My Integrity has been questioned. I am appalled and disenfranchised by the behavior of the City of Miami's Fire Rescue Department. I am disgusted that they would walk into my or any citizen's home and display this type of racism and racial profiling that I am speaking on today. Supposedly, America is the greatest country in owever, four weeks ago my family and I were placed in a position that shocked and rumbled my faith and trust in this "America the beautiful!" The constitution was written for the people by the people! Mme where along the line the sworn officers of the City of Miami Fire Rescue; -that we entrust our lives to keep us safe have forgotten their sworn duty and commitment to the citizens of the City of Miami. TheConstitution states that all people were created equal. It did not exclude iEORLE who are poor, uneducated, handicapped, varied religious beliefs, use of the color of their skin, or because they live in a specific neighborhood or community. IT STATED, ALL PEOPLEIH The City of Miami has cancer and it has been growing, maturing and developing in the body for the last 20 -years or more. Corruption and scandals have plagued our City government year after year. It has become. an embarrassment to be known as a citizen of Dade County! It's now time for the people to stand up and take back our City and earn the respect we once held in high esteem from the entire world. Dade County was once known as a place where everyone wanted to live, visit or negotiate business deals! We were once a loved and respected city. We stand before the Commission today asking for you as servants of the people for your help, by removing the cancer that is still growing within us. Chief William Bryson needs to removed along with the City Manager, Carlos Gimenez and be replaced with men and women who are of high quality and fully understand and respect the constitution of the United States of America and that will serve the people with honor, respect and Integrity. We go all around the works telling other countries to stop violating human and civil rights. What a hypocrite our government is when it allows and nourishes this type of demoralizing and racial behavior. In closing, we also ask that a formal investigation be launched into the practices and behaviors of the Fire Department against the citizens of the • City. The panel should be from an outside entity, and the citizens from the community should take part in this process. To may dismay, I was because I felt that i was wat. When I woke up, I realized that I lying in a aidlood. I panicked! ... and yelled for my soul I called rescue. The man Irl fitly and quickly turned around and replied, get your hands off me... don'ttouch u4ol My son moved back from him. By this time, I was even more upset because I'm watching the negative and unprofessional behavior of this man grow worse. I asked the team to take me to coral Gables Hospital where I had just been treated for a hernia. They replied, legally we can't take you there... it has to be the closest hospital which is JMH. If you don't go there ... we will have to leave you here! By phone, my daughter persuaded me to go on to JMH and that she would meet me there and then transport me to Coral Gables. Although I decided to go with the • tearn, I was terribly disappointod with their actions because we were not rude to them We gave them no reasons to react that way! Can you imagine being treated this way by someone who is supposedly to be giving you medical attention. I was really frightened by this incident. Moreover, they refused to give me their names And badge numbers. All I know at this point is that they are from RESCUE 9. Now we are at the hospital. They removed me from the ambulance and a Metro -Dade officer was in the lot. I called for him to give we assistance in recording an assault report due to the actions of the rescue attendant at my home0. The officer never approached me; however, he went directly to the rescue team members and began to converse with them. They were laughing and the officer Frank Castillo. The same attendant that was rude and nasty to we and my. son told the officer that I was a stupid bitch and that I could kiss his ass! My back was turned to them, but after hearing those vulgar words,. I looked around and said to officer Castillo, did you hear that and I ask you to come to me to help and you re6rsed to. I asked him for his name and badge number as well. He replied, rm one in five million. He turned laughing and walked out of the emergency room. I am requesting a formal investigation to be launch by the City of Miami Tire Rescue Department, as well as a .formal Investigation to be launch by the Dade County Police Department. I would like to inform the City Manager Carlos A. Girnenez up front that I have informed by members of the community that you way show favoritism to the City of Miami Fire department, because you are former Fire Chief. I have perwaally work with you ire several community projects and I saw you as a fare and compassionate mar that has a great deal ofrespect for your job. I expect you as the New City Manager to now perform your job and be full aware that the eyes ofthe community