ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
ESTABLISHING A NEW SPECIAL REVENUE FUND
ENTITLED: "SOLID WASTE REDUCTION: RECYCLING
AND EDUCATION (FY'01)" AND APPROPRIATING
FUNDS FOR THE DEVELOPMENT AND IMPLEMENTATION
OF SAME IN THE AMOUNT OF $214,155, CONSISTING
OF TWO GRANTS FROM THE STATE OF FLORIDA
DEPARTMENT OF ENVIRONMENTAL REGULATION: (1)
A RECYCLING AND EDUCATION GRANT IN THE AMOUNT
OF $174,155, AND (2) A WASTE TIRE GRANT IN
THE AMOUNT OF $40,000; AUTHORIZING THE CITY
MANAGER TO ACCEPT THE GRANT AWARDS AND TO
EXECUTE THE NECESSARY DOCUMENTS, IN A.FORM
ACCEPTABLE TO THE CITY ATTORNEY, FOR
ACCEPTANCE OF THE GRANTS; CONTAINING A
REPEALER PROVISION AND SEVERABILITY CLAUSE.
WHEREAS, the State of Florida enacted the 1988 Solid Waste
Management Act requiring counties and cities to develop and
implement recycling programs to achieve a statewide recycling
mandate and certain goals in accordance with Section 43.706(4),
Florida Statutes; and
WHEREAS, pursuant to Resolution No. 89-218, the City of
Miami ("City") entered into an interlocal agreement with
Miami -Dade County, in which the City and other municipalities
agreed to submit a joint grant application with Miami -Dade County

to the State of Florida Department of Environmental Regulation
("FDER") requesting funding for recycling and waste tire projects
to assist in meeting the requirements of the 1988 Solid Waste
Management Act; and
WHEREAS, the FDER, in accordance with the State of Florida
Solid Waste Management Grant Rule No. 17-716, has approved the
City and Miami -Dade County's joint application for Fiscal Year
2001; and
WHEREAS, pursuant to Resolution No. R-542-00, the Miami -Dade
Board of County Commissioners accepted the State of Florida Solid
Waste Management grant award for Fiscal Year 2001 in the amount
of approximately $2.1 million on behalf of the County and
participating municipalities in the joint application for said
grant, and the County Manager executed the grant agreement; and
WHEREAS, the City's portion of the grant funds is $214,155,
and it is now appropriate to establish a special revenue fund in
which to appropriate the grant;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The. recitals and findings contained in the
Preamble to this Ordinance are adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The following Special Revenue Fund is
established and resources are appropriated as described herein:

Section 3. The City Manager is authorized -11 to execute
the necessary documents, in a form acceptable to the City
Attorney, with the State of Florida, Department of Environmental
Regulation, to accept said grants and implement the programs.
Section 4. All Ordinances or parts of Ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are repealed.
Section S. If any section, paragraph, clause, phrase, or
word of this Ordinance is declared invalid, the remaining
provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.21

limited to those prescribed by applicable City Charter and Code

If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

RECOMMENDATION
It is respectfully recommended that the City Commission adopt the attached appropriations
ordinance establishing a Special Revenue Fund Entitled: "Solid Waste Reduction: Recycling and
Education (FY'01)" in the amount of $214,155.00, consisting of a Recycling and Education Grant
and Waste Tire Grant from the State of Florida Department of Environmental Regulation (FDER),
pursuant to the 1988 Solid Waste Management Act, Section 403.7095 Florida Statute and FDER
Grant Rule 17-716.
BACKGROUND
The City of Miami (City) currently has inter -local agreements with Miami -Dade County to allow for
joint applications for two (2) State Grants. The grants are 1) The Recycling and Education Grant
and 2) The Waste Tire Grant.
As a municipal participant in an inter -local agreement by and between the City of Miami and
Miami- Dade County, the City of Miami, per Resolution No. 89-218, agreed to submit a joint grant
application with Miami -Dade County and other municipalities in Miami -Dade County to the FDER
in order to avoid a local match requirement per Section 403.7095 3(c) Florida Statute.
On June 6, 2000 the Miami -Dade County Board of County Commissioners, per Recycling and
Education Grant FY'0041 for Municipal Grant Allocations applied for and accepted on behalf of
the County and those municipalities participating in the joint grant application, a grant award in the
amount of approximately $2.1 million in grant funds from the State of Florida Solid Waste
Management Grant Program for the funding of recycling and waste tire projects. This action
further provides the authorization for the execution of the grant contract (R-542-00), in
substantially the attached form. Said grant agreement provides funding for recycling program
operations and for recycling related educational and promotional purposes.
According to the final grant statement and pursuant to FDER Grant Rule 17-716, only those
expenditures incurred during the funding period will be funded. The method of payment for
recycling program expenditures incurred by the City is based on monthly or quarterly requests for
payment. Only allowable expenses incurred will be approved by the FDER for reimbursement
purposes.

and Budget the need to establish a New Special Revenue Fund entitled "Solid

consisting of a Solid Waste Management Recycling Program and Waste Tire
Program grants from the State of Florida Department of Environmental
Regulation, which will be administered by the Department of Solid Waste.

RECOMMENDATION
It is recommended that the Board approve the attached resolution authorizing the County
Manager to apply for, receive, and expend up to $2.1 million in grant funds from the State of
Florida's Solid Waste Management Grant Program, which will provide an estimated $1.1
million in FY 2000-01 to fund the County's Waste Tire Program, and an estimated $995,700
for the FY2000-01 Recycling and Education Grant. No matching funds from the County'are
required as a condition of receiving these state funds. Both the Waste Tire Grant and the
Recycling and Education Grant will be shared between the Unincorporated Municipal Service
Area (DMSA) and participating municipalities according to the schedule of allowable
expenditures under the Solid Waste Grants Program Rule_
BACKGROUND
The State of Florida Solid Waste Management Grant Program, now in its twelfth year,
provides funding for local recycling and related educational programs and waste tire projects.
Attachment A comprises the application provided by the Florida Department of Environmental
Protection's application for the grant.
The Solid Waste Tire Grant application is a one -part application due to the state on or before
July 1, 2000. The Solid Waste Tire Grant funding will be used to supplement County disposal
fees to cover expenditures associated with the collection, processing and handling of waste
tires, Countywide enforcement activities related to illegally -dumped tires, and cleanup of
abandoned tire facilities. Any remaining funds will be distributed to the municipalities,
including UMSA, based on population and historical use. Municipalities use the grant funds
to reimburse the County for the costs of collection and for disposal charges paid for the use of
County disposal facilities.
The Recycling and Education Grant application process is divided into two parts. Part I, due
on or before July 1, 2000, initiates the application process. Part II, due by October 1, 2000;,.
contains specific information on planned recycling. activities. Recycling and Education Graiit
funds are spent on various recycling activities. DMSA has previously used the funding to
assist in the payment of its mulch collection and distribution program, as well as the curbside

WHEREAS, this Board desires to accomplish the purposes outlined in the accompanying
memorandum, a copy of which is incorporated herein by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNT -i"
COMMISSIONERS OF MIAMI-DADE COUNTY, FLORIDA, that this Board authorizes the
County Manager ito apply for approximately $2.1 million in grant funds from the State of Florida
Solid Waste Management Grant Program for the funding of recycling and waste tire projects to be
made on behalf of Miami -Dade County and those municipalities having agreed to joint
participation through execution of the appropriate Interlocal Agreement; authorizes the Director of
the Department. of Solid Waste Management to sign reimbursement requests for the grant;
authorizes the County Manager to execute such contracts and agreements as are required by this
governmental body following their approval by the County Attorney's Office, to execute such other
contracts as will serve to further the purposes described in the funding request, following their.

approval by the County Attomey's Office, to expend any and all monies received for the purposes
described in the funding request, to receive and .expend any additional funds that might become

modification, renewal, cancellation and tennination clauses 'of any contracts and agreements on
behalf of Miarni-Dade County, Florida.
The foregoing resolution was offered by Commissioner, Dorrin D. Rolle
