ORDINANCE NO.
AN EMERGENCY ORDINANCE OF THE MIAMI CITY
COMMISSION AMENDING SECTION 7 OF ORDINANCE
NO. 11970, THE ANNUAL APPROPRIATIONS AND
CAPITAL IMPROVEMENT PROJECTS ORDINANCE FOR
FISCAL YEAR ENDING SEPTEMBER 30, 2001, FOR
THE PURPOSE OF INCREASING APPROPRIATIONS ,IN
THE AMOUNT OF $500,000 TO CAPITAL IMPROVEMENT
PROJECT NO. 324002, ENTITLED "ORANGE BOWL
STADIUM RAMPS AND IMPROVEMENTS," FROM
$1,250,400 TO $1,750,400; CONTAINING A
REPEALER PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, the City Commission adopted Ordinance No. 11970,
the Annual Appropriations and Capital. Improvement Projects
Ordinance, on September 28, 2000, establishing revenues and
appropriations for the City of Miami, Florida, for Fiscal Year
ending September 30, 2001; and
WHEREAS, due to the age of the structure, various areas at
the Orange Bowl Stadium have been identified as exhibiting severe
deterioration, which presents a threat to the safety and welfare
of the public; and
WHEREAS, it is most important to perform remedial repairs to
the identified areas prior to the next football season, with
funds appropriated, on an emergency basis from Capital Project
120625

No. 324002, entitled "Orange Bowl Stadium Ramps and Improvements
in the amount of $500,000;"
NOW, THEREFORE', BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Ordinance No. 11970 adopted September 28,
2000, the Annual Appropriations and Capital Improvements Projects
Ordinance for Fiscal Year ending September 30, 2001, is amended
in the following particulars:!/
"ORDINANCE NO. 11970
Section 7. Section 6 of Ordinance No. 11705, as amended,
adopted September 28, 1998, and Section 5 of Ordinance No. 11839, as
amended, adopted September 28, 1999, are hereby further amended in
the following particulars to revise previously approved Projects and
establish new Projects to be initiated during Fiscal Year 2000-
2001:2/

the thousands of dollars.

Section 3. All ordinances or parts of ordinances,
insofar as they are in conflict with provisions of this Ordinance
are repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provision of this Ordinance shall not be affected.
Section 5. This Ordinance is declared to be an emergency
measure on the grounds of urgent public need for the preservation
of peace, health, safety, and property of the City of Miami,. and
upon the further grounds of the necessity to make the required
and necessary payments to its employees and officers, payment of
its debts, necessary and required purchases of goods and supplies
and to generally carry on the functions and duties of municipal
affairs.

Section 6. The requirement of reading this Ordinance on
two separate days is dispensed with by an affirmative vote of
not less than four-fifths of the members of the Commission.
Section 7. This Ordinance shall become effective
immediately upon adoption and signature of the Mayor.'

This Ordinance shall become effective as specified herein unless
vetoed by the Mayor within ten days from the date it was passed
and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City
Commission or upon the effective date stated herein, whichever is
later.

It is respectfully requested that the City Commission adopt the attached Emergency Ordinance
amending Ordinance 11970, the annual Appropriations Ordinance for the fiscal year ending
September 30, 2001, by increasing appropriations to Capital Project No. 324002, Orange Bowl
Stadium Ramps and Improvements.
BACKGROUND
While conducting remedial work to the structural framing in the Orange Bowl Stadium's upper
deck, new areas were found showing severe deterioration due to the age of the structure. The
metal deck that conforms the composite system of the. West End concourses, the interior
pedestrian ramps, as well as the concrete walkways in several. locations around the Stadium
present signs of corrosion, sagging, and cracks at the supports. These conditions must be
repaired. It is most important that the identified areas be corrected prior to, the next football
season.
The Department of Public Works will immediately start this remedial work through multiple
contracts so as to accomplish the most critical repairs first. The remedial work will be done so it
will not interfere with the already scheduled events at the Stadium.
The cost of the needed repairs will not exceed $500,000. Funds in this amount have been
identified from an available balance in the 1998 General Fund Contribution to Capital Projects
account. It is necessary to appropriate the funds in Capital Project No. 324002 on an emergency
basis since their availability is critical to the timely completion of the remedial repairs.