are on you.. I hope that I can continue to respect you in this same measure as you do your job and address the issue that has been brought to your attention. In short, I am expecting it responsf:: to this matter very soon, and I am demanding that the Caucasian man be removett from our community, If he is going to have this type ofattitude while working, he really should not be working. REFEAENCES' a�lll ryson ENCLOSURES Fire Chief In regards to the complaint from Ms. Hattie Willis (8/15/01 letter, attached), concerning allegations of mistreatment by Rescue 9 B shift, I submit the following: We have had the complaint reviewed and investigated by EMS Chief Charles Maree. Chief Maree spoke with the complainant and all members of the Rescue crew involved. Chief Maree had written responses from the crew submitted in memo form. In addition, I personally spoke with the officer in charge, lieutenant Mike Hosmer. Our findings are that Ms, Willis became quite irritated when she was told that • she would be transported to the closest hospital, instead of Coral Gables hospital, where she wanted to go. This decision of the officer was based upon the amount of blood lost and not knowing the source of the bleeding. When this was communicated, things on the scene became tense. Also, during this time Ms. Willis was under the Impression that her son had been assaulted. She explained this in a phone conversation to Chief Maree and said after discussions with her son, she was incorrect. After the transport location became an issue, there are many conflicting allegations. The only issue we could substantiate is that Ms. Willis asked Lt, Hosmer for the names and badge numbers and Lt. Hosmer, erroneously, referred her to the report field copy for the information, Lt Hosmer has been counseled concerning his mistake in this area. In summary, we feel that the decisions made in this incident were appropriate and within the purview of the officer in charge. Lt. The antics, the screaming, the cries of prejudice, the uncooperative behavior all contributed to making a possibly dangerous situation for the patient exceedingly more difficult to manage. At no time did the crew of Rescue 9 act toward this individual in an unprofessional manner. Never once did I raise my voice, or use foul or abusive language. The accusations this individual is claiming are totally false, • unsubstantiated and have no merit. The crew of Rescue 9 attempted to assess and treat the patient with the best interest of her medical condition and life safety in mind. Our treatment would have been more extensive (IV, oxygen therapy, monitoring) had she allowed us to treat her, but in fact she refused treatment, as well as refusing to answer this officers questions as to medical history, allergies to medications, past medical conditions, etc. Statements such as "we will leave you here to die," are bogus. My response to her and only after she demanded we get out of her house was; " if l leave you here there is a possibility you could die." I cannot determine how extensive your bleeding is. Right now your blood pressure is fine, but that could change." The allegation that I pushed her son up against the wall is a flat out lie. At one point while I was standing in the doorway to the bathroom her son in fact attempted to push this officer out of the way. i did at that point tell him to remove his hand from my shoulder and not touch or push me again. What I should have done was request MPD, Ref. Battery upon a firefighter. I decided not to, feeling the situation was volatile enough and would only result in an even longer delay of transport. It is the opinion of this officer after seeing the amount of blood on the bed that a prolonged transport to Coral Gables Hospital was out of the question. That • coupled with the fact that the patient refused treatment and was uncooperative made it imperative she be seen at the closest capable medical facility. Only after speaking to patient's daughter by phone, did she agree to allow Rescue 9 to transport her to Jackson Memorial Hospital. Upon release at Jackson Memorial Hospital triage she was again screaming and flailing her arms causing so much of a commotion that all three nurses questioned this officer as to why l did not transport this patient to Crisis Intervention for psychiatric care. I instructed the patient that any and all information she requested conceming this alarm could be obtained from the field copy that was given to the triage nurse. As I exited the ER her final words to me were (and I quote) "you won't be smiling when I sue your mother fucking ass." Chief, I have responded to the allegations presented at the time of our meeting on August 15, 2081 It is my understanding during our meeting, that the patient had decided to "change", or "rescind" a portion of the allegations. Having been made aware of this, I strongly question this individual's credibility concerning the entire situation. Having worked in the cities north end for the past twenty-four years my question and concern at this time is, what exactly this individual meant when stating; "i don't want these people working in her community." R-9 found Ms. Willis sitting