ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 2/ARTICLE XI OF THE CODE OF
THE CITY OF MIAMI, FLORIDA, AS AMENDED,
ENTITLED "ADMINISTRATION/BOARDS, COMMITTEES,
COMMISSIONS" TO CHANGE THE; PROCESS BY WHICH
VACANCIES ON THE COMMUNITY RELATIONS BOARD
ARE FILLED; MORE PARTICULARLY BY AMENDING
SECTIONS 2-885 AND 2-1152 OF SAID CODE;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the City Commission wishes to facilitate the
process by which vacancies on the Community Relations Board are
filled;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Chapter 2/Article XI. of the Code of the City
of Miami, Florida, as amended, entitled "Administration/Boards,
Committees, Commissions", is hereby amended in the following
particulars:l/

Division 2. Standards for Creation and Review of
Boards Generally
Sec. 2-885. Terms of Office.
(a) Unless otherwise specifically provided in the
charter or the Code -Tthe terms of office of the members
of each board shall be of one year or until the
nominating commissioner leaves office, whichever occurs
first. When the nominating commissioner leaves office
the board member's term shall expire. Vacancies on
boards shall be filled by the commission for the
unexpired term. Board members shall continue to serve
until their successors have been appointed and
qualified. The provisions of this section shall not
apply to the downtown development authority.

Section 2. All ordinances or parts of ordinances insofar
as they are inconsistent or in conflict with the provisions of
this Ordinance are hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase or word of this Ordinance is declared invalid, the
remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance shall become effective thirty
(30) days after final reading and adoption thereof.�11
PASSED ON FIRST READING BY TITLE ONLY this 14th day of
December 2000.
2/ This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the. date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

Attached is a proposed ordinance to amend Section 2-1152 of the Code of the City of Miami,
Florida, as amended, to provide that vacancies on the Community Relations Board (the `Board') be
filled by the City Commissioner who nominated the member whose position has become vacant, and
that such appointment be effective for the remainder of the unexpired term or until the nominating
Commissioner leaves office.
Presently, Section 2-1152 provides that when a membership vacancy occurs on the Board, the
City Commission ("Commission') shall select the replacement board member from a list of three
candidates to be submitted by the remaining members. of the Board. In the event that none of the three
candidates suggested meets with Commission approval, the Board is required to submit another
entirely different list for Commission consideration, and the process is to continue until a replacement
is appointed. This process has been found to be inefficient, and has hindered the appointment to the
Board of several highly qualified individuals. The Board has requested that this provision be
amended.
