconsistency with the current zoning and the actual use of the properties. Section 3. Page No. 35 of the Zoning Atlas, made a part of Ordinance No. 11000, as amended, the Zoning Ordinance of the City of Miami, Florida, by reference and description in said Ordinance, is amended to reflect the changes made necessary by this Amendment. Section 4. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 5. If any section, part of section, paragraph, clause, phrase, or word of this Ordinance is declared invalid, the remaining provisions.of this Ordinance shall not be affected. Section 6. This. The following findings have been made: • The proposed change will provide consistency between the Future Land Use Map of the Miami Comprehensive Neighborhood Plan 1989-2000 and the Zoning Atlas of Zoning Ordinance 11000, in conjunction with the orderly growth of the subject area. • It is found that the subject area is bounded by Ir Avenue and another Medium density multifamily residential area which surrounds the Miami Orange Bowl; the change to Medium density multifamily residential is a logical extension of this category up to 17" Avenue. • It is found that many of the individual properties within the subject area have multifamily facilities located on site, therefore the proposed recommendation is consistent with the actual use 'of the said properties. • It is found that the proposed designation is consistent with the intent of this primarily medium density residential neighborhood, and will not have an adverse effect on the said property.