on the toilet c/o abdominal pain and severe hemorrhaging. Following R -9's assessment, a determination was made that the Pt. had lost a significant amount of blood and should be transported ALS to the nearest facility. The pt. was advised that due to the severity of her condition she would have to be transported to a hospital nearer than her hospital of choice (Coral Gables). The patient immediately became irrational. At this time Ms. Willis phoned a family member and informed her of the situation. Ms. Willis was very emotional during her conversation on the phone, so I • asked Ms. Willis for the phone so that I could advise her faulily member of the situation. At this point, her family member stated it was ok to transport her to JMH and she could meet Ms. Willis in the ER: I then gave the phone back to Ms. Willis. Ms. Willis' accusation of R -9's officer pushing her son is an example her itTational state of mind and of her blowing the situation completely out of proportion. At no time did the officer lay his hands on the pt.'s son. In fact, Ms. Willis' son pushed the officer out of his way in an attempt to make his way into the bathroom. At this moment, the officer turned around and told him to get his hands off him. Furthermore, I feel personally offended by the allegations of prejudice against Ms. Willis. l have worked in district 2, a district that is predominantly African- American, for approximately 3 years. I work in this district because 1, like my partner, who has also been in district 2 for 3 years, and my Lt. who has been here 24 years enjoy coming to work in this neighborhood and helping the residents in our area. BENAVLNTE Upon arrival, Pt. was found in the bathroom sitting on the toilet. The pt, stated that she had surgery performed at Coral Gables hospital for a tumor in her abdomen and had requested 911•,service because of her bleeding wound. R-9 crew proceeded to assess pt., and we found that she had lost a substantial amount of blood. At this point the pt, was advised that she could not be taken to Coral Gables hospital, and bypass 3 nearby hospitals due to the amount of blood noticed on her bed. The pt then became very emotional, uncooperative, and refused to hear what our Rescue crew had to say and ordered us to leave her house. R-9 crew then stated that she needed to be seen by a doctor, if not there would be a possibility of severe complications, At no time did rescue crew make a statement such as '.We will leave you here, so that you will die..'. She then agreed to be transported to JMH after speaking to her daughter over the • phone. The pt. then began to make irrational allegations such accusing the Rescue officer to have pushed her son against the wall, and all of us of being racist. At no time did I witness my officer put a hand on her son. Instead, her son was the one who had pushed my officer. All he did in return was tell him, `Don't touch me or push me again". During transport the pt. refused any treatment and demanded not to be touched or spoken to. The pt was asked questions pertinent to her condition and medical history, allergies etc. but refused to give any information. In reference to the other accusations, I would like to state that I have been working for this department for 2 years and 7 months. The majority of this time has been spent at station 9 serving a predominantly African-Annerican community. It has been my choice to do so. I personally take offense to her accusations of prejudice. GIMENEZ Cky Manaser This letter is to inform you that the Department of Fire -Rescue Is still in the process of investigating of your complaint regarding the Incident that occurred on August 13, 2001 (Alarm #47101). This investigation is riot complete because the Department has had some difficulty contacting the Miami -Dade County Police Officer mentioned In your letter to me. The police officers name was not correct and required additional efforts to identify him. We are also attempting to Identify and obtain statements from the hospital staff members that were on duty. 1 am forwarding this status report to you prior to the completion of the Investigation because I promised you a response today. At this time it would be premature to report on specific issues of the investigation, as it Is not complete. We are working as quickly as possible to arrive at a conclusion, but must use due diligence to ensure fair treatment of all concerns. When this investigation is completed, the Management Services Division will make • a recommendation for discipline. I will take their recommendation into consideration and make a final decision. I am sorry that your experience with the Department of Fire -Rescue was not a positive one. It is our goal to treat the people that we serve as though we were treating a member of our family. If our investigation reveals that we.fell short in this case, the department will do what is necessary to rectify the situation. As a part of that informal review, the EMS Chief Charles Maree spoke with you and all members of the rescue crew individually. Chief Maree has written responses from the crew submitted in memo form. In addition, The Fire Chief, William W. Bryson, personally