Martinez Date: June 11. 2000 E Re: Property Located at 2337 S.W. 21" Street, Miami, Florida 33145 TIMELINE OF EVENTS History 1927: My house was originally built consisting of lots 4, 5, and 6. 1970: The owner at that time sold lots 4 and 6. The City of Miami approved the division of the lots without taking into consideration that Lot 5, where my house is, consisted of two legal units (Units A and B). According to the City's zoning codes, because my property consisted of two legal units, it was required to have two lots (Lots 5 and 6). Nevertheless, the City approved the sale of Lot 6. In addition to allowing the sale of Lot 6, the property line between Lots 5 and 6 is wrongfully divided. The property line between Unit B in Lot 6 should have had at least 5 feet. Instead there are only 2 feet between Unit B and the property line of Lot 6. The City failed to follow the law by allowing the illegal division between Lots 5 and 6, and for allowing the sale of Lot 6 knowing that Lot 5 consisted of two legal units, and was required to have two lots. Furthermore, the City has lost all permits and documents for my house between 1927 and 1970. The only three documents the City has for the period between 1927 and 1970 are: I. The real property record, 2. A permit from the Division of Plumbing dated March 26, 1929, for a new waste line from dwelling unit connecting "1 water closet, 1 bathtub, 1 lavatory, 1 sink" to the septic tank; and 3. Incomplete plumbing diagram dated "1/9/37." If the City wants to use the permit dated March 26, 1929, which connects a new waste line to the septic tank, to be for Unit A, then why is it that there are two lines from Unit A and Unit B, and there is no mention of on this document of a second lavatory and a second water closet as it documented on the real property record from 1927? Tomas Reaalado • June 11.201X1 Palle 2 1971 After 1937, the City has no evidence of any permits because they were los% or they do not want to admit they have them. My family buys the property on Lot 5 consisting of Unit A and Unit B. as they are today. The front house and the house in the rear (Unit B) consisting of one bedroom, one bathroom, a living/dining area, and a full kitchen. 1996. After receiving notice from the City of complaints made by Conchita Moreno, I went to the City of Miami and found the only two documents the City had. Inspector Juan Gonzalez authorized a permit for a dwelling unit for the rear unit. His only concern at that time was that in the Real Property Record it indicated a garage in Unit B. Unfortunately, because the City lost all the documents between 1929 and 1970, no one knows when they changed the garage to what it is today. However, in the diagram from 1929, there was a sink connected to a line to the existing septic tank. 1997-98: All the electric wiring was changed in both units A and B to comply with the new City codes. At this time, the City inspector advised us that it was illegal to have one electric meter for two dwelling units, and therefore, we had to add a second meter for the rear unit. We now pay separate electric bills for each unit. 2000; After 19 years, the kitchen cabinets and sink. for Unit B were changed. I obtained a permit for these changes and it was approved by the City. 2001 Complain : March 22: Conchita Moreno and her brother, Blas Moreno, who is around 70 years old and lives in Rhode Island and studied medicine in the Army, go to see Sergio Guadix to complain that we have an illegal unit. According to Sergio, they put pressure on him to open an investigation. March 27 I went to the City to speak with Sergio Guadix. Mr. Guadix admits that Conchita Moreno is pressuring him. April 23: Inspectors Navarro and Pau go to my house to inspect the property. They do not find anything illegal, and they close the case. April 30: Sergio Guadix demands to open the case again alleging that he has observed discrepancies in the City records. After meeting with a few inspectors, they decide that I have to take out the stove, and the kitchen sink. She also said that I had 30 days to comply with their decision, and that I could rent the unit. To this day. I have not received any written documentation indicating the City's demands. I have worked with engineers for more than 25 years. Not only am I aware of the City's codes, but I have also consulted with various engineers about this matter. According to a Division of Plumbing Inspection permit dated March 26, 1929, the waste line was connected to the septic tank at that time, and it includes a sink and a bathtub. Thereafter, on the diagram dated "1/9/37," it seems that the bathtub on the rear unit was changed to a shower. At the top left of the paper, it states: "THIS SPACE FOR ELEVATION SKETCH." The small print underneath that heading states: In alteration to existing work show the old work in red ink and the new in black ink...." Unfortunately, because this is a copy, no one can tell which one is the old (red) and which is new (black). At the right of the paper it states: "THIS SPACE FOR PLAN SKETCH." The small print under this heading states: "Show location of stack and horizontal drains inside building, lettering each opening stack connections as shown on the elevation sketch on opposite page.... " The diagram underneath this heading indicates a shower and the configuration for the new connection. Because the configuration for the shower is different than for a bathtub, the connection had to be changed. Therefore, the alteration does not involve the sink and it is not shown on the diagram on the right side. The diagram on the left shows that the line for the sink was connected separately to the main line, and hence it is not on the diagram. As mentioned before, because no one can tell which part of the alteration was in red and which was in black, it is very difficult to interpret with exactitude. Further, this document is incomplete as it is missing the floor plan that they mention on the diagram, which were lost by the City. When 1 met with Sergio Guadix and he saw this documents, lie tried to confuse me by arguing that the diagram on the left was the front unit (A) and the diagram on the right was the rear unit (B). However, when anyone reads the heading and small print on each side of the document, it is clear that both diagrams refer to the "Rear House." Violations committed by the City of Miami 1. The City allowed the sale of Lot 6 when there were two legal units, A and B, on Lot 5. According to zoning; codes, because Lot 5 has two units, it should consist of two lots. 2. The property line between Unit B and Lot 6 is 2 feet when according to the City codes, it should have been at least 5 feet to be legal. The City lost all documents from 1927 to 1970. They know this, but it is not in their best interest to admit it. Facts to Consider: 1. Unit B has been grandfathered for more than 30 years. Since we bought this property in 1971, this unit has been grandfathered. What changes were made to the property before we bought it in 1971 is unknown as again, the City lost all documents from 1927 to 1970. 2. On the ARPS Property System Property Parcel Inquiry, the property is categorized as a "duplex." Sergio Guadix told me this did not matter and was not important. 3. We have pay solid waste fees for two units; duplex and dwelling unit for many years. 4. To require me to request a permit for structural remodeling it is just plain harassment as it will never be approved by the City. Furthermore, they know that if the structure is remodeled in any way, I would lose the grandfather clause for Unit B. Sergio Guadix knows this, and is trying to get me to do this because Conchita Moreno knows that I am entitled to have at least 5 feet between her property and Unit B, plus Lot 6 because I have a legal second unit on my property since 1927. Conchita Moreno is a mean-spirited person who enjoys causing problems and threatening people. She has continuously put pressure on the City to find that Unit B is illegal. The City in order to get her off their backs, has found a way to confuse me with the 1937 drawing, and is now asking me to do something that will forfeit the grandfather clause Unit B has had for the last 30 years. Furthermore, the City should be held responsible for their failure to properly follow their own zoning codes by allowing Lot 6 to he divided and sold improperly. Sergio Guadix has forced me to obtain legal counsel to handle this matter. According to everyone with whom I have spoken about this, the manner in which the City has handled this matter is unfair, unjust, and unsubstantiated. They are forcing me to take all necessary steps that will bring justice to this case, including bringing in the media and exposing those who are responsible for the injustice. This has already gone too far. Finally, the City knows that codes are constantly changing, and they cannot require homeowners to comply with the new codes. They know this, but they do not want to admit it. My father is 90 years old and has health problems. My mother is 82 and has Alzheimer disease. 1 have to work and take care of them, which is hard enough Because of the stress caused by this matter, I even had to be hospitalized last month for chest pains caused by stress. The City has taken advantage of my vulnerable situation, and what they are doing is abusive. My family has been living at the property located at 2337 S.W. 21" Street, since April 197 1. When my father bought this property, it consisted of the main house in the front and a small detached "servant quarter" in the back consisting of one bedroom, a bathroom, a kitchen, and a living/dining room area. Because the house was built in 1927, when the zoning laws were changed, the unit in the back was grandfathered in. Further, as you will see from the attached City records, the house is considered a duplex, and as such we pay waste fees and have electric service meters for two units. The