ORDINANCE NO.
AN ORDINANCE OF THE MIAMI CITY COMMISSION
AMENDING CHAPTER 2/ARTICLE XI/DIVISION 11 OF
THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "ADMINISTRATION/BOARDS,
COMMITTEES, COMMISSIONS/PARKS ADVISORY
BOARD," TO PROVIDE THAT THE CHAIRPERSON OF
THE PARKS ADVISORY BOARD (THE "BOARD") MAY
EXCUSE THE ABSENCE OF A BOARD MEMBER IF THE
MEMBER'S ABSENCE IS DEEMED, UNAVOIDABLE; MORE
PARTICULARLY BY AMENDING SECTION 2-1144.4 OF
SAID CODE; CONTAINING A. REPEALER PROVISION
AND A SEVERABILITY CLAUSE AND PROVIDING FOR
AN EFFECTIVE DATE.
WHEREAS, Section 2-886rof the Code of the City of Miami
Florida, as amended, provides the automatic removal of a member
of a City of Miami board;;committee, or commission, if the member
is (a) absent from thyee consecutive meetings or (2) absent from
four of the Boards'�fneetings; and
WHEREAS, due/to emergencies or unforeseen personal reasons,
members of they"Parks Advisory Board (the "PAB") have missed
meetings of tVe PAB; and
the members appointed to the PAB are individuals
who posses the knowledge and expertise necessary to carry out
the dulVies as charged by the City Commission; and

WHEREAS, the City Commission deems it in the best interest
of the citizens of the City of Miami to amend the City Code to
provide that the Chairperson of the Board may excuse the absence
of a Board member if the member's absence is deemed unavoidable;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Ordinance are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. Chapter 2/Article XI/Division 11 of the Code
of the City of Miami, Florida, as amended, is hereby amended in
the following particulars:'/

2/ This Ordinance shall become effective as specified herein unless vetoed
by the Mayor within ten days from the date it was passed and adopted.
If the Mayor vetoes this Ordinance, it shall become effective
immediately upon override of the veto by the City Commission or upon the
effective date stated herein, whichever is later.

Ordinance Amending City
Code for Parks Advisory Board
It is respectfully recommended that the City Commission adopt the attached ordinance
amending Chapter 2/Article XI of the City Code, entitled "Administration/Boards,
Committees, Commissions", to permit excusable Board member absences for members of the
new Parks Advisory Board that have emergencies or legitimate personal reasons for not
attending board meetings, therefore, not resulting in their removal should they miss a certain
number of meetings as stated in the code.
BACKGROUND
In the regular monthly board meeting of September 27, 2000, the members of the Parks
Advisory Board requested an exception to the code requirements for attendance, to permit
board members who have an emergency or a true legitimate personal reason for not attending
a board meeting, to remain on the board of the number of absences exceed the current
number allowed by the code.
Several existing Parks Advisory Board members with a strong desire and commitment to
serve, risk being automatically removed from the board even though some have unavoidably
missed meetings for medical or other business reasons. In order to keep these valued citizens
on this board, adoption of this ordinance is recommended.