spoke with the officer in charge, Lieutenant Mike Hosmer. While speaking with Lt. Hosmer, the Fire Chief conn d him on his obligation to provide the badge numbers for himself and his crew upon request. It is up to the paramedics on the scene to determine the safest, most efficient means to remove a patient from their residence and to get them to the rescue truck. The logistics of every scene is different. Therefore, it is not possible to develop a predetermined protocol for these actions. The Rescue crew stated that they assisted you to the stretcher. S. I am also requesting any documents which have any recommendations by those who may have investigated (Chief of EMS, Chief of Management Services, Deputy Chief) and forwarded them to the Fire Chief (Chief Bryson). These documents have been provided. 6. We demand to have Lt. Hosrner removed from our community because of his blatant disrespect and racist attributes and behavior. The Department of Fire -Rescue utilizes an assignment agreement to determine permanent assignment of members. This agreement is contractual and utilizes qualifications and seniority. Members of the department are not assigned or reassigned due to race or ethnicity. The Lieutenant in question has 22 years on the job, all in the north end of town and does not have one citizen complaint in his personnel records. 7. Where is Mr. William's complaint, which was sent to the Fire Chief via Chief Raul Martinez? (See attachment) This leads us to believe that not only are you disregarding our complaints, you are also trashing our complaints! The Department of Fire -Rescue admits that Mr. William's complaint was not handled in a timely manner. The complaint has been investigated and a response has been forwarded to Mr. Williams. To reiterate the Fine Chiefs comments to you in his September 14, 2001 memo, I am sorry that your experience with the Fire Department was not [ MS a positive one. The Department of Fire -Rescue .responds to over 70,000 – 51W(3) calls for service per year. The Department receives approximately 75-100 citizen complaints per year. Expressed as a percentage, this averages out to .0010% to .0014% or one (1) complaint per one thousand calls. Given the difficult nature of Fire -Rescue work, I do not feel these numbers illustrate a pattern of abusive or poor service. When formal investigations are conducted, they are performed by the Management Services Division. Management Services will forward its findings to the Fire Chief along with a recommendation for discipline if it is warranted. 11. Please explain to us your criteria for appointments to Deputy Chief, Assistant Chief and other staff positions within the. Hire Department. The Staff positions within the Department of Fire -Rescue are, Fire Chief, Deputy Fire Chief, Assistant Fire Chief and Executive Assistant to the Fire Chief. The Fire Chief is appointed by and responsible to the City Manager. All other staff positions are appointed by the City Manager upon recommendation from the Fire Chief from within the Department. Anyone within the Department may be selected for these positions. 12. Have you had the opportunity to appoint people to fill any of these positions since you became Fire Chief? During my Tenure as Fire Chief numerous appointments were made to my staff. During Chief Bryson's tenure as Fire Chief, . there has been three (3) staff appointments. 13. If so, did everyone qualified have an opportunity to compete for the position or positions? The Fire Chief can recommend to the City Manager any member of the Department that he/she feels is best qualified to fill a staff position. 14. The Department of Fire -Rescue has many experienced well-qualified individuals from all ethnic groups. This includes African-Americans. 15. During my tenure as Fire Chief four (4) African-Americans were promoted to staff positions. In reference to the above alarm I spoke with Mr. Logan (the patient). Mr. Logan claims that his speech was slurred and he had right side weakness when R6 first arrived on this alarm. He is upset because R6 did not transport him and he had a stroke the following morning._ All three crew members (Lt. Pace, R. Gonzalez and Z. Perez) stated that they went the extra mite on this patient and that an extensive assessment was given the patient which found everything to be in normal limits. Lt. Pace stated that he offered transport to the patient. Firefighter Lattener stated that the complainant was not the patient, but a bystander at the Lutheran Ministries location. A decision to walk the patient down the stairs was made after careful evaluation of the patient who contrary to complainant's statement was not bleeding. The patient was large and taking her down the narrow stairway on a stretcher would have endangered both the patient and the crew. After the decision was made, the complainant continued to question the crew about their decision, and what would happen if the patient began to give bLrth and the baby fell on the floor, whereby Lattener answered that he would then pick the baby up. The complainant then told Lattener he had a bad attitude, Lattener answered that he didn't, this continued once or twice. Immediately