ORDINANCE NO. o 8
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING ORDINANCE NO. 11970, THE
ANNUAL APPROPRIATIONS FOR FISCAL YEAR ENDING
SEPTEMBER 30, 2001, FOR THE PURPOSE OF
ADJUSTING SAID APPROPRIATIONS RELATING TO
OPERATIONAL AND BUDGETARY REQUIREMENTS FOR
THE VIRGINIA KEY BEACH PARK TRUST;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11970,
as amended, establishing revenues and appropriations for the
City of Miami, Florida, for Fiscal Year ending September 30,
2001; and
WHEREAS, the.City Commission adopted Ordinance No. 12003 on
December 14, 2000, creating the Virginia Key Beach Park Trust 'to
serve in an advisory capacity to the City Commission concerning
the development and use of Virginia Key Beach; and
WHEREAS, it is necessary to establish an operating budget
and appropriate funds in the amount of $333,149 for expenditures
during the current fiscal year for the Virginia Key Beach Park
Trust;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:

Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11970, as amended, adopted
September 28, 2000, the Annual Appropriations Ordinance for
Fiscal Year ending September 30, 2001, is further amended in the
following particulars:.1/

Section 1. The following appropriations are' made for
the municipal operation's of the General Fund for Fiscal
Year ending September 30, 2001:

Section 2. The above appropriations for the General
Fund are made based on the following sources of revenues
for Fiscal Year ending September 30, 2001:

Section 3. All ordinances or parts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this Ordinance are repealed.

Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid,
the remaining provisions of this Ordinance shall not be
affected.
Section 5. This Ordinance is declared to be an
emergency measure on the grounds of urgent public need for the
preservation of peace, health, safety, and property of the City
of Miami, and upon the further grounds of the necessity to make
the required and necessary payments to its employees and
officers, payment of its debts, necessary and required purchases
of goods and supplies and to generally carry on the functions
and duties of municipal affairs.
Section 6. The requirement of reading this Ordinance on.
two separate days is dispensed with by an affirmative vote of
not less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon its adoption and signature of the Mayor .2/
z/ If the Mayor does not sign this Ordinance, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission. .

It is respectfully requested that the City Commission adopt the attached Emergency Ordinance
amending Ordinance 11970, the annual Appropriations Ordinance for the fiscal year ending
September 30, 2001.
BACKGROUND
On December 14,2000 the City Commission passed Ordinance 12003, creating the Virginia Key
Park Trust. This board is to serve in an advisory capacity on the development of Virginia Key. At
this time it is necessary to establish an operating budget and appropriate funds in the amount of
$333,149 for this fiscal year.
