ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 10, ARTICLE I, OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED,.
ENTITLED "BUILDINGS, BUILDING PERMIT FEE
SCHEDULE", WHICH SETS FORTH FEES FOR
BUILDING, PLUMBING, ELECTRICAL, MECHANICAL,
(INCLUDING BOILER AND ELEVATOR) INSPECTIONS,
PERMITS AND CERTIFICATES, TO: (1) ELIMINATE
CERTAIN SERVICES AND FEES WHICH ARE NO LONGER
WITHIN THE PURVIEW OF THE CITY OF MIAMI, (2)
COMPLY WITH PROVISIONS OF THE SOUTH FLORIDA
BUILDING CODE, (3) COVER THE COSTS OF
PERFORMING CERTAIN REVIEWS AND ENFORCEMENT,
AND (4) CLARIFY, MODIFY, AND ELIMINATE
CERTAIN SERVICES AND FEES; MORE PARTICULARLY
BY AMENDING, REPEALING OR ADDING CERTAIN
SUBSECTIONS TO SECTION 10-4 OF THE CODE;
CONTAINING A REPEALER PROVISION, SEVERABILITY
CLAUSE, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City of Miami (the "City") administration has
conducted a thorough study of building permit reviews and
corresponding fees currently conducted and billed by the City and
neighboring municipalities; and
WHEREAS, based on the study's results, the City Manager
recommends,. and the City Commission finds, that certain
amendments should be made to the City's Building Permit Fee
Schedule to: (1) eliminate certain services and corresponding

fees which are no longer within the purview of the City of Miami,
(2) comply with the provisions of the South Florida Building
Code, (3) cover the costs of performing certain reviews and
enforcement, and (4) clarify,
services and corresponding fees;
modify, and eliminate certain
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Chapter 10, Article 1, of the Code of the
City of Miami, Florida, as amended, is amended in the following
particulars:l/
"CHAPTER 10
ARTICLE I. IN GENERAL
Sec. 10-4. Building Permit Fee Schedule.
(a) Fee for work without permit. When work is
commenced prior to obtaining a required permit, a fee of
two (2) times that specified in this Section plus $100
shall be paid. The payment of such fee shall not relieve
any person, firm or corporation from fully complying with
all of the requirements of all applicable regulations and

codes, nor shall it relieve them from being subject to any
of the penalties therein. The fee requirement shall be
applicable to all divisions of the building and zoning
department.

(b) General fees.
(1) Solid waste surcharges.
c. Exemptions. The following permits are
exempt: sign, landscape, elevator,
revisions, residential painting
permits, and subsidiary permits.
Affordable housing shall be exempt
providing that proper certification
from the director of the community
development department is presented
at the time plans are reviewed.
(4) Recertification of plans and revised
plans fee; permit card replacement.
e. Replacement of lost permit card or

f. Expedited plans review service for
special projects. A "special project"
is defined as a project having a
development order, or any other
project as determined by the City
Manager, or -his designee, as having
special interest to the City. The

review will be the preferred method.

(5) Dry run fee/upfront fee. Review of

Eighty percent of the total amount of
the dry run fee and one hundred
percent of the upfront fee will be
credited to the building permit when
issued. No credit will be given if
after review, a substantial new design
is submitted for review, or a permit
is not issued within 180 days of last
review. No refunds will be allowed.
(6) Certificate of occupancy and certificate of
use.
e. Occupation prior to obtaining
certificate. When a building is
occupied prior to obtaining a
temporary or final certificate of
occupancy, a fee double the permit
certificate amount plus a $100.00
fine shall be paid. The payment of
such fee shall not relieve any
person, firm or corporation from
fully complying with all of the
requirements of all applicable
regulations and codes, nor shall it
relieve them from being subject to
any of the penalties therein.
(7) Application fee

(13) Test for smokeproof towers and smoke
removal systems:

prescribed by the building and
zoning department on a one (1) time
and/or annual basis for smoke
removal or approved pressurized
systems in stair tower, atrium or
similar areas:

Section 3. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 5. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.al
z/ This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it- shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

It is respectfully recommended that the City Commission adopt the attached Ordinance
amending Section 10-4 of the Code of the City of Miami, as amended.
BACKGROUND
The attached ordinance was passed on first reading during the February 8, 2001 commission
meeting. During that time, there was a discussion regarding the fees being charged for residential
painting permits. After analyzing the charges, the department has decided to reduce the fees by
allowing that residential permits to be exempt from the following: 1) No minimum fee, 2) No
Solid Waste surcharge fee, and 3) No permit application fee.
The above exemptions will allow compliance with the code by still requiring that a permit be
obtained by anyone meeting the minimum requirements for a painting permit, but at a reasonable
cost to homeowners. The example below of actual permit charges reveals the impact:
