ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A NEW SPECIAL REVENUE FUND
ENTITLED: "DERELICT VESSEL REMOVAL GRANT
PROGRAM FUND," AND APPROPRIATING FUNDS IN
THE AMOUNT OF $48,687.58 CONSISTING OF A
GRANT FROM THE FLORIDA FISH AND WILDLIFE
CONSERVATION COMMISSION; AUTHORIZING THE
CITY MANAGER TO ACCEPT THE GRANT AWARD AND
TO EXECUTE THE NECESSARY DOCUMENTS, IN A
FORM ACCEPTABLE TO THE CITY ATTORNEY, FOR
ACCEPTANCE OF THE GRANT; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, Section 376.15(2)(b), Florida Statutes, authorizes
the Florida Fish and Wildlife Conservation Commission to provide
grants to coastal local governments for the removal of derelict
vessels from waterways; and
WHEREAS, the City of Miami (the "City") desires to remove
certai.n designated derelict vessels in the Miami River and
Biscayne Bay which threaten public health and safety,
navigation,. the environment, and the aesthetics of the general
vicinity; and

WHEREAS, the
Florida Fish and Wildlife Conservation
Commission has awarded the City a grant for the removal of
derelict vessels from the public waterways;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1.
The recitals and findings contained in the
Preamble to this
Ordinance are adopted by reference and
incorporated as if
fully set forth in this Section.
Section 2.
The following Special Revenue Fund is
established and resources are appropriated as described herein:
FUND TITLE:
Derelict Vessel Removal Grant Program Fund
RESOURCES:
Florida Fish and Wildlife
Conservation Commission $48,687.58
APPROPRIATION:
$48,687.58
Section 3.
The City Manager is authorized'I to accept
said grant and execute
the necessary documents, in a form
acceptable to the
City Attorney, with the Florida Fish and
Wildlife Conservation Commission for acceptance of the grant.
Section 4.
All- ordinances or parts of ordinances
insofar as they
are inconsistent or in conflict with the
provisions of this
Ordinance are repealed.
Section 5.
If any section, part of section, paragraph,
clause, phrase or
word of this Ordinance is declared invalid,

the remaining provisions of this Ordinance shall not be

Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof .21

Wildlife Conservation Commission

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached Ordinance establishing
a new special revenue fund entitled: "Derelict Vessel Removal Grant Program," appropriating funds
in the amount of $48,687.58 for said funds from a grant received by the Florida Fish and Wildlife
Conservation Commission, and authorizing the City Manager to execute such documents, as
acceptable to the City Attorney, to implement said grant.
BACKGROUND
The City of Miami has designated specific derelict vessels in the Miami River and in Biscayne Bay
which pose a threat to public health and safety, navigation, the environment and/or the aesthetic
condition of the general vicinity. The Department of Conferences, Conventions and Public
Facilities has applied for grant funds, and the Florida Fish and Wildlife Conservation Commission
has awarded a grant to the City in the amount of $48,687.58 to remove derelict vessels from these
waterways. The Department recommends that a Special Revenue Fund be established, "Derelict
Vessel Removal Grant Award" and the City Manager execute the necessary documents to
implement said grant award.