city and county taxes are appraised on two units, and are paid as such. For all intent and purposes this property has always consisted of two inhabitable separate units, and the rear unit has always been legally rented. As you will see from the attached documents, we have always requested permits for all of the work that has been done to this property in order to comply with the City's requirements. About twenty-five years ago, Conchita Moreno's family bought the house located next to our property (2345 S.W. 21" Street). From the time they moved in, she has continuously harassed and created problems for our family. Although this is City property and to an effort to avoid problems, we asked our visitors to make sure they parked to front of our house, or in our driveway. G She then started calling our house complaining that she could hear our visitors laughing and making noises. These visitors were in our house during the day, and they were normal visitors, not parties or large gatherings. She then started claiming that the unit in the rear was illegal. At one point about 12 years ago, site even went to the City Records Department looking for our property records to find out if the unit was illegal. After she found out that it was legal, site stopped complaining about the unit for a while. In 1996, two friends and I were building a desk with shelves for my study in our back yard. On several occasions she took pictures of my friends while they were building the desk. In one instance, she took the pictures in front of me and I took them away from her. During this time, site kept harassing us because she did not want any noise to come from our house. She proceeded to complain to the City about our property. We received a letter from the City stating that we were violating the laws by having "an illegal unit, illegally operating a business in a residential zone, illegal mechanical repair, work complete without a permit, building and/or roofing, etc." When the inspector came to look at our property, she did not find any such violations, and said everything was legal. After she continued to complain to the inspector about our property and harassing us, we had to hire an attorney to stop her from making false accusations and threats. L In 1999, a dog broke a garbage bag that was left on the street on the morning the garbage was to be picked up. When my father saw that the bag was broken, he and two other neighbors put the garbage in a new bag that was picked up later that day. Again, she complained to the City authorities. We received a letter warning us that if we did not place the garbage out on the specific days and tithes, we would have to pay a fine. L In 2001, she again complained to the City authorities about our unit in the rear. Throughout all these years we have tried everything to keep her at peace. We have accommodated her every time she complained. Realizing that the only way to avoid any confrontations, we stopped all communications with her about 14 years ago. We live in a good neighborhood with some neighbors that are like family to us. Unfortunately, we have someone who does not bet along with most of the other neighbors. As a matter of fact, only two or three neighbors still talk to her. The gentleman lived alone in the house with his dog. After the dog was found dead, his health deteriorated and lie had a few strokes. One day, after having a verbal confrontation with her in his back yard, he had a heart attack and was found dead a couple of days later. This is a woman who likes to intimidate people. She does not work, and she thrives on making other people's lives miserable. For the past 25 years she has done everything possible to intimidate us and make our lives impossible. We arc at a point that we feel she has a personal vendetta against our family. 1 live on this property with two elderly parents My father is 90 years old and has a heart condition. My mother is going to be 82 years old and has Alzheimer disease. As you can imagine, taking care of two elderly parents who are ill is not easy. I have instructed my father not to go outside the house when she is out, which is something 1 also do. We live in a free country and we are United States citizens. We bought this property 30 years ago and, like all citizens, we pay taxes on it. However, because of this woman, we live in constant fear of doing anything outside of our property for fear of a confrontation and/or her incessant threats. I would respectfully request that you and your office please disregard the recent complaint filed by Conchita Moreno against us and our property. As all of the records indicate. our property is fully compliant with the laws of the City of Miami. We would also ask you to help us in putting a stop to the constant harassment by Conchita Moreno to our family. We do not want to cause any problems for her; we just want to be left alone to enjoy our property as citizens and owners at 2337 S.W. 21" Street.