after this exchange, Lattener realized that this conversation had progressed too far. he said nothing more to the complainant. Captain M. Lessaicherre: Captain Lessaicherre was interviewed in person on January 30, 2000. Capt. Lessaicherre confirmed Firefighter Lattenef's version of the events. FF M. Arango: Firefighter Arango was interviewed by phone on January 30, 2000. Arango confirmed Lattenwr's statement, He added that the patient was treated with the utmost courtesy and treatment was aggressive. Conclusion: We have all probably encountered this type Of situation. Restraint must always be shown under difficult circumstances. This policy defines the transportation of patients by a Rescue. Patients may be classified as Advanced life Support (ALS) or Basic Life Support (BLS) according to the severity and prehospital treatment of their illness or injury, and then transported as described below. DESTINATION: ALS PaVents VAN be transported to the nearest capable hospital emergency department (as defined in the Hospital Capa i tq Chan in Chapter 77 of the Priotoeots, Policies b Procedures Manuao, except when the nearest capable hospital is temporarily closed, or such transport is refused by the patient (see below). ALS transports to farther hospitals must have the reasons dearly documented in the incident report. Nearest hospital is dermed as the hoVoi of emergency doWment which can be readied in the shortest time period, it Is not necessarily the closest hospital in germs of distance. The capabilities of individual emergency departments has been determined by survey of each hospital as to its capabilities in managing various categories of medical, surgical, pediatfic, and OB/Gyn problems. If two capable hospitals can by reached within approximately the same time (dithwence of approximately 3 minutes), the patient or family may choose between them. If the patient absolutely n0uses transport to the nearest capsW hospltst, but wig ecoW transport to another capable hospital within our hospital destinsftn bourdaruss (Parkway to the North and Baptist to the South), we must clearly explain the risks of the longer transport and strongly encourage going to the newest hospital. If they still refuse we will transport to the further hospital and document the event in the report narrative. If the patient deteriorates while in route to the further hospital, the transport destination will be changed to the nearest capable hospital from your cument: location. ✓BLS Patknts will usually be transported to the nearest capable hospital emergency departrnsrtt. C;IFr1t 10 7 01 • • C 5/99 EMS COMPLAINT PROCEDURE 01.01 PURPOSE: To maintain a high level of public trust and confidence in Miami Fire -Rescue Emergency Medical Services by investigating and responding to complaints as quickly as possible. 01.02 POLICY: It is the policy of the City of Miami Fire -Rescue Department that all complaints made by the public and other individuals be investigated in a timely and coordinated manner. 01.03 RESPONSIBILITY: It is the responsibility of all Miami Fire -Rescue Department officers and supervisors to ensure all complaints are processed according to. this procedure. 01.04 PROCEDURE: I. PERSON RECEIVING THE COMPLAINT: (secretaries, personnel on the scene, individuals answering the phone at a fire station, alarm office personnel, etc.) A. Obtain all appropriate information such as: 1. NATURE OF COMPLAINT 2. DATE AND TIME OF COMPLAINT 3. NAMES AND/OR UNIT NUMBER 4. PERSON MAKING THE COMPLAINT AND ANY WITNESSES NAMES 5. Individuals receiving an EMS complaint should forward all information (through channels) to the District Chief in charge of the unit or individual involved and the EMS Chief. Q. INITIAL CONTACT A. The District Chief shall contact the complainant and verify all pertinent information as necessary. The District Chief shall advise the complainant that an investigation has begun, and the complainant will be provided with results as soon as possible. B The District Chief shall advise the complainant to file a police report if the complaint is about missing property or other criminal act. C. District Chiefs receiving EMS complaints about an incident occurring on another shift are to forward the complaint immediately to the Chief of the Emergency Response Division (after obtaining all pertinent information). The Chief of the ERD will forward this information to the Chief of EMS and the District Chief in • charge of the unit or individual involved. D. When an EMS complaint is received by 40hr, or non - sworn personnel (i.e., Secretaries, Dispatchers) or other MFD employees; all pertinent information shall be gathered (see procedures, section 1) and forwarded through channels to the Chief of the Emergency Response Division. M. DISTRICT CHIEFS A. The District Chief of the unit or individual involved shall perform the initial contact. B. Forward all pertinent information (through channels) to the EMS Chief, C. Assure all requested memos deemed necessary from subordinates are forwarded through channels to the Chief of EMS.\ D. Shall make final recommendation for discipline or other action after the investigation is completed by the EMS Chief'.
