Florida Marlins
On the agenda for tomorrow's City Commission meeting there is a discussion item on (tie
status of the baseball stadium for the Florida Marlins. As you are aware, Mayor Alex
Penelas has requested a 60 -day extension of the negotiations that I assume will be part of
your discussion. Additionally, a resolution was passed that required a Memorandum of
Understanding (MOU) for the construction of a proposed baseball stadium by September
13, 2001. At this time, an MOU has not been executed.
It is my recommendation that if the Commission is to consider the requested 60 -day I
extension for all parties to reach a final agreement, that it should be subject to the V
following conditions:
1. The Florida Marlins or the '`Team" will not enter into or continue any negotiations
with any parties other than the City and the County regarding the location/relocation of
the Team or its playing facilities. In addition, the Florida Marlins will agree to lobby
Major League Baseball to keep the Team in South Florida (specifically, the City of
Miarni) and will make all attempts to preclude Major League Baseball from considering
contraction of the Team.
2. The Florida Marfins will provide bi-weekly updates to tile: City Commissioners
throughout this 60 -day extension period.
3. The Florida Marlins will pay no later than September 20, 2001., a non-refundable
extension fee in the amount of $150,000, which will be used by the City of Miami for all
third party project -related expenses incurred by the City from June 15, 2001 and during
this 60 -day extension period. These project -related expenses include the payment of fees
and expenses of consultants retained by the City of Miami far the purposes of evaluating
the feasibility, financing and development of this proposed baseball stadium. It should be
noted these fees are for third party expenses incurred to date by the City of Miami and
exclude the significant amount of staff time that has been dedicated to this project.
Payment of this fee will allow the City of Miami to continue to dedicate the resources
required to keep this project moving forward.

4. It is understood that the City of Miami's obligation under this Agreement is to use its
best efforts to reach a final Memorandum of Understanding executed by the Florida
Marlins, the City of Miami and Miami -Dade County by November 12, 2001. This letter
of understanding is not intended to provide the Florida Marlins or anyone else with any
assurances, implied or otherwise, that any financing or other transaction can be obtained
or will be consummated by the City of Miami related to the construction of the proposed
Major League Baseball stadium.

Dear Sirs:
In light of the national tragedy and the ongoing effects of that tragedy on both Major League
Baseball and the financial industry that is the core of my other business, I respectfully request
your forebearance on matters relating to a new ballpark in downtown Miami.
I hope you understand that my attention over the past few days has been focused, and will
continue to be focused, first and foremost on both baseball policy matters relating to the
appropriateness of the industry's resumption of play and on the impact of the tragic events on cny
clients and colleagrues in the financial industry.
We remain cornmitted to seeing a ballpark built in South Florida and moving forward with this
process at the appropriate time.
